LEONC 4I, pity Cer SAN RAFAEL CITY ORDINANCE ORDINANCE NO. 1359 AN ORDINANCE OF THE CITY OF SAN RAFAEL REPEALING AND REENACTING CHAPTER 5.60 (PARKING METERS) OF THE SAN RAFAEL MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. (a) The following portions of City streets listed below are estab- lished as parking meter zones: MISSION AVENUE, from 'B' Street to Hetherton Street. FIFTH AVENUE, from 'H' Street to Irwin Street. JULIA STREET, from 'B' Street to 'A' Street. FOURTH STREET, from Second Street to Irwin Street. THIRD STREET, from Hayes Street to 'E' Street. RITTER STREET, from Third Street to Lincoln Avenue. HETHERTON STREET, from Second Street to Mission Avenue. TAMALPAIS AVENUE, East of and West of the NWPRR tracks from Third Street to -Mission Avenue. LINCOLN AVENUE,'from Second Street to Pacheco Street. CIJOS STREET, from Third Street to Fourth Street. NYE STREET, from Fifth Avenue to Laurel Place. Notwithstanding any other provision of this chapter, the above described parking meter zone areas shall, for the purposes of this chapter, be deemed a public street in said City. 5.60.020 Installation of Parking Meters. The City Engineer is author- ized and directed to install meters in all parking meter zones established or created by the Council of the City, for the purpose of, and in such numbers, and at such places, and for such time limits as set forth in Council resolution to provide for the efficient control and regulation of the parking of vehicles therein. 5.60.030 Parking Meter Time Limits. The City Engineer shall install parking meters in the parking meter zone with the following maximum time limits: 12 minutes, 24 minutes, 1 hour, 2 hour, 3 hour, 5 hour, 10 hour, 12 hour. The maximum time limit, days and hours of operation, parking rate, and coin denomination accepted for each parking meter shall be indicated on said meter. - 2 - ORDINANCE NO. 1359 5.60.040 Curb or Street Lines or Markings. The City Engineer shall have lines or markings painted or placed upon the curb or street adjacent to each parking meter designating the parking space for which the meter is to be used, and each vehicle parked adjacent or next to any parking meter shall park within the lines or markings so established. It is unlawful to park a vehicle of such size or in such a position that the same shall not be entirely within the space designated by such lines or markingsā€¢ 5.60.050 Time of Operation of Parking Meters - Unlawful Parking. It is unlawful for any person between the hours of nine a.m. and six p.m. of any day to cause or permit any vehicle registered in his name or operated by him to be parked continuously in any parking meter space within a parking meter zone for more than the maximum period of time indicated on said parking meter, or any time during which the meter is displaying a signal indicating that that space is illegally in use, except during the time necessary to set the meter to show legal parking, and excepting also during the time from six p.m. to nine a.m., and on Sundays and holidays as listed in 5.04.020. 5.60.055 Parking Meters, Exclusive Use Of. Temporary utilization of a parking meter space without the deposit of a coin or for a period of time longer than the maximum time limit of said parking meter may be granted by the City upon application for such permission. The applica- tion shall be submitted in writing to the Police Department and shall provide a substantial need for temporarily closing off the meter(s) involved to public use for a stated duration of time. Upon payment to the City Treasurer of a daily fee established by Council resolution, official bags shall be issued to the applicant for placement on said meter. This provision shall not permit anyone from occupying a parking meter space during a posted no -parking period. 5.60.060 Parking Meter Rates. The parking meter rate for all parking meters in the parking meter zone shall be established by Council resolu- tion. 5.60.065 Repealed. 5.60.068 Repealed. 5.60.070 Repealed. 5.60.075 Repealed. - 3 - ORDINANCE NO. 1359 5.60.080 Deposit of Coin or Coins Required. When any vehicle is parked in any expired metered parking space as provided in accordance with the provisions of this chapter, the operator of the vehicle upon so park- ing shall, and it is unlawful to fail to, deposit immediately one or more United States coins in such parking meter. 5.60.090 Improper Use of Meter. It is unlawful to deposit or cause to be deposited in any parking meter, any slug, device or metallic substitute for United States coins, or to deface, injure, tamper with, open, or willfully break, destroy, or impair the usefulness of any parking meter installed pursuant to this chapter. 5.60.100 Duties of Police Officers. It shall be the duty of each police officer or employee of the Police Department as designated by the Chief of Police to take the number of any meter at which any vehicle is unlawfully parked, as provided in this chapter; the time and date of such violation; the State vehicle license of such vehicle; and the make of such vehicle; and issue, in writing and attach to such vehicle a citation for illegal parking in the same form and subject to the same procedure provided for by laws of the State of California applicable to the traffic violations within the City. 5.60.110 Fines for Meter and Overtime Parking. Parking meter viola- tions and overtime parking violations are infractions, and any person or persons who enter a plea of nolo contendere or guilty, or is found guilty by a court of competent jurisdiction, shall pay a fine of not more than Fifty Dollars as established by the judicial council of the municipal court of the central judicial district, County of Marin, upon request by the City Council in the form of a duly passed resolution. 5.60.120 Disposition and Use of Revenue. The depositing of coins in parking meters as provided in this title, is levied and assessed as -4- ORDINANCE NO. 1359 fees for the purposes provided in this section. All receipts accru- ing to the City from the operation of parking meters shall be expended for the acquisition, installation, operation, maintenance, repair and replacement of parking meters, parking meter collection and enforcement and expenses incidental thereto; the acquisition by purchase, condem- nation or lease, installation, improvement, operation, maintenance, repair and replacement of off-street parking facilities and expenses incidental thereto, including costs and expenses incurred in condemna- tion proceedings whether successfully concluded or abandoned; and expenses incurred in connection with proposals or proceedings for acquisition of off-street parking facilities, whether such proposals or proceedings are carried out or abandoned. Excess revenue not expended for the foregoing purposes shall be deposited in the City's General Fund or expended for any lawful purpose. DIVISION 2. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, printed, published, and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage. DIVISION 3. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, sub- sections, sentences, clauses, or phrases be declared invalid. -5- ORDINANCE NO. 1359 FRED JJEN 4,cting Mayor Attest: J_/UNE M.
