LEONCINI, City Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City do hereby certify that the foregoing Charter Ordinance No. 1354 entitled: AN INTERIM URGENCY ORDINANCE EXTENDING FOR EIGHT MONTHS (INTERIM PROHIBITION OF USES) PROHIBITING ANY USES WHICH MAY BE IN CONFLICT WITH A CONTEMPLATED NEIGHBORHOOD PLAN AND ATTENDANT ZONING PROPOSALS, PURSUANT TO GOVERNMENT CODE SECTION 65858 (NEIGHBORHOODS 13 & 14) (Sun Valley/Fairhills) is a true and correct copy of an ordinance of said City and was introduced at a regular meeting of the City Council of the City of San Rafael, held on the fifteenth day of October 1 19791 published as required by City Charter in the Independent -Journal a newspaper printed and published in the City of San Rafael and passed and adopted as an ordinance of said City at a regular meeting of the City Council of said City held on the fifteenth day of October , 1979, by the following vote, to wit: AYES: COUNCILMEMBERS Greiner, Jensen, Nixon & Mayor Mulryan NOES: COUNCILMEhIBERS:None ABSENT: COUNCILMEhIBERS:Miskimen WITNESS my hand and the official seal of the City of San Rafael this 18th day of October . , 1979. LEONC I, ty Cler ORDINANCE NO. 1354 AN INTERIM URGENCY ORDINANCE EXTENDING FOR EIGHT MONTHS (INTERIM PROHIBITION OF USES) PROHIBITING ANY USES WHICH MAY BE IN CONFLICT WITH A CONTEMPLATED NEIGHBORHOOD PLAN AND ATTENDANT ZONING PROPOSALS, PURSUANT TO GOVERNMENT CODE SECTION 65858 (NEIGHBORHOODS 13 and 14) THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. Chapter 98 of Title 14 of the San Rafael Municipal Code is hereby extended, pursuant to Government Code Section 65858. DIVISION 2. This Ordinance, if passed, shall by operation of law be of no further force and effect eight months from the date of adoption thereof; provided, however, that after notice and public hearing, the City Council may extend this Interim Urgency Ordinance for one year. DIVISION 3. This Ordinance is an Urgency Ordinance for the needed preservation of the public peace, health, and safety, and shall go into effect immediately. The basis and justification constituting the urgency are as follows: Section 65858 of the Government Code provides for the adoption of Urgency Interim Ordinances prohibiting any uses which may conflict or be inimical with a contemplated zoning proposal to be undertaken by a local government agency within a reasonable time. The City of San Rafael has undertaken preparation and adoption of a Neighborhood Plan for Neighborhoods 13 and 14 as specified in the 1974 San Rafael General Plan. Extension of this Interim Urgency Ordinance is necessary to prevent uses which, if permitted, would vitiate, diminish, or be counterpro tive to the Neighborhood Plan. LAWRENCE E.
