LEONCINI, City Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City do hereby certify that the foregoinq Charter Ordinance No. 1308 entitled: AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE SAN RAFAEL MUNICIPAL CODE BY AMENDING ORDINANCE NO. 1283 (SAN PEDRO COVE - PD DEVELOPMENT PLAN AMENDMENT) BY ADDING CONDITION TO DEVELOPMENT PLAN CONDITIONS AND REVISING MASTER PLAN (600 Point San Pedro Road) is a true and correct copy of an ordinance of said City, and was introduced at a regular meeting of the City Council of the City of San Rafael, held on the 5th day of September 19 78 Published as re- quired by City Charter in the Independent -Journal , a newspaper printed and published in the City of San Rafael and passed and adopted as an ordinance of said City at a regular meeting of the City Council of said City held on the 18th day of Sentember 19 78 by the following vote, to -wit: Ayes: Councilmen: Miskimen, Mulryan, Nixon and Vice -Mayor Jensen Noes: Councilmen: None Absent: Councilmen: Mayor Bettini WITNESS my hand and the official seal of the City of San Rafael this 26th day of September 19 78 NE M. LEONCINI, ity Clerk ORDINANCE NO. 1308 AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE SAN RAFAEL MUNICIPAL CODE BY AMENDING ORDINANCE NO. 1283 (SAN PEDRO COVE - PD DEVELOPMENT PLAN AMENDMENT) BY ADDING CONDITION TO DEVELOPMENT PLAN CONDITIONS AND REVISING MASTER PLAN THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: Division 1. Ordinance No. 1283, adopted by the San Rafael City Council on January 3, 1978, describing that property known as San Pedro Cove PD (Planned Development) is incorporated by reference as though set forth fully herein. Division 2. Any development of this property shall be subject to the conditions outlined in Exhibit "A" and shall be in conformance with the Master Plan, Exhibit "B", which are attached hereto and made a part hereof. Division 3. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, printed, published, and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage. e A 6 � #�' �Z4� C. LEONCIN4;.itvy Cler EXHIBIT "A" Conditions which were included as part of the zoning (Z77 -8(b)] action by the Planning Commission on August 8, 1978: FIRE DEPARTMENT (a) Fire hydrants shall be installed; their location is to be deter- mined by the Fire Marshal. (b) The fire flow shall be determined by the Fire Department. (c) On streets under 22 feet in width, on -street parking shall not be permitted. (d) The radius of all turns in cul-de-sacs shall be reviewed and approved by the Fire Department prior to submittal of a Final Subdivision Map. PUBLIC WORKS DEPARTMENT (e) The two-way street widths shall be a minimum of 24 feet wide. One-way streets shall be a minimum of 20 -feet wide. The City Engineer shall designate the areas where no parking signs shall be posted. (f) Streets shall be constructed to City standards, whether public or private. (g) Final location of roadways and building sites shall be subject to review and approval of the Geotechnical Review Board. (h) The area around the cove, referred to as Area 11, and any other area subject to flooding shall comply with Title 18, Protection of Flood Hazard Areas, of the Municipal Code. (i) A maintenance road shall be provided along the edge of the drainage ditch with the size and location to be approved by the City Engineer. (j) All structures shall be set back a minimal distance from the top of the drainage ditch to prevent lateral spreading. Deter- mination of this distance shall be approved by the Geotechnical Review Board. PLANNING DEPARTMENT (k) An Environmental and Design Review permit shall be required for the site and its structures. (1) The applicant shall submit an acoustical report with the Design Review for Lot 33. This report shall outline the mitigation measures necessary to obtain an interior sound level of 45 decibels (CNEL).
