LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1395 entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AMENDING CHAPTER 10.76 COMMUNITY ANTENNA TELEVISION SYSTEMS FRANCHISES BY ADDING SECTION 10.76.085 SANCTIONS FOR FAILURE TO REMEDY SERVICE PROBLEMS is a true and correct copy of an ordinance of said City and was introduced at a regular meeting of the City Council of the City of San Rafael, held on the eighteenth day of Mav 1981, published as required by City Charter in the San Rafael News/Pointer , a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a regular meeting of the City Council of said City held on the fifteenth day of June , 1981, by the following vote, to wit: AYES: COUNCILMEMBERS: Jensen, Nixon & Mayor Mulryan NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: Breiner & Miskimen WITNESS my hand and the official seal of the City of San Rafael this seventeenth day of June , 1981. qe JE 2. LEO]NI, pity Jerk ORDINANCE NO. 1395 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AMENDING CHAPTER 10.76 COMMUNITY ANTENNA TELE- VISION SYSTEMS FRANCHISES BY ADDING SECTION 10.76.085 SANCTIONS FOR FAILURE TO REMEDY SERVICE PROBLEMS THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. Section 10.76.085, Sanctions for Failure to Remedy Service Problems of Chapter 10.76 of the San Rafael Muni- cipal Code is hereby added, to read and provide as follows: 10.76.085 Sanctions for Failure to Remedy Service Problems. When a subscriber files a written complaint with City for a service problem which is preventable and reasonably within grantee's control and grantee fails to remedy said problem within a reasonable period of time following receipt of written notice by City, City may levy a maximum penalty of $500. If grantee objects to a penalty in writing, the matter shall be submitted to arbitration in accordance with the rules of the American Arbitration Association. The decision of the arbi- trator shall be final. Grantee shall provide written notice to each subscriber at intervals of not more than one year regarding the complaint and sanctions process set forth herein including the procedure for reporting and resolving subscriber complaints. The notice shall specifically inform the subscribers of their rights to com- plain in writing to City of the grantee's failure to resolve a service complaint which is preventable and reasonably within grantee's control. The proper address of City to which complaints may be directed shall be included in such notice. DIVISION 2. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining por- tions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage.
