AN ORDINANCE OF THE CITY COUNCIL of the

CITY OF SAN RAFAEL AUTHORIZING AN AMENDMENT
(Name of Public Agency)
TO THE CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF
(Governing Body)
SAN RAFAEL AND THE BOARD OF ADMINISTRATION OF THE
CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM.
The City Council of the City of San Rafael

does ordain as follows:
SECTION 1. That an amendment to the Contract between the City Council

introduced at a regular meeting of the City Council of the City of
San Rafael, held on Monday , the 3rd day of January , 1977,
and was ordered passed to print by the following vote, to wit:

Exhibit "A"
AMENDMENT TO CONTRACT BETWEEN THE
BOARD OF ADMINISTRATION
PUBLIC EMPLOYEES` RETIREMENT SYSTEM
AND THE
CITY COUNCIL
CITY OF SAN RAFAEL
The Board of Administration, Public Employees' Retirement System, hereinafter
referred to as Board, and the CITY COUNCIL of the CITY OF SAN RAFAEL, hereinafter
referred to as Public Agency having entered into a contract under date of June 20, 1957,
effective July 1, 1957, as amended effective December 1, 1957, January 1, 1958, March 2,
1959, January 1, 1969, October 1, 1969, March 1, 1971, October 1, 1973 and July 1, 1974,
which provides for participation of Public Agency in said System, Board and Public Agency
hereby agree as follows:
A. The following subparagraph shall be added to Paragraph 6 of said
contract:
6.(f) Section 20024.2 (defining "final compensation" on the basis
of average compensation earnable during the year immediately
preceding retirement or any other one year period elected by
the member).
B. Paragraph 6.5 shall be added to said contract:
6.5 Public Agency, in accordance with Section 20740, Government
Code, shall cease to be an "employer" for purposes of Chapter
6 of the Public Employees' Retirement Law effective as of the
effective date of this amendment to this contract. Accumulated
contributions of the Public Agency as of the date of such amend-
ment shall be fixed and determined as provided in Section 20759,
Government Code, and such accumulated contributions and
contributions hereafter made shall be held by the Board as
provided in Section 20759, Government Code.
C. Paragraph 7(a) shall be stricken from said contract and the following
paragraphs shall be substituted therefor:
7. Public Agency shall contribute to said Retirement System as
follows:
a. With respect to miscellaneous members, the Public Agency
shall contribute the following percentages of monthly salaries
earned as miscellaneous members of said System:
(1) 1 .514 percent until June 30, 2000 on account of the
liability for prior service benefits.

(2) 11 .968 percent on account of the liability for current
service benefits.
(3) 0.300 percent on account of the liability for the 1959
Survivors program.
(4) 0.130 percent until June 30, 2000 to provide the benefits
under Section 21222.1 of the Government Code.
D. This amendment shall be attached to said contract and shall become effective
on the 1st day of March, 1977
