LEON CI City Clerk ORDINANCE NO. 1404 AN URGENCY ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING TITLE 14, ZONING OF THE SAN RAFAEL MUNICIPAL CODE RELATING TO MOBILE HOMES THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. Section 14.08.140 is hereby amended by deleting the definition of "Mobile Home"; by adding to the "Mobile Home Lot" definition title", Mobile Home Park District", and by adding the following definitions: MOBILE HOME: A structure transportable in one or more sections, which in the traveling mode, is eight feet or more in width and forty feet or more in length or, when erected, is three hundred twenty or more square feet in area, and which is built on a permanent chassis. As used in Chapter 14.14, "mobile homes" includes manufactured housing units meeting the above definition. It does not include recreational vehicles, motor coaches, trailer coaches or travel trailers. MANUFACTURED HOUSING: Both mobile homes and other housing units subject to the Uniform Building Code which are either wholly or mainly manufactured at an offsite location and are assembled onsite. DIVISION 2. Section 14.13.100 E is hereby amended by adding to the "Mobile Homes" title "Mobile Home Park District". DIVISION 3. Section 14.75.020 is hereby amended by deleting "h" and by adding the following Section h. h. Mobile homes, travel trailers, trailer coaches and motor coaches may be used for commercial, professional or in- dustrial purposes if a use permit is first obtained in each case. Temporary occupancy not to exceed ninety (90) days may be permitted for night watchman's quarters or for other security purposes if a use permit is first obtained in each case. Travel trailers or motor coaches shall not otherwise be used for human habitation. DIVISION 4. Chapter 14.14 is hereby added to Title 14, the City of San Rafael Zoning Ordinance, as attached. ORDINANCE NO. 1404 DIVISION 5. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining por- tions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. DIVISION 6. Urgency Ordinance. This ordinance is hereby declared to be necessary for the immediate preservation of the public peace, health, and safety and will take effect and be in full force upon its adoption by a four-fifths' vote of the members of the San Rafael City Council. Senate Bill 1960 (California Statutes of 1980), codified at Government Code, section 65852.3 and Health and Safety Code, section 18300, became effective on July 1, 1981. This legislation allows the City to exercise the authority set forth in this ordinance. If this ordinance were not to become effective immediately, there would result uncertainty as to the nature of the regulations which would be applied to mobile home applications sub- mitted after July 1, 1981, but before the effective date of this ordinance. CHAPTER 14.14 MOBILE HOMES Purpose. Applicability. Establishment. Application Processing. Findings. Compatibility Criteria. Expiration. Appeals. This ordinance is adopted to increase the supply of housing and variety of housing types available to the public by establishing a method for placement of mobile homes within all zoning districts which allow single family dwellings. 14.14.020 APPLICABILITY. This Chapter does not apply to mobile homes in the Mobile Home Park District or to mobile homes allowed in accordance with Sections 14.75.020 (h) and M. Any mobile home subject to this Chapter must, at a minimum, meet the standards set forth in the National Manufactured Housing Construction and Safety Standards Act of 1974 (42 USC 5401 et seq.), as amended at the time of any placement of such mobile homes; not to be altered in violation of applicable codes; and be placed on a permanent foundation. The mobile home may be placed on a lot zoned for single family use upon approval of a Certificate of Compatibility. All mobile home additions will also require a Certificate. 14.14.030 ESTABLISHMENT. The Zoning Administrator shall have authority to grant Certificates of Compatibility in accordance with the provisions of this Section. The Certificate of Compatibility shall be issued prior to issuance of a building permit. 14.14.040 APPLICATION PROCESSING Applications for Certificates of Compatibility shall be in the form required by the Planning Department. 14.14.050 FINDINGS The Zoning Administrator shall grant a Certificate of Compatibility upon a finding that the project meets the criteria for compatibility. 14.14.060 COMPATIBILITY CRITERIA. A Mobile Home Certificate of Compatibility shall be issued if: MOBILE HOMES 14-1 1. The lot is within an area zoned for single family dwellings. 2. The manufactured home is to be used as a residential dwelling. 3. The home meets all zoning, subdivision and development standards which would apply to a site built residence on the same lot. 4. The home is attached to a permanent foundation system which conforms to State and local code requirements. 5. The mobile home is at least 20 feet in body width and is multi - sectional. 6. The roof and exterior siding and trim are of materials and treatment commonly found on site built residential structures in the surrounding area. 7. The exterior covering material shall extend to the ground, except that when a solid concrete or masonry perimeter foundation is used, exterior covering materials need not extend below the top of the foundation. Alternative skirting materials commonly found on site built homes in the area will be considered compatible. 8. The roof pitch of the mobile home shall be compatible with other homes in the neighborhood. 9. Eave and gable overhangs are not less than 12 inches from the vertical side of the home. This requirement may be modified where eaves of surrounding homes are less than 12 inches. 10. Exterior roofing and siding materials of any garage or car- port, shall be identical to that of the main structure. 11. Garages or carports shall be similar to those of site built structures in the surrounding area. 14.14.070 EXPIRATION. A Certificate of Compatibility shall become void twelve months following the date of approval unless a valid building permit is obtained. The Certificate shall also become void if the building permit expires. 14.14.080 APPEALS Any person affected by a determination made in accordance with this article may appeal such determination by the procedures set forth in Chapter 14.84.
