GRADY, City Clerk ` �_ ORDINANCE NO. 1244 AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM PUD -R1 (PLANNED UNIT DEVELOPMENT - SINGLE FAMILY RESIDENTIAL), DISTRICT TO P -D (PLANNED DEVELOPMENT) DISTRICT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. The Zoning Map of the City of San Rafael, California, adopted by reference by Section 14.15.020 of the Municipal Code is amended by reclassifying the following de- scribed real property from PUD-Rl (Planned Unit Development - Single Family Residential) District to P -D (Planned Development) District. Said property so reclassified is located at: 2436 Fifth Avenue, San Rafael, California, and shown as County Assessor's Parcel 177-240-09. DIVISION 2. Any development of this property shall be subject to the conditions outlined in Exhibit "A" which is attached hereto and made a part hereof. DIVISION 3. This Ordinance shall be published once in full before its final passage in the Independent Journal , a newspaper of general circulation, printed, published, and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage. �i C. EXHIBIT "A" Conditions which were included as part of the zoning (Z76-5) action by the Planning Commission September 28, 1976: (a) On-site fire hydrants shall be provided per requirements of the City Fire Marshal. (b) The development of Lot 1 as shown shall require complete substantiation with regard to the structure being placed over the drainage channel: (1) The structure foundations shall be independently supported from the channel bank. (2) The finished floor shall be at a sufficient elevation to preclude flooding from the channel. (3) There shall be sufficient room between the structure and the channel bottom to allow maintenance equipment access. (4) The channel bank shall have an erosion resistant surfacing placed on it (e.g., rock rip -rap, gunite, etc.). (5) All work shall be prepared by a Registered Civil Engineer. (c) Street trees shall be planted prior to issuance of occupancy permits, the size, type, spacing, soil treatment and planting to be determined by the City Landscape Architect. (d) A landscaping plan for the four -unit lot and all land area visible from public streets shall be approved by the Planning Director prior to issuance of building permits for Lots 2 through 7. The planting shall be completed prior to issuance of occupancy permits. (e) The exterior building materials shall be used brick and unpainted wood, per the submitted elevations. (f) The easterly lot line and the plan for the structure on Lot 5 shall be adjusted to preserve all mature trees on this lot.
