LEONCINI, City Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City do hereby certify that the foregoing Charter Ordinance No. 1277 entitled: "AN URGENCY ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNI- CIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO DESIGNATE CERTAIN REAL PROPERTIES WITH A DRD (DESIGN REVIEW DISTRICT) OVERLAY ZONE" DOWNTOWN is a true and correct copy of an ordinance of said City, and was introduced at a regular meeting of the City Council of the City of San Rafael, held on the 3rd day of October 1977 Published as re- quired by City Charter in the Indepedent Journal , a newspaper printed and published in the City of San Rafael and passed and adopted as an ordinance of said City at a regular meeting of the City Council of said City held on the 3rd day of October, 1977 by the following vote, to -wit: Ayes: Councilmen: Miskimen, Mulryan, Nixon and Mayor Bettini Noes: Councilmen: None Absent: Councilmen: Jensen WITNESS my hand and the official seal of the Cit,Y�of San Rafael this 41 day of V 19 7-) E`1+4�LEONCINI, City C erk ORDINANCE NO. 1277 AN URGENCY ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAE4 CALIFORNIA, SO AS TO DESIGNATE CERTAIN REAL PROPERTIES WITH A DRD (DOWNTOWN REVIEW DISTRICT) OVERLAY ZONE THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. The Zoning Map of the City of San Rafael, California, adopted by reference by Section 14.15.020 of the Municipal Code, is amended by combining the existing zoning of the following - described real properties with a DRD (Downtown Review District) over- lay zone: Parcels fronting on both sides of Fourth Street, between D Street and Lootens Place, more parti- cularly Assessors parcels 11-205-08 thru 14; 11-212-05, 06, 07, 08, 11 and 14; 11-215-01, 02 and 03; 11-216-01; 11-222-03; portion of 11-222-04 (southerly portion bounded on the north by the line South 83°East, 138 feet, more or less, and its extension easterly to the eastern boundary of property); 11-253-01, 02, 03, 04 and 10; 11-255-03, 23, 27; portion of 11-255-26 (northerly portion bounded on the south by the line South 83° East, 128.6 feet more or less); 11-261-01, 15 and 17; 11-263-02; portion of 11-263-04 (northerly portion bounded on the south by the line South 83° East, 78.3 feet, more or less) 11-263-05 thru 11; portion of 11-263-18 (northerly portion bounded on the south by the extension 2.5 feet of the line South 6045' West, 150 feet, continuing easterly South 830 East, 50 feet, more or less, to the easterly boundary of the property); 11-263-20. Containing 9.7 acres, more or less. DIVISION 2. This Ordinance is an Urgency Ordinance for the needed preservation of the public peace, health, or safety within the meaning of Government Code Section 25123 and shall go into effect im- mediately. The facts constituting such necessity are: the merchants within the Beautification District on Fourth Street will participate in the Beautification Program only if the work can be commenced immediately, so that it can be accomplished prior to the Christmas 1977 Shopping Season, and the winter rains. The City's economic basis is largely founded on the sales tax, and a significant portion of that sales tax is derived from the sales of businesses located in the Downtown District. - 1 - 0 R I Ilk - -"D " NTA L Immediate implementation of this program is necessary to insure its success and that of other redevelopment programs for the area. DIVISION 3. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that anyone or more sections, subsections, sentences, clauses, or phrases be declared invalid.
