LEONCINI, City Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City do hereby certify that the foregoing Charter Ordinance No. 1304 entitled: AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING ORDINANCE NO. 1287, CODIFIED AS SECTION 14.12.05D OF THE SAN RAFAEL MUNICIPAL CODE, BY PROVIDING CRITERIA FOR APPROVAL OR DISAPPROVAL OF SIGN APPLICATIONS BY THE PLANNING COMMISSION UPON SUBMISSION OF THE PLANNING DIRECTOR is a true and correct copy of an ordinance of said City, and was introduced at a regular meeting of the City Council of the City of San Rafael, held on the 5th day of July 19 78 Published as re- quired by City Charter in the Terra Linda News , a newspaper printed and published in the City of San Rafael and passed and adopted as an ordinance of said City at a regular meeting of the City Council of said City held on the 17th day of July 19 78 -by the following vote, to -wit: Ayes: Councilmen: Miskimen, Mulryan, Nixon and Mayor Bettini Noes: Councilmen: None Absent: Councilmen: Jensen WITNESS my hand and the official seal of the City of San Rafael this 19th day of July 19 78 JE Aj "M_I —,41 l erk ORDINANCE NO. 1304 AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING ORDINANCE NO. 1287, CODIFIED AS SECTION 14.12.05 D. OF THE SAN RAFAEL MUNICIPAL CODE, BY PROVIDING CRITERIA FOR APPROVAL OR DISAPPROVAL OF SIGN APPLICATIONS BY THE PLANNING COMMISSION UPON SUBMISSION OF THE PLANNING DIRECTOR THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. Section 14.12.05 D., "Who Approves Sign Applications" of the San Rafael Municipal Code is hereby amended to read in its entirety as follows: 14.12.05 D. Who Approves Sign Application. The Planning Director shall approve applications which comply with the standards and requirements of this Chapter. The Director may, however, withhold action on an application until it is reviewed by the Planning Commission if he feels there is a potential element of controversy regarding the following factors which include, but are not limited to: color, type, face, shape, or other elements disharmonious, distracting, or incongruous with the site or the surrounding neighborhood. The Planning Commission shall review all applications where an adjustment is requested. DIVISION 2. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, printed, published, and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage. _ FRED JENSEN, Attest: JEA.,E I.
