JEA s LEO C NI,`City Clerk ORDINANCE NO. 1440 AN ORDINANCE OF THE CITY OF SAN RAFAEL PROVIDING FOR COST OF LIVING INCREASE FOR CITY COUNCIL THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. Section 36516.2 of the California Government Code, enacted in 1972, provides that the compensation of Councilmembers and Mayor may be increased beyond the amount provided in Section 36516 of the Government Code by an Ordinance on an amount equal to 5% for each calendar year from the operative date of the last adjustment of the salary in effect when the Ordinance or amendment thereto is enacted. The previous salary adjustment was effective September 1981 for the liayor and for each Councilmember as provided for in Ordinance 1413. DIVISION 2. As of September 1, 1982, the Mayor shall receive $534 per month and each Councilmember shall receive $357 per month. Said increases shall be paid in the same manner as paid to other officers and employees of the City of San Rafael. DIVISION 3. Nothing contained herein shall be construed to provide for any automatic future increase in salary pursuant to Sec- tion 16516.2; however, this provision shall not invalidate Section 4 of Ordinance No. 878 which does provide for automatic increase pursuant to population growth as set forth in Government Code Section 36516. DIVISION 4. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, sub- sections, sentences, clauses or phrases be declared invalid. DIVISION 5. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage.
