LEONCIN fit Clerk ORDINANCE NO. 1423__ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AMENDING TITLE 14 (ZONING CODE) BY ADDING CHAPTER 14.64 "COIN" OPERATED AMUSEMENT DEVICE CENTERS AND A DEFINITION FOR COMMERCIAL RECREATION USES: THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. Title 14 of the San Rafael Municipal Code is hereby amended by adding a new Chapter 14.64 to read as follows: CHAPTER 14.64 COIN OPERATED AMUSEMENT DEVICE CENTERS (uses with 5 or more coin operated Amusement Devices) SECTIONS: 14.64.010 Standards 14.64.010 STANDARDS Coin operated amusement device centers shall comply with the following standards. a. Use permits shall be granted for periods of no more than six months initially. The Zoning Administrator may approve extensions. In approving Use Permits and extensions, find- ings must be made that the use will not or has not created or increased the incidence of loitering, vandalism, pedestrian obstruc- tion, excessive noise, or any other activity that may have an adverse effect on adjacent or vicinity properties, residences, or businesses. b. No use permits shall be located within 300 feet of a public or private grammar, middle or high school. C. One vehicular parking space shall be provided for each five coin operated amuse- ment devices. This requirement shall also apply to those arcade businesses located in Parking Assessment Districts. d. One on-site bicycle parking space shall be provided for each two coin operated amusement devices. Bicycle parking shall be in bicycle racks or stands and shall not obstruct required exits. Bicycle parking may be required inside buildings if no acceptable outside area exists on-site. Bicycle parking may be waived for "adults only" establishments. e. Hours of operation shall be no later than 10:00 PM. The Planning Commission may grant exceptions to this limitation for adult only establishments or when it is demonstrated that the use is clearly ancillary to another use. DIVISION 2. Chapter 14.08, Section 14.08.040C is hereby amended by adding the following definition: COMMERCIAL RECREATION USES: Includes golf and country clubs, marinas, tennis and swim clubs, health clubs, theaters, coin operated amusement device centers (uses with 5 or more coin or token operated amusement devices) and other privately owned and operated uses or facilities installed on a site, either inside or outside of the structures, for the active and/or passive enjoyment of persons visiting the site. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance, and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. DIVISION 4. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage.
