GRADY, U ty Cl e ORDINANCE NO. 1262 AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING SECTION 2.08.030(B) OF THE SAN RAFAEL MUNICIPAL CODE PERTAINING TO THE EMPLOYMENT, DISCIPLINE AND REMOVAL OF HEADS OF DEPARTMENTS AND SUBORDINATE OFFICERS THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. Section 2.08.030(b) of the San Rafael Municipal Code is hereby amended to read as follows: "(b) To recommend to the City Council the employment, discipline or removal of all heads of departments and appoint all subordinate officers and employees of the City, to recommend transfer of employees from one department to another, the consolidation or combination of offices, positions, departments or units under his jurisdiction. The foregoing provisions shall not apply, however, to the positions of City Attorney or City Clerk, but shall apply to their subordinates, deputies, assistants, and employees in their respective offices and departments. Matters of supervision, discipline, and control of departmental subordinate officers and employees shall be governed by the City's Personnel Rules and Regulations." DIVISION 2. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the Ordinance. The City Council of the City of San Rafael hereby declares that it would have passed this Ordinance, and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more other sections, subsections, sentences, clauses, or phrases may be declared invalid or unconstitutional. DIVISION 3. This Ordinance shall be published once before its final passage in the Independent Journal , a newspaper of general circulation printed, published and circulated in the City of San Rafael and shall be in full force and effect thirty (30) days after its final passage. s A.PU�TT i, I ayor Attest: MARION A.
