GRADY, City Clerk ORDINANCE NO. 1226 AN ORDINANCE OF THE CITY OF SAN RAFAEL PROVIDING FOR COST OF LIVING INCREASE FOR CITY COUNCIL THE COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS: DIVISION 1 . Section 36516.2 of the California Government Code, enacted in 1972, provides that the compensation of councilmen and mayor may be increased beyond the amount provided in Section 36516 of the Government Code by an Ordinance on an amount equal to 5% for each calendar year from the operative date of the last adjustment of the salary in effect when the Ordinance or amendment thereto is enacted. The previous salary adjustment was effective in July 1975 in the amount of $380 per month for the mayor and $254 per month for each councilman. D I V I S 10 N 2 . As of the effective date of this Ordinance each councilman and the mayor shall receive in addition to his regular compensation of $380 per month for the Mayor and $254 per month for each Councilman, a sum equal to 3% of that amount. Said increase shall be paid in the same manner as paid to other officers and employees of the City of San Rafael. DIVISION 3 . Nothing contained herein shall be construed to provide for any automatic future increase in salary pursuant to Section 36516.2; however, this pro- vision shall not invalidate Section 4 of Ordinance No. 878 which does provide for automatic increase pursuant to population group as set forth in Government Code section 36516. D I V I S 10 N 4 . If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The Council hereby declares that it would have adopted the ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. D I V I S 10 N 5 . This Ordinance shall be published once in full before its final passage in the Independent Journal , a newspaper of general circulation, printed, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage. etdozw e.4� C.
