Ragghianti, City Attorney ORAL COMMUNICATIONS OF AN URGENCY NATURE: 8:00 PM PRESENTATION TO ACTING MAYOR FRUGOLI BY STUDENT COUNCIL OF ST. ISABELLA'S SCHOOL IN TERRA LINDA - File 9-1 Mrs. Sandy Boyd, Science Teacher and Student Council Moderator for St. Isabella's School in Terra Linda, introduced the school's Council members and called upon President Keven Clifford, who made a presentation to Acting Mayor Gary Frugoli, for his part in their Council program. City Council presented the school Council members with flags of the City of San Rafael. VARIOUS PROBLEMS ON WARNER COURT - File 9-3-40 x 9-3-30 x 9-3-17 Mr. Wes Mayne, owner of two four-plexes on Warner Court and resident of 21A Warner Court, informed Council of a variety of problems he feels need to be taken care of by the City. Mr. Mayne submitted a list of concerns to the City Clerk for review by City staff. WILD PIGS - GLENWOOD HILLSIDE - File 13-3 x 9-3-40 x 151 Joseph R. Wirts, Attorney (retired) of 23 Alderwood Way, spoke on the problem of wild pigs running loose in the Glenwood hillside and of a $300 bill sent to him by the Public Works Department for fencing on his property. Public Works Director Bernardi stated that his department has received a Depredation Permit from the State Fish & Game to take care of the problem, and will be working with the Marin Municipal Water District whose Range Manager will join the City in taking steps to remove the wild pigs. A staff report will be brought back to Council at the meeting of October 20, 1986 or November 3, 1986; in the meantime, bill for $300 will be waived. CONSENT CALENDAR Item 2. SRCC MINUTES (Regular) 10/6/86 Page 2 SRCC MINUTES (Regular) 10/6/86 Page 3 PRESENTATION OF RESOLUTION - SAN RAFAEL PUBLIC EDUCATION FOUNDATION - File 212 Mr. Fred Kantor, President of the San Rafael Public Education Foundation was presented with the Resolution of Appreciation by Councilmember Russom, which was adopted earlier. SUN VALLEY OPEN SPACE ASSESSMENT DISTRICT - File 6-36 Mr. Elliot Bien, initiator of the Sun Valley Open Space Assessment District, thanked Council and staff for their efforts in the success of the project. Mr. Bien invited Council and staff to join them in a picnic celebration on Saturday, October 11th at the Sun Valley Park, to be given by the Neigh- borhood 13 Association. 11. PUBLIC HEARING - AN ORDINANCE CLARIFYING AND AMENDING ORDINANCE NO. 1517, AMENDING TITLE 12 (BUILDING REGULATIONS) OF THE MUNICIPAL CODE PERTAINING TO "RIGHT OF ENTRY", AND RENUMBERING CERTAIN SECTIONS (PW) - File 1-6-1 x 1-6-2 x 1-6-3 x 1-6-5 x 1-6-6 x 1-6-7 x 9-3-32 Acting Mayor Frugoli opened the public hearing. Public Works Director Bernardi stated that it was brought to staff's attention that Ordinance No. 1517, adopted last November, contained a number of errors which need to be corrected, the most important of which is the deletion of necessary verbiage in the "Right of Entry" wording required for conformance with State law in various sections, and that other sections require renumbering. There being no comments from the public, Acting Mayor Frugoli closed the public hearing. AND APPELLANT; AP 11-254-18 (Pl) - File 10-7 x 5-1-286 Planning Director Moore stated that on September 15, 1986, the Council upheld an appeal of the Planning Commission's denial of design revisions to the Californian. Staff was directed to return with a Resolution incorporating Council's action to revise the necessary Design Review Application Conditions of Approval and work with the Applicant on possibly relocating the elevator to a more centralized location. Mrs. Joanne Sobel of 678 Barberry Lane, reiterated her request that the project be approved with two elevators. After further discussion, Councilmember Russom moved and Councilmember Nave seconded, to adopt the Resolution Upholding an Appeal of the Planning Commission's Denial of Design Revisions to the Californian SRCC MINUTES (Regular) 10/6/86 Page 3 0 SRCC MINUTES (Regular 10/6/86 Page 4 (formerly Centertown) Senior Citizen Residential Development Located at 855 "C" Street. RESOLUTION NO. 7444 - RESOLUTION UPHOLDING AN APPEAL OF THE PLANNING COMMISSION'S DENIAL OF DESIGN REVISIONS TO THE CALIFORNIAN (FORMERLY CENTERTOWN) SENIOR CITIZEN RESIDENTIAL DEVELOPMENT LOCATED AT 855 "C" STREET AYES: COUNCILMEMBERS: Nave, Russom & Acting Mayor Frugoli NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: Breiner & Mayor Mulryan 13. CONSIDERATION OF ESTABLISHMENT OF PROFESSIONAL AD HOC BOARD OF REVIEW FOR BUILDING AND FIRE CODE EXCEPTIONS (PW) - File 9-2-41 x 1-6-1 x 1-6-4 Public Works Director Bernardi requested that Council establish a Professional Ad Hoc Board of Review for Building and Fire Code Excep- tions. He noted that when the Fire Department and Public Works staff review various projects, they normally rely on Code interpretations made by the authors of the various Codes, but when grey areas arise, staff would feel more confident with outside professional assistance. He recommended that the Board be comprised of a Fire Protection Engi- neer, Structural Engineer, Electrical Engineer, Mechanical Engineer and an Architect who would all serve in a advisory capacity to Council and City staff, and that there be no limit to the length of term to serve because meetings would not take place on a regular basis, and asked that the residency requirements be -waived. After discussion, Councilmember Nave moved and Councilmember Russom seconded, to approve staff's recommendation authorizing the City Clerk to solicit applications from qualified professionals to serve on the Ad Hoc Board of Review for Building and Fire Code Exceptions, and that there be no length of term or San Rafael residency requirements. A list of qualified professionals will be kept on file to be called upon when needed. There being no further business, the meeting was adjourned. JEAN M.
