LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1499 entitled: "AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM R-2 (DUPLEX RESIDENTIAL) DISTRICT TO C-1 (RESTRICTED COMMERCIAL) DISTRICT" (101 Third Street) is a true and correct copy of an ordinance of said City and was introduced at a Regular meeting of the City Council of the City of San Rafael, held on the Fourth day of February , 1985, published as required by City Charter in the Independent Journal , a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a Regular meeting of the City Council of said City held on the Nineteenth day of February 1985 by the following vote, to wit: AYES: COUNCILMEMBERS:Frugoli, Nave, Russom & Mayor Mulryan NOES: COUNCILMEMBERS:None ABSENT: COUNCILMEMBERS:Breiner WITNESS my hand and the official seal of the City of San Rafael this Nineteenth day of February 19-S5. LEONCIN , City.0 erk ORDINANCE NO. 1499 AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM R-2 (DUPLEX RESIDENTIAL) DISTRICT TO C-1 (RESTRICTED COMMERCIAL) DISTRICT (101 Third Street) (Western Boat Shop and Barbary Coast Yachts) THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. The Zoning Map of the City of San Rafael, California, adopted by reference by Section 14.15.020 of the Muni- cipal Code is amended by reclassifying the following real property from R-2 (Duplex Residential) District to C-1 (Restricted Commer- cial) District. Said property so reclassified is located at 101 Third Street, San Rafael, County Assessor's Parcel 14-161-20 described in Exhibit "A" attached. DIVISION 2. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published, and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage. JEA L bNCI ,amity erk ()R, ji, G�N AL EXHIBIT "A" DESCRIPTION: All that certain real property situate in the City of San Rafael, County of Marin, State of California described as follows: BEGINNING at a stake at the Northeasterly corner of that tract of land deeded to Hans Iverson by Isaac Shaver, said point being in the Southerly line of the San Rafael and Point San Pedro Road, and said stake being Southerly ten and three quarter (10 3/4) degrees West 280 feet from a double or forked oak tree blazed and marked B.T. 103 and being the same oak referred to in a deed from Wm. T. Coleman to Isaac Shaver recorded in Book "J" of Deeds, at page 331, thence running Westerly along the Southerly line of said road 40 feet, more or less, to the True Point of Beginning of this description; thence from said True Point of Beginning North 3°45' East 60.85 feet to a point in the Southerly line of Point San Pedro Road, as described in the Deed from the Board of Education of the City of San Rafael, to the City of San Rafael, recorded January 18, 1934 in Book 226 of Official Records, at page 105, Marin County Records; thence along said line South 66°17' East 42.52 feet; thence South 66°36' East 152.2 feet; thence along an arc concave to the right having a radius of 327.12 feet, through an angle of 9°35'18" a distance of 54.7 feet, more or less; thence leaving said Southerly line of Point San Pedro Road South 26°48' West 46 feet, more or less, to the Northerly line of San Rafael Canal, as said Canal is shown upon "Map No. 2 of Salt Marsh and Tidelands situate in the County of Marin, State of California" and prepared in 1870 for the Board of Tideland Commissioners; thence along said Northerly line North 81° West 180 feet, more or less, and South 69°30' West 40 feet, more or less; thence leaving said Northerly line North 3°45' East 63 feet, more or less, to the True Point of Beginning. Containing 0.37 acres, more or less.
