LEONCINI, City Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City do hereby certify that the foregoinq Charter Ordinance No. 1266 entitled: An Ordinance Amending Title 12 of the San Rafael Municipal Code by deleting Chapter 12.08, Board of Examiners and Appeals and Amending Chapter 12.12 Uniform Building Code, and Amending Chapter 12.16 Uniform Plumbing Code, and Amending Chapter 12.32 Uniform Swimming Pool Code is a true and correct copy of an ordinance of said City, and was introduced at a regular meeting of the City Council of the City of San Rafael, held on the 1st day of August. 1977 Published as re- quired by City Charter in the Independent Journal , a newspaper printed and published in the City of San Rafael and passed and adopted as an ordinance of said City at a regular meeting of the City Council of said City held on the 15th day of August, 1977 by the following vote, to -wit: Ayes: Councilmen: Jensen, Miskimen and Mayor Bettini Noes: Councilmen: None Absent: Councilmen: Mulryan, Nixon WITNESS my hand and the official seal of the Cil of San Rafael this day of 19 1.7 JANNE M. LEOINJCINI, ity Clerk ORDINANCE NO. 1266 AN ORDINANCE AMENDING TITLE 12 OF THE SAN RAFAEL MUNICIPAL CODE BY DELETING CHAPTER 12.08, BOARD OF EXAMINERS AND APPEALS AND AMENDING CHAPTER 12.12 UNIFORM BUILDING CODE, AND AMENDING CHAPTER 12.16 UNIFORM PLUMBING CODE, AND AMENDING CHAPTER 12.32 UNIFORM SWIMMING POOL CODE THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION I. Chapter 12.08 entitled "Board of Examiners and Appeals" is hereby deleted. DIVISION II. Section 12.12.010 entitled "Adoption of the Uniform Building Code is hereby amended to read: 12.12.010 Adoption of the Uniform Building Code. There is adopted for the purpose of providing minimum standards to safe guard life or limb, health, property and public welfare, that certain code known as the Uniform Building Code, 1976 Edition and the Uniform Building Code Standards, 1976 Edition, published by the International Conference of Building Officials, 5360 South Workman Mill Road, Whittier, California, 90601, and the whole thereof, including the Table of Contents, Chapters 13, 23, 35, 38, 48, 49, 51 and 70 of the Appendix, and the index therein, save and except such portions as are hereafter deleted, added thereto, modified or amended of which code, amend- ments and secondary code, not less than three copies have been and are now on file in the office of the City Clerk, and the same are adopted and incorporated as fully as set out at length herein, and from and after September 14, 1977 the pro- visions thereof shall be controlling with the city limits. DIVISION III. Section 12.12.020 entitled "Amendments made in the Uniform Building Code" is amended as follows: There is hereby added the following: 1. Section 303(g) is amended by changing sixty (60) days of date of issuance to one hundred -twenty (120) days. 2. Section 304 is amended by adding a new sub -section (g) to read as follows: (g) no utilities shall be authorized to be connected until such time as a final building inspection is approved and all other city department requirements have been completed. -1- 3. Occupancy Designation Changes. Occupancy groups referred to within Section 12.12.020 are changed as follows: Occupancy Designation A is changed to A-1 Table 33-A is amended by adding to footnote 2 the following: The Building Official may grant relief from compliance to this section when, in his opinion, said compliance would be impractical or im- pose an undue hardship. 5. The reference to Section 1710 is hereby deleted. 6. Section 506-4 is changed to read as follows: 4. Unlimited Areas. The area of any building other than group E occupancy shall not be limited if the building is provided with an approved fully supervised automatic fire extinguishing system throughout, as specified in Chapter 38, and entirely surrounded by yards of not less than 60 feet in width and by fire access roads not less than 20 feet in width. 7. There is adopted for the purpose of providing minimum requirements for the protection of life, limb, health, property, safety and the general welfare of the general public, that certain code known as the Uniform Plumbing Code 1976 Edition including the appendix thereof, adopted by the Inter- national Association of Plumbing and Mechanical Officials at the Forty-sixth Annual Conference, September, 1975, save and except such portions as are hereinafter deleted, added thereto or amended not less than three copies of the Uniform Plumbing Code, 1976 Edition including the appendix thereof, are now on file and have been on file in the office of the City Clerk for at least fifteen days prior to Auqust 1, 1977 , and the Uniform Plumbing Code, including the appendix thereof, are adopted and in- corporated herein by reference as though set forth in full. DIVISION V. Chapter 12.32 is hereby amended as follows: Section 12.32.010 is hereby amended to read as follows: Section 12.32.010 Adoption of Uniform Swimming Pool Code, 1976 Edition. There is adopted for the purpose of providing minimum re- quirements for the protection of life, limb, health, property, safety and general welfare of the general public by prescribing minimum standards for the design, construction or installation, repair or alteration of swimming pools, public or private, and equipment re- lated thereto, that certain code known as the Uniform Swimming Pool Code, being the 1976 Edition and published by the Inter- national Association of Plumbing and Mechanical Officials, 5032 Alhambra Avenue, Los Angeles, California, 90032, save and except such portions as are hereinafter deleted, added, modified or amended, of which code not less than three copies have been and W! are now on file in the office of the City Clerk for at least fifteen days, and the same is adopted and incorporated herein by reference as though set forth in full herein. DIVISION VI. Chapter 12.36 is hereby amended as follows: Section 12.36-050 Delivery of Report. Change "Certified Mail" to "Regular Mail". Delete "Return Receipt Requested". DIVISION VII. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the ordinance and each section subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsection, sentences, clauses or phrases be declared invalid. DIVISION VIII. This ordinance shall be published once in full before its final passage in the Independent -Journal, a newspaper of general circulation, printed, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage. ij v - C.
