LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1493 entitled: "AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNI- CIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM P -D (PLANNED DEVELOPMENT) DISTRICT TO P -D (PLANNED DEVELOPMENT) DISTRICT" (1301 Third Street, "Centertown") is a true and correct copy of an ordinance of said City and was introduced at a Regular meeting of the City Council of the City of San Rafael, held on the fourth day of February , 1985, published as required by City Charter in the Independent Journal , a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a Regular meeting of the City Council of said City held on the Nineteenth day of February 1985, by the following vote, to wit: AYES: COUNCILMEMBERS:Frugoli, Nave, Russom & Mayor Mulryan NOES: COUNCILMEMBERS:None ABSENT: COUNCILMEMBERS:Breiner WITNESS my hand and the official seal of the City of San Rafael this Nineteenth day of February , 1J 85. LEA t_y Clerk k ORDINANCE NO. 1498 AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNI- CIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLAS- SIFY CERTAIN REAL PROPERTY FROM P -D (PLANNED DEVELOP- MENT) DISTRICT TO P -D (PLANNED DEVELOPMENT) DISTRICT (1301 Third Street, "Centertown") THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. The Zoning Map of the City of San Rafael, California, adopted by reference by Section 14.15.020 of the Muni- cipal Code is amended by reclassifying the following real property from P -D (Planned Development) District to P -D (Planned Develop- ment) District. Said property so reclassified is located at 1301 Third Street, San Rafael, County Assessor's Parcel 11-254-18 described in Exhibit "B". DIVISION 2. Any development of this property shall be subject to the conditions outlined in Exhibit "A" which is attached hereto and made a part hereof. DIVISION 3. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published, and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage. E&I I, City lerk The foregoing Ordinance No. 1498 was read and intro- duced at a Regular meeting of the City Council of the City of San Rafael, held on the 4th day of February , 1985, and ordered passed to print by the following vote, to wit: AYES: C OUNC I LME MBE RS : Breiner , Frugoli , Nave, Russom and Mayor Mulryan NOES: COUNC ILMEMBERS :None ABSENT: COUNC ILME MBERS: None and will come up for adoption as an Ordinance of the City of San Rafael at a Regular meeting of the Council to be held on the Nineteenth day of February , 1985. i 22 A/7 ORIGIN EXHIBIT "A" Conditions which were included as part of the zoning [Z82 -18(b)] action by the Planning Commission on January 15, 1985: (a) This P -D (Planned Development) rezoning is approved for a 63 unit condominium complex restricted to occupancy by persons 60 years of age or older. This provision shall be contained in the CC&Rs. Any proposed modification of the age restriction would require rezoning. Sixty-two parking spaces are provided on-site; seven additional parking spaces shall be available for limited use on the adjacent parcel. Five of the units shall be below market rate, affordable to one person families at 90% of median for studio units and median income for one bedroom units. If any units are rented, all senior age restrictions continue to apply. (b) All conditions of UP82-91(b), ED82-89(b), and TS83-7(b) and any subsequent modifications thereof shall be satisfied. (c) The P -D rezoning is approved for this project only. If any of the project approvals expire, the zoning shall automatically revert to the previous C-2 (General Commercial) District. (d) The rezoning is valid for a period of 18 months or until June 15, 1986, and shall become null and void if a building permit is not issued or an extension granted. EXHIBIT "B" Description All that certain real property situate in the City of San Rafael, County of Marin, State of California, being a portion of Block 15 as said Block is laid down and delineated on Map of Town of San Rafael, filed in the office of the County Recorder of the County of Marin, State of California, October 141, 1873, described as follows: BEGINNING at the corner formed by the intersection of the South line of Third Street with the West line of C Street; running thence Southerly along the West line of C Street 192.0 feet; thence Westerly and parallel with Third Street 150 feet; thence Northerly and parallel with C Street 36.0 feet; thence Westerly and parallel with Third Street 52.4 feet; thence Northerly and parallel with C Street 152.88 feet to the Southerly line of Third Street; thence Easterly along the Southerly line of Third Street 204.31 feet to the Point of Beginning. 26.1 A/13
