LEONCINI , it�Cler ORDINANCE NO. 1357 AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING TITLE 2 "ADMINISTRATION" OF THE SAN RAFAEL MUNICIPAL CODE BY REPEALING CHAPTER 2.20 "CIVIL SERVICE" AND ENACTING A NEW CHAPTER 2.20 "CIVIL SERVICE" (EXCEPT AS APPLIED TO MEMBERS OF THE CLASSIFIED SERVICE WITHIN THE CITY OF SAN RAFAEL FIRE DEPARTMENT) THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. Title 2 of the San Rafael Municipal Code is amended by repealing Chapter 2.20 "Civil Service" in its entirety, and a new Chapter 2.20 "Civil Service" is enacted to read in its entirety as follows: CHAPTER 2.20 CIVIL SERVICE Section 2.20.010 Adoption of Civil Service System. 2.20.020 Designation of Officers and Employees Included. 2.20.030 Age Establishment Prohibited. 2.20.040 Eligibility; Rules. 2.20.050 Rules and Regulations. 2.20.060 Compensable Injury Absence. 2.20.010 Adoption of Civil Service System. Pursuant to the authority granted to the legislative body of the City of San Rafael under the provisions of California Government Code 545000 et seq., and any other provisions of law applicable thereto, the Civil Service System of the City of San Rafael is hereby adopted. 2.20.020 Designation of Officers and Employees Included. The provisions of this Ordinance and the Personnel Rules and Regulations pro- mulgated hereunder shall apply to all regular, full-time, permanent, classified employees of this City, with the exception of Management, Con- fidential, and Unclassified positions listed in the Salary Resolution regularly adopted by the City of San Rafael and as amended. 2.20.030 Establishment Prohibited. The Civil Service System created by this Ordinance shall not allow, nor cause the establishment of minimum or maximum age limits for any Civil Service examination, nor shall age be a minimum qualification for any City employment in the Classified Service. 2.20.040 Eligibility; Rules. Any person possessing all the minimum qualifications for a Civil Service position is eligible to take any Civil Service examination, and the Personnel Officer or any appoint- ing power shall not adopt any rule prohibiting the employment of any person otherwise qualified in any City employment solely because of age. NAL ORDINANCE NO. 1357 2.20.050 Rules and Regulations. Pursuant to the authority herein invested, the City Council shall formulate and adopt Rules and Regulations for the administration of the Civil Service System. Any subsequent amendments to the Rules and Regulations may be adopted by the Council. All Rules and Regulations adopted shall be consistent with the provisions of this Chapter. The Rules shall provide for the following matters, in addition to such other matters as may be necessary and proper in carrying out the intent and purposes of this Chapter: a) The classification of all persons in the Classified Service; b) The selection, employment, advancement, suspension, demotion, discharge, and retirement of all persons in the Classified Service; c) The formulating of minimum standards and qualifications for each of the positions in the Classified Service; d) The publication of notices inviting the filing of applications for persons in the Classified Service; e) Reduction in force and reinstatement; f) Change of employment status; g) Salary plan; h) Probationary status; i) Disciplinary action; j) Health standards; k) Vacation, sick leave, holiday pay, and leave benefits; 1) Grievance procedures; m) Creation of a Board of Appeals. 2.20.060 Compensable Injury Absence. The period of time during which an employee, subject to this Ordinance and to the Rules and Regulations promulgated hereunder, is required to be absent from his or her position by reason of an injury or disease for which he or she is entitled to receive compensation under the provisions of Division 4 of the Labor Code (commencing with 53201) is not a break in his or her continuous service for the purpose of his or her right to salary adjustments, sick leave, vacation or seniority. - 2 - ORDINANCE NO. 1357 DIVISION 2. The provisions of this Ordinance and of the Rules and Regulations promulgated hereunder shall not be applicable to members of the Classified Service within the City of San Rafael Fire Department. DIVISION 3. If any provision of this Ordinance or its applica- tion is held invalid by a court of competent jurisdiction, such invalid- ity shall not affect other provisions, sections, or applications of the Ordinance which can be given effect without the invalid provisions or applications, and to this end any phrase, section, sentence, or word is declared to be severable. DIVISION 4. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, printed, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage.
