LEONCINI, City Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1317 entitled: AN URGENCY ORDINANCE OF THE CITY OF SAN RAFAEL REPEALING CHAPTER 2.38 OF THE SAN RAFAEL MUNICIPAL CODE, MUNICIPAL ELECTION CAMPAIGN CONTRIBUTION AND EXPENDITURE CONTROLS is a true and correct copy of an ordinance of said City and was introduced and adopted as an Urgency Ordinance of the City of San Rafael at a regular meeting of the City Council of San Rafael held on the twentieth day of November, 1978, by the fol- lowing vote, to wit: AYES: COUNCILMEN: Jensen, Miskimen, Mulryan and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: Nixon WITNESS my hand and the official seal of the City of San Rafael this first day of December, 1978. J�MLEON)%l CINI, i y Clem ORDINANCE NO. 1317 AN URGENCY ORDINANCE OF THE CITY OF SAN RAFAEL REPEALING CHAPTER 2.38 OF THE SAN RAFAEL MUNICIPAL CODE, MUNICIPAL ELECTION CAMPAIGN CONTRIBUTION AND EXPENDITURE CONTROLS THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. Chapter 2.38, Municipal Election Campaign Contribution and Expenditure Controls, of the San Rafael Municipal Code, is hereby repealed in its entirety. DIVISION 2. This Ordinance is an Urgency Ordinance for the needed preservation of the public peace, health, or safety with- in the meaning of Government Code Section 25123 and shall go into effect immediately. The facts constituting such necessity are as follows: Chapter 2.38 of the San Rafael Municipal Code was adopted prior to the effective date of implementation of the Political Re- form Act. Certain measures of the Chapter are unconstitutional, and the balance have been superseded by the State Act. The total Chapter, therefore, is invalid. Because San Rafael Municipal Elections are imminent, and because candidates must file their papers soon and receive informational packets, it is incumbent upon the City to repeal the provisions of Chapter 2.38 so that no measure of confusion or illegality exists. &�Zt ew�;� C.
