JE t LEONCINI, City C erk ORDINANCE NO. 1401 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AMENDING TITLE 14 OF THE SAN RAFAEL MUNICIPAL CODE (ZONING ORDINANCE) BY ADDING CHAPTER 14.47, C-4 (DOWNTOWN COMMERCIAL)DISTRICT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. Title 14 of the San Rafael Municipal Code (Zoning Ordinance) is hereby amended by adding a new Chapter 14.47, titled C-4: Downtown Commercial to read and provide as follows: CHAPTER 14.47 C-4: DOWNTOWN COMMERCIAL DISTRICT SECTIONS: 14.47.010 Purpose. 14.47.020 Use regulations. 14.47.030 Building height limit. 14.47.040 Building site area required. 14.47.050 Yards required. 14.47.010 PURPOSE. To enhance development and maintain a balance of retail and non - retail commercial uses at all street level or first floor locations in the Downtown District by requiring Use Permit Review of office, bank, and financial institution uses. 14.47.020 USE REGULATIONS. I PERMITTED USES: a. Retail stores and personal service establishments within a building, including appliance stores, bakeries, barber shops, beauty parlors, book stores, department stores, drug stores, food shops, hardware stores, mortuaries, nurseries, radio stores, restaurants, shoe shops, studios, tailor shops, and other uses which in the opinion of the Planning Commission are of a similar nature. b. Social halls, lodges, fraternal organizations and clubs. c. Offices at second floor locations or above. II USE PERMIT. The following uses are permitted, subject to obtaining a use permit in each case: a. Banks, financial institutions, and offices at street level or first floor locations. b. Ambulance service, animal hospitals, automobile repair shops, cleaning and dyei►g establishments, creameries, discos, gasoline service stations, laundries, launderettes, live entertainment, outdoor markets, outdoor sales establishments, marine uses, pet shops, public garages, used car lots, fast food establishments, yacht harbors, establishments selling prepared food intended for consumption on the premises in a vehicle, and other uses which, in the opinion of the Planning Commission, are of a similar nature. c. Single family dwellings, duplexes, multiple family dwellings, apartment houses, hotels, motels, rooming or boarding houses and dwelling groups. d. Churches, schools, parks, playgrounds, public and quasi -public buildings. e. Family Care Facilities, Group Care Facilities, Day Care Facilities, and Major Medical Facilities. 14.47.030 BUILDING HEIGHT LIMIT. Maximum height any building - fifty (50) feet. �uhl' GINAL - 1 - ORDINANCE NO. 1401 14.47.040 BUILDING SITE AREA REQUIRED. a. For each main building - minimum two thousand (2,000) square feet. 14.47.050 YARDS REQUIRED. a. Front Yard - none, except where the frontage in a block is partially in an R District, in which case the front yard shall be the same as required in such R District. b. Side Yard - none, except where the side of a lot abuts upon the side of a lot in an R District, in which case the side yard shall be not less than ten (10) feet. c. Rear Yard - none, except where the rear of a lot abuts on an R District, in which case the rear yard shall be not less than ten (10) feet. DIVISION 2. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance, and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid. DIVISION 3.
