Ordinance No. 1328 entitled:
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING SECTION 050

is a true and correct copy of an ordinance of said City,
and was introduced at a regular meeting of
the City Council of the City of San Rafael, held on the 5th
day of Mn rah 19 79 Published as re-
quired by City Charter in the San Rafael Pointer ,
a newspaper printed and published in the City of San Rafael
and passed and adopted as an ordinance of said City at a
regular meeting of the City Council of said City
held on the 19th day of March 19 79 -by the
following vote, to -wit:
Ayes: Councilmen: Jensen, Miskimen, Nixon and Mayor Mulryan
Noes: Councilmen: None
Absent: Councilmen: None

ORDINANCE NO. 1328
AN ORDINANCE OF THE CITY OF SAN RAFAEL
AMENDING SECTION 050 OF CHAPTER 12.36
"REPORT OF RESIDENTIAL BUILDING RECORD"
OF THE SAN RAFAEL MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. Chapter 12.36, Section 050 of the San
Rafael Municipal Code is hereby amended to read in its entirety
as follows:
12.36.050 Receipt and Delivery of Report to Buyers.
The report, when completed, shall be personally delivered to the
seller or his authorized agent who shall receipt for the same.
The owner or his authorized agent shall deliver the report to
the buyer or transferee prior to the consummation of the sale.
Any title insurance company or other escrow handling the sale or
exchange of City residential property, prior to closing the sale
or transfer, shall obtain from the buyer a written acknowledgment
of the receipt of the report of the residential building records.
The buyer or transferee shall execute a receipt of the building
inspection and the owner shall deliver a copy of said receipt to
the Building Department of the City.
DIVISION 2. If any section, subsection, sentence, clause,
or phrase of this Ordinance is for any reason held to be invalid,
such decision shall not affect the validty of the remaining portions
of this Ordinance. The Council hereby declares that it would have
adopted the Ordinance and each section, subsection, sentence, clause,
or phrase thereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses, or phrases be declared
invalid.
DIVISION 3. This Ordinance shall be published once in full
before its final passage in a newspaper of general circulation, printed,
published, and circulated in the City of San Rafael, and shall be in
full force and effect thirty (30) days after its final passage.

The above and foregoing Ordinance No. 1328 was read and
introduced at a regular meeting of the City Council of the City of
San Rafael, held on the 5th day of Parch 1979, and ordered
passed to print by the following vote, to wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and
Mayor Bettini
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: None
and will come up for adoption as an Ordinance of the City of San Rafael
at a regular meeting of the Council to be held on the 19th day of
March 1979.
