ORDINANCE NO. 1420
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL AMENDING THE SAN RAFAEL MUNICIPAL CODE
TITLE 15 CONCERNING THE MERGER OF SUBSTANDARD LOTS
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. Chapter 15.10 "Merger of Substandard Lots" is
hereby added to read as follows:
CHAPTER 15.10
MERGER OF SUBSTANDARD LOTS
SECTIONS: 15.10.010 Merger Required
15.10.020 Notice of Merger
15.10.010 MERGER REQUIRED
Two or more contiguous parcels or units of land
held by the same owner shall be deemed merged
if:
a) at least one of the contiguous parcels or
units of land does not conform to standards
for minimum parcel size, as determined by
the most restrictive of the following:
(1) minimum parcel size of 5,000 square
feet; or
(2) minimum parcel size of the zoning
district in which it is located; or
(3) minimum parcel size as modified by the
slope provisions contained in Section
15.34.020; and
b) at least one of the contiguous parcels or
units of land is not developed with a
building for which a permit has been issued
by the City or which was built prior to the
time such permits were required.
15.10.020 NOTICE OF MERGER
Whenever the Building Department or Planning
Department has knowledge that real property has
merged pursuant to Section 15.10.010 above, a
Notice of Merger shall be filed by the Planning
Director with the County Recorder. This notice
shall identify the real property subject
to merger and the name(s) of the record owner(s).
The City shall notify the owner(s) in writing,
at least 30 days prior to the recording
of the notice, specifying a time, date and
place at which the owner(s) may present evidence
to the legislative body why such notice should
not be recorded.
DIVISION 2. If any section, subsection, sentence, clause or
phrase of this Ordinance is for any reason held to be invalid, such
decision shall not affect the validity of the remaining portions of
this Ordinance. The Council hereby declares that it would have adopted
the Ordinance, and each section, subsection, sentence, clause, or
phrase thereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses or phrases be declared invalid.

ORDINANCE NO. 1420
DIVISION 3. This Ordinance shall be published once in full
before its final passage in a newspaper of general circulation,
published and circulated in the City of San Rafael, and shall be in
full force and effect thirty (30) days after its final passage.

The foregoing Ordinance No. 1420 was read and intro-
duced at a Regular meeting of the City Council of the City of
San Rafael, held on the 21st day of December , 1981, and
ordered passed to print by the following vote, to wit:

NOES: COUNCILMEMBERS: None
ABSENT: COUNCILMEMBERS: None
and will come up for adoption as an Ordinance of the City of San
Rafael at a Regular meeting of the Council to be held on the
18th day of January , 1982.
