hereby certify that the foregoing Charter Ordinance No. 1368
entitled:
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING TITLE 10 OF THE
MUNICIPAL CODE OF THE CITY OF SAN RAFAEL BY ADOPTING CHAPTER 10.91
"POSTING OF GASOLINE PRICES"
is a true and correct copy of an ordinance of said City and
was introduced at a reqular meeting of the City
Council of the City of San Rafael, held on the 7th
day of April , 1980, published as required by City
Charter in the Independent -Journal , a newspaper
printed and published in the City of San Rafael and passed
and adopted as an ordinance of said City at a regular
meeting of the City Council of said City held on the 21st
day.of April , 1980, by -the following vote, to wit:

ORDINANCE NO. 1368
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING
TITLE 10 OF THE MUNICIPAL CODE OF THE CITY OF
SAN RAFAEL BY ADOPTING CHAPTER 10.91
"POSTING OF GASOLINE PRICES"
THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. Chapter 10.91 "Posting Gasoline Prices," is
hereby adopted to read in its entirety as follows:
CHAPTER 10.91 POSTING OF GASOLINE PRICES
Section 10.91.010 Posting.
10.91.020 Availability.
10.91.030 Other Requirements.
10.91.040 Penalty for Violation.
10.91.010. Posting. Every person, firm, partnership, associa-
tion, trustee, or corporation which owns, operates, manages, leases or
rents a gasoline service station or other facility offered for sale,
selling or otherwise dispensing gasoline or other motor vehicle fuel to
the public from such a facility abutting or adjacent to a street or high-
way shall post or cause to be posted or displayed and maintain at said
premises at least one sign which is clearly visible from all traffic
lanes in each direction on such street or highway.
Each said sign shall be readable from said traffic lanes and
shall indicate thereon the grade and actual price per gallon or litre,
including all taxes, of whatever grade of gasoline or other motor vehicle
fuel the station chooses to post.
10.91.020. Availability. No person, firm, partnership,
association, trustee, or corporation which owns, operates, manages,
leases or rents a gasoline service station or other facility offered
for sale, selling or otherwise dispensing gasoline or other motor
vehicle fuel to the public shall advertise, either in connection with
any signs or other advertising medium utilized to satisfy the
requirements of this section or otherwise, the price of any grade of
gasoline or other motor vehicle fuel which is not immediately available
to be sold or dispensed to the public at said premises.

10.91.030. Other Requirements. Each sign posted, displayed or
maintained pursuant to requirements of this Section shall not be inconsis-
tent with the provisions of Article 8 of Chapter 7 of Division 8
(Sections 20880 et seq.) of the State of California Business and Pro-
fessions Code or Section 14.12.02A of the San Rafael Municipal Code.
10.91.040. Penalty for Violation. Any person, firm or corpor-
ation violating any of the provisions of this Chapter is guilty of an
Infraction, and each such person is guilty of a separate offense for each
and every day or portion thereof during which any violation of any of the
provisions of this Code is committed, continued or permitted, and upon
conviction of any such violation such person shall be punished by a fine
of not less than Ten ($10.00) Dollars nor more than One Hundred ($100.00)
Dollars.
DIVISION 2. If any provision of this Ordinance or its applica-
tion is held invalid by a court of competent jurisdiction, such invalid-
ity shall not affect other provisions, sections, or applications of the
Ordinance which can be given effect without the invalid provisions or
applications, and to this end any phrase, section, sentence, or word is
declared to be severable.
DIVISION 3. This Ordinance shall be published once in full
before its final passage in a newspaper of general circulation, printed,
published, and circulated in the City of San Rafael, and shall be in
full force and effect on June 1, 1980.

The foregoing Ordinance No. 1368 was read and introduced at
a regular meeting of the City Council of the City of San Rafael, held
on the 7th day of April, 1980, and ordered passed to print by the
