LEONCINI, Ci y Clerk ORDINANCE NO. 1333 AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE SAN RAFAEL MUNICIPAL CODE SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM U AND R-1 (UNCLASSIFIED AND SINGLE FAMILY RESIDENTIAL) DISTRICT TO P -D (PLANNED DEVELOPMENT) DISTRICT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. The Zoning Map of the City of San Rafael, California, adopted by reference by Section 14.15.020 of the Munici- pal Code is amended by reclassifying the following described real property from U and R-1 (Unclassified and Single Family Residential) District to P -D (Planned Development) District. Said property so reclassified is located at 210-230 Pt. San Pedro Road and 24 Summit Avenue, the entirety of the Marin Yacht Club property, County Assessor's Parcels 9-031-09, 10 and 9-032-10 which is more particu- larly described as follows: BEGINNING at the Northeast corner of the Beale Wharf Lot, as said lot is described in Deed from the San Rafael Development Company, a corporation, to Truxton Beale, dated May 13th, 1909 and recorded in Book 127 of Deeds, at page 10, Marin County Records, being a point on the Southerly line of a 25 foot right of way lead- ing to said Beale Lot, running thence along the Southerly line of said right of way North 740 19' 21" West 349.58 feet (Deed North 750 37' West 324.95 feet) to the Easterly line of the San Rafael - San Pedro County Road, thence along the Easterly line of said Road, South 500 36' 38" West 367.0 feet (Deed South 490 18' West 327.17 feet) to a point distant South 400 52East 25.0 feet from Station 0+00 of Survey of proposed new San Rafael -San Pedro Road, thence along the Easterly line of said New San Rafael -San Pedro Road as surveyed, on a curve to left on a radius of 1125 feet, from a tangent bearing South 500 36' 38" West, a distance of 617.19 feet, thence South 190 00' 38" West 149.09 feet, thence on a curve to the right on a radius of 650 feet a distance of 280.78 feet, thence South 460 14' 22" East 5.00 feet thence on a curve to the right on a radius of 655 feet from a tangent bearing South 460 14' 22", West a distance of 54.68 feet, to the Northerly corner of the map of Porto Bello, recorded in Book 12 of Maps at Page 10, Marin County Records; thence leaving said Southerly line of Point San Pedro Road and along the Northeasterly line of Porto Bello, and the Southwesterly prolongation thereof, South 390 06' 22" East (Map N 400 24' 30" W) 330 feet, more or less, to a point on the Southerly line of Allardt's Canal, said point being on the line between Stations 6 and 7, as said Canal is shown on Map Number 2 of Salt Marsh and Tide Lands, situate in the County of Marin, State of California, thence, Southwesterly along said Southerly line, South 26 47' 39" West (Map) S 25 1/20 W) 110 feet more or less, to a point on the Northerly line of the parcel of land deeded to U.S.A. in 225 of Deeds at Page 431, Marin County Records; thence along last said Northerly line, North 610 40' 16" East (Deed N 610 40' 16" E) 988.94 feet; thence North 720 39' 57" East (Deed N 720 39 57" E) 305.654 feet; thence South 790 05' 23" East (Deed S 790 05' 23" E) 284.715 feet; thence South 630 50' 43" East (Deed S 630 50' 43" E) 13 feet, more or less, to a point which is perpendicular to the most Southerly corner of Lot 31, as said Lot is shown on the "Map of Marina Vista City of San Rafael, Marin County, California" recorded in Book 6 of Maps at Page 4, Marin County Records; thence at a right angle, North 260 09' 17" East 33 feet, more or less to said corner of Lot 31, thence Northwesterly, along the Westerly line of said Lot 31 and Parcel "B" North 530 12' 21" West (Map N 540 30' W) 58.00 feet; thence North 350 02' 21" West (Map N 360 20' W) 60.83 feet; thence North 100 02' 21" West (Map N 110 20' W) 251.65 feet; thence North 700 39' 39" East (Map N 690 22' E) 32.13 feet; thence North 190 08' 21" West (Map N 200 26 W) 250.00 feet; thence North 380 42' 21" West (Map N 400 00' W) 150.00 feet; thence North 510 26' 21" West (Map N 520 44' W) 200.06 feet; thence North 10 07' 39" East (Map N 00 10' W) 80.20 feet to the POINT OF BEGINNING. - 2 - DIVISION 2 Any development of this property shall be subject to the conditions outlined in Exhibit "A" which is attached hereto and made a part hereof. DIVISION 3 This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, printed, published, and circulated in the City of San Rafael, and shall be in full force and effect thirty ( 30 ) days after its final passage. DIVISION 4 If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining por- tions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid. OL E M. LE0NCI CityC erk - 3 - 16 B/20,21,19 EXHIBIT "A" Condition which was included as part of the zoning (Z79-6) action by the Planning Commission on April 24, 1979. (a) This rezoning is for all existing use of the property, and the development of 6 new residential units at the western edge of the property. Within 60 days after approval, the applicant shall submit a survey map of the property which shows all existing facilities, the mean high water line, Allardt's Canal and the location of the proposed 6 dwelling units. No new construction within the Allardt's Canal area is permitted pending final determination by the State Lands Commission on the ownership of this area.
