LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1497 entitled: AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM M (HEAVY COMMERCIAL AND MANUFACTURING) DISTRICT TO P -D (PLANNED DEVELOPMENT) DISTRICT (540 Francisco Boulevard West) (Bacci Project) is a true and correct copy of an ordinance of said City and was introduced at a REGULAR meeting of the City Council of the City of San Rafael, held on the FIFTH day of NOVEMBER , 1984, published as required by City Charter in the INDEPENDENT JOURNAL a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a REGULAR meeting of the City Council of said City held on the NINETEENTH day of NOVEMBER 1984, by the following vote, to wit: AYES: COUNCILMEMBERS: Nave, Russom and Mayor Mulryan NOES: COUNCILMEMBERS: Breiner ABSENT: COUNCILMEMBERS: Frugoli WITNESS my hand and the official seal of the City of San Rafael this 21st day of NOVEMBER 1984. ' JEA �LEOANCI-1,erk ORDINANCE NO. 1497 AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM M (HEAVY COMMERCIAL AND MANU- FACTURING) DISTRICT TO P -D (PLANNED DEVELOPMENT) DISTRICT ( 540 Francisco Boulevard West) (B.acci Project) THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. The Zoning Map of the City of San Rafael, California, adopted by reference by Section 14.15.020 of the Muni- cipal Code is amended by reclassifying the following real property from M (Heavy Commercial and Manufacturing) District to P -D (Planned Development) District. Said property so reclassified is located at 540 Francisco Boulevard Pest, San Rafael, County Assessor's Parcel 13-051-23, described in Exhibit "B", which is attached hereto and made a part hereof. DIVISION 2. Any development of this property shall be subject to the conditions outlined in Exhibit "A" which is attached hereto and made a part hereof. DIVISION 3. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage. LEON I, City lerk - 2 - EXHIBIT "A" Conditions/Development Standards which were included as part of the zoning (Z84-8) action by the Planning Commission on September 25, 1984: (a) The P -D zoning shall be limited to development of an automobile dealership contained within four buildings. Any change in the operation or type of dealership shall be subject to an amendment of the approved use permit for review of potential traffic impacts. (b) Development of an automobile dealership at this location shall be subject to the following development standards: 1) Building setbacks: -a Minimum frontyard setback - 25 feet; -b Minimum rearyard setback - 15 feet; and -c Minimum sideyard setback - 5 feet. 2) Building height: 30 feet average (25'-32'). Any minor modifications to setbacks, building height, and building coverage can be processed as a modification to the approved design review. (c) This P -D zoning shall be subject to amendment when or if the 55 -foot wide highway "take" occurs. This "take" may result in modifications to the site plan (building, parking and landscaping). (d) This P -D zoning shall be valid for 18 months from the date of City Council adoption unless subsequent permits have been filed and approved. EXHIBIT "B" DESCRIPTION: All that certain real property situate in the City of San Rafael, County of Marin, State of California described as follows: Lands of Bacci as recorded in Document No. 82043049 of Marin County Records, being Parcel 2 of that certain parcel map "Lands of Bacci and Lands of San Rafael Redevelopment Agency as Described in Book 3763 of Official Records at Page 449, Marin County Records" as recorded in Book 21 of Parcel Maps at Page 18, Marin County Records. Containing 2.317 acres, more or less.
