10. STATUS REPORT RE PARKING STANDARDS OUTSIDE THE DOWNTOWN AREA (P1) -

Councilmember Russom stated his concerns are that staff recommended
an additional year to look at the current standards and evaluate the
effectiveness on the parking situation, and asked, if the standards
are inadequate, within a year will we have gone so far with develop-
ment and the associated parking that we might find ourselves in
trouble?
Planning Director Moore replied that on an informal basis, new
developments are monitored to see how conditions of approval are
being complied with and noted no difficulties with the parking
standards. Should there be parking problems, it will be brought back
to the Council sooner than one year.
Councilmember Breiner indicated that she supports an interim report
on a 6 -month basis so as to have Council brought up to date with the
parking situation.
Council approved staff recommendation postponing formal review of the
standards for an additional year to allow completion of a sufficient
number of projects for an adequate evaluation of the Standards'
effectiveness, to include a 6 -month interim report, without motion.
11. CLAIM FOR DAMAGES - PACIFIC GAS & ELECTRIC COMPANY - File 3-1-946 (PW)
Mayor Mulryan indicated that this was a situation where a contractor
was on the job, and asked why the City was included in this claim
even though there was a contractor present. Assistant City Manager
Nicolai stated that emergency repair work being done on Canal Street
was being monitored by the City staff.
Councilmember Nave moved and Councilmember Breiner seconded, to deny
the claim.

12. AUTHORIZATION TO CALL FOR BIDS FOR RESTORATION OF SECOND FLOOR
READING ROOM (BRIDE'S ROOM) AT FALKIRK (Lib/Cult.Aff.) - File 4-1-381
Mayor Mulryan asked for a further explanation concerning restoration
of the Bride's Room.
Director of Library/Cultural Affairs Stratford reported that at a
previous Council meeting, $13,400 was appropriated for restoration of
the house by the pool, having preliminary work done, but in having an
architect look at the structure, it was determined that it was not
feasible to restore that structure. Permission was granted from the
San Francisco Foundation to use funds that they had granted to a room
called the "reading room". The future use of the room is presently
open. The restoration would give the widest range of options for
that room and the Cultural Affairs Commission has endorsed this
project.
Councilmember Breiner moved and Councilmember Frugoli seconded, to
authorize staff, by motion, to seek competitive bids for restoration
of the second -floor reading room (Bride's Room) at Falkirk.

Mayor Mulryan asked if there was a sketch available of the project.
Director of Library/Cultural Affairs Stratford suggested that this
item be continued to the meeting of March 4th so a sketch could be
presented then, and Council agreed.

Council asked for clarification on the figure of $70,396 which was
explained by Administrative Assistant Alan Harry, indicating two
additional vehicles were being requested, one for the Recreation
Department and one for Redevelopment Agency staff. Also, it was
indicated to Council that records are kept on car repairs, and that
the old vehicles that are not needed are auctioned.

19. APPOINTMENT OF ACTING CITY MANAGER - File 9-3-11
Mayor Mulryan stated that this item is an appointment of Assistant
City Manager Pamela J. Nicolai to Acting City Manager during the
interim period until such time that a City Manager is hired. Ms.
Nicolai's salary will be $4,000 per month, effective March 4, 1985.
Councilmember Breiner moved and Councilmember Nave seconded, to
appoint Pamela J. Nicolai as Acting City Manager, at a monthly salary
of $4,000 until such time that a City Manager is hired.

20. PUBLIC HEARING - TS80-10(b) - APPEAL OF PLANNING COMMISSION'S

Mayor Mulryan opened the public hearing.
Planning Director Moore gave a detailed report on the appeal by the
Loch Lomond Homeowner's Association of the January 15, 1985, Planning
Commission conditional approval of a 1-1/2 year extension for this
subdivision, a 30 lot, single family residential subdivision north of
the Villa Real and Loch Lomond neighborhoods. She noted a tentative
map was approved by the Planning Commission in July 1981 and the time
extension to the subdivision was granted after extensive public input
with meetings through the Planning Commission and one neighborhood
meeting.
On January 30, 1985, the Loch Lomond Homeowners Association appealed
the Planning Commission's decision contending that the subdivision is
not consistent with Basic Policy #7 of the San Rafael General Plan,
regarding the environmental quality. Also, the homeowners association
does not consider the site to be suitable for this type of density
and requests a number of additional conditions be incorporated into
any approval of the time extension.
Ms. Moore noted there is no substantial evidence by the homeowners
association proving that the project has the potential to be environ-
mentally degrading or inconsistent with the General Plan or that the
site is not suitable for the type and the density of development that
is proposed for this site.
Regarding the Association's claim that the project is in violation of
the Subdivision Map Act because the map is not consistent with the
City's General Plan, Ms. Moore noted that the residential usage and
the dedication of over 50% of property in open space is consistent
with the Residential and Open Space Review Area designation in the
General Plan. Ms. Moore stated that staff review of the appeal
letter and correspondence received shows no evidence or qualified
testimony indicating that the studies and conditions of approval
relied on and imposed by the Planning Commission are in error or
deficient.
Mayor Mulryan asked Ms. Moore to summarize the homeowners associ-
ation's 13 points.
Ms. Moore noted the homeowners association references an internal
Public Works Department memo which they claim indicates that the
Department is aware that the downstream system is inadequate to
handle runoff from this project. his. Moore stated that memo related
to a preliminary drainage study submitted at the time the subdivision
was applied for in 1981, and substantial work was done in 1984,
taking into account the peak storm characteristics the City had to
deal with in the early 19801s. Also, the Planning Commission
requested that the 1984 drainage analysis be reviewed by an impartial
third party expert, Mr. Dominic Selmi, who concluded, "the preceding
recommendations for Loch Lomond Unit 10 should reduce existing
downstream drainage problems. The street improvement proposed for
Unit 10 will also have a beneficial effect by intercepting surface
runoff and erosion. The repair of slides by the subdivider will
further reduce potential volume of earth carried by the runoff."
Ms. Moore stated the applicants contend that the staff report does
not address impacts of landslides and drainage problems and asked
that certain conditions in the 1979 Herzog report be imposed on the
project. Ms. Moore stated there are other conditions of approval
that staff recommended and the Planning Commission imposed that go
further than the 1979 Herzog report. Regarding the appellants'
demand for the repair of all landslides on and off-site, Ms. Moore
indicated that in the City's hazardous lands policy, landslides
are studied and those posing any threats to the proposed development
or other properties must be repaired prior to development.

The homeowners association also calls for a soils and geologic
analysis of the melange and fault area above the site. Ms. Moore
stated analysis of these areas will be performed as part of the final
plan review.
Regarding appellants' request for special engineering of swimming
pools in the slide areas, Ms. Moore noted this is standard operations
procedure in the Public Works Department in an area such as this.
Ms. Moore stated it is not the routine of the City to do a financial
study to determine the cost to the City relative to income from
proposed development.
Ms. Moore noted the other requests include the improvement of the
storm drainage system, a reworking of the channels servicing Loch
Lomond, removal of landslide material and debris from these channels,
supporting earth and banks along the swales to prevent further
erosion, and major improvements to the neighborhood drainage system.
All the City can legally require, is that this subdivision not
adversely affect the downstream situations.
Appellants also are asking for regular maintenance and repairs to be
established and budgeted for the storm drainage which is already in
the City's normal operating budget; in fact, for this fiscal year
1984/85, there is a Revenue Sharing project that is entitled "Debris
Removal From Silting Basins", of which funds will be extended to this
neighborhood and others.
Ms. Moore stated the Association is also asking for redistribution of
inflows to the Las Casas and Inverness storm basins although such a
diversion from one drainage basin to another is not consistent with
drainage basin law.
Appellants are also concerned about defoliation of the slopes.
Ms. Moore concluded that there is no substantiating evidence from the
homeowners association appeal which proves this project to be environ-
mentally degrading, or the property being physically unsuitable for
the type of development that has been approved. Ms. Moore stated
that this has been one of the most rigorously reviewed subdivisions,
which has been reviewed thoroughly as a result of the benefit of
knowledge gained from the storms in the early 1980's.
The president of the Loch Lomond Homeowners Association, Marianne A.
Shaw, stated that they were appealing the Planning Commission's
tentative map because of their concerns with landslides and storm
water drainage system, that they feel were not sufficiently addressed
through the review process or incorporated into the conditions of
approval. Mrs. Shaw stated that the Planning Department staff have
answered the concerns of the association that satisfied their needs
as far as their review process is concerned, but they have not
received adequate statements or guarantees from the Planning Depart-
ment or the developers concerning two major aspects, that of land-
slides and the storm water drainage system existing in Loch Lomond.
Mrs. Shaw reminded Council of a news article in the Independent
Journal dated January 9, 1982, with headlines, "The Great Storm".
Mrs. Shaw continued by referring to the Herzog Report dated October
14, 1979, a report from Cooper and Clark Engineers and a report from
Oberkamper and Associates, representatives of the developers of the
subdivision in question, indicating that these documents support and
provide evidence that landslides and drainage on this site have not
been answered adequately. A map furnished by the Planning Department
dated 1983 was shown and explained by Mrs. Shaw on where the lots are
located, and the landslide and drainage areas.
Mrs. Shaw called upon Mr. Salem Rice, who presented a geotechnical
letter he wrote and submitted to Council which had not been given to
the Planning Department, and explained some of the significant
information contained in the Herzog report, the Cooper and Clark
report and subsequent reports.

Mayor Mulryan informed Mrs. Shaw, that producing a letter at this
point may be delaying any action on the hearing should the informa-
tion contained in the letter need further study by the Planning
Department.
Mr. Salem Rice at this point, clarified that he did not have a
technical report, but a letter recently written when he was contacted
by the Loch Lomond Homeowners Association. Mr. Rice stated that his
name was used in the soils report implying that he concurred with the
findings in that report and that the first time he had known about it
was when he was contacted by Mrs. Shaw.
Mr. Rice stated that he is a professional geologist, licensed by the
State of California, and has mapped the geology of San Rafael and
prepared maps showing slopes for land use planning purposes which
were submitted in 1976 to the City. Mr. Rice's main concern is that
his name is being used in reference to the landslide, a small portion
of which is exposed in the southeast corner of the map in which a
major landslide mass hangs down into areas that have been built over
on flatter grounds. The Herzog report of October 24, 1979 came to
the conclusion that this deposit is safe and feasible to develop and
this report was submitted to Cooper and Clark, who were the City's
geotechnical review consultant. Cooper and Clark disagreed with the
Herzog's report, and stated that, "In our opinion, construction on
this landslide debris should be preceded by detailed geologic soil
investigation oriented toward further evaluation of potential hazards.
If the data developed does not unequivocably indicate that the area
is safe, then residential construction should not be contemplated."
Mr. Rice agreed with that recommendation. He indicated he finds no
evidence in a subsequent report and communications that the recom-
mended investigation was done. Mr. Rice noted in that particular
area, there are six lots which are entirely on this mass and portions
of lots 7, 8, 9 and 10 are also on the mass.
Mayor Mulryan asked Mr. Rice if he had reviewed the conditions that
have been imposed by the Planning Commission and recommended to
Council, and Mr. Rice stated he had. He added that Mr. Herzog avoids
calling this area a landslide but calls for special engineering
foundation construction and flexible pipe connections for structures.
Mr. Rice continued to state that this is an old landslide that is
many decades old and that storm activity in 1982 and 1983 reactivated
other landslides.
Mayor Mulryan asked Mr. Rice if the measures recommended by the staff
and Planning Commission are inadequate, and Mr. Rice stated that
regarding the landslide, the staff does not call for correction of it
by moving the mass out and other measures needed.
Planning Director Moore asked Mr. Rice if this recommendation was
contained in his letter for review by the City's Geotechnical Review
Board. Mr. Rice indicated it was not. However, he did recommend
that the City follow its geotechnical review consultant's recom-
mendation, which has not been done.
Ms. Moore asked Mr. Rice if he had reviewed Cooper and Clark's
correspondence of 1984 when staff called for additional information
and update, and Mr. Rice indicated he had not. Ms. Moore added that
tonight was a difficult time to respond to Mr. Rice's comments
because staff has no idea which materials Mr. Rice relied on in
coming to the conclusions he has made.
Mayor Mulryan asked Ms. Moore if lots 1 to 11 had or had not been
identified as a landslide area and adequate steps taken to safeguard
the area. Ms. Moore stated she is not qualified to answer that
question, but was familiar with what the geotechnical review had
gone through and conclusions reached by Cooper and Clark of the
City's Geotechnical Review Board. In 1984, they indicated that in
their opinion the proposed development is geologically feasible,
making specific recommendations that grading, drainage and foundation
recommendations contained in the Herzog report are normally required
for hillside development, and that they needed to review final
grading plans, and those are conditions of approval on the project.

Councilmember Russom asked Mr. Rice for clarification if the Cooper
and Clark report supersedes the Herzog report in this area and is
more accurate geologically and should be the controlling report.
Mr. Rice indicated he could not answer without seeing the 1984
report. Mr. Rice continued to state that Cooper and Clark did not do
detailed geologic studies, but reviewed the Herzog report. He
indicated he assumes that they had also looked at his (Mr. Rice's)
map. He said the City should follow the recommendations made by
Cooper and Clark.
Councilmember Breiner asked Mr. Rice to explain what "detailed
analysis" means. Mr. Rice replied this would including boring
trenches to establish the thickness of deposit, its potential
stability, and water level within it.
Councilmember Breiner asked Mr. Rice if he had looked at lots 23 and
24, and Mr. Rice indicated he had not.
Mrs. Shaw continued by reiterating what Mr. Rice had said, and spoke
on Basic Policy #7 on public and private proposals that might alter
environment and landslides. The San Rafael General Plan states that
public agencies have a clear mandate to protect the public from
injury and death and preventing property damage. They look at the
conditions of approval for protection and find nothing listed to
protect the residents against problems resulting from landslides
triggered in potentially unstable areas. Mrs. Shaw quoted from the
Herzog report that "There is an inherent risk of instability
associated with all hillside construction. In addition, subsurface
conditions are complex and may differ from those indicated by surface
features and those encountered as the test hole locations. There-
fore, we are unable to guarantee the stability of any hillside
construction. For houses constructed on hillsides, we recommend that
mudflow and earthquake insurance be obtained." Mrs. Shaw quoted a
final piece of advice from the Herzog report: "Soils conditions and
standards of practice change. Therefore, we should be consulted to
update this report if construction is not performed within 18
months." This report was done in October 1979. The report also
mentions that periodic maintenance be required. She mentioned also
the storm water drainage system serving the Loch Lomond and Villa
Real neighborhoods.
Mrs. Sonia Dietz of 127 Kinross showed pictures of damages to her
backyard done during the storms in 1982.
Mayor Mulryan called upon the developers' representative. Mr. John
Leahy, co -developer of the project with Mr. Robert Ham. Mr. Leahy
stated that they feel that the suggestions made by the Planning
Department benefited the total plan. He stated that they had
developed the Loch Lomond Highlands 30 years ago. From the stand-
point of the developers, they worked on this project a long period of
time and have employed professionals of top reputation who have
worked thoroughly with the planning staff and the public works staff
and independent consultants brought into the project, and after many
hours of meetings have worked out solutions to all the problems they
feel exist on the project. Mr. Leahy did not go into the issues
raised but did say however, that it is difficult for a layperson to
address these issues, particularly when lengthy reports are subjected
to extractions out of context, ignoring the final conclusions.
Further, the builder of the project, Mr. Robert Ham has built in
Marin for 20 years. As to the appeal, to Mr. Leahy's knowledge, all
the questions raised have technical merit, have been considered and
are included in the constraints and requirements for the future
development.
Mr. Lee Oberkamper, Civil Engineer for the development, spoke on the
drainage system and the facilities that will be constructed in con-
junction with the development that will provide improvement with the
downstream conditions, protecting the downstream property owners.
Mr. Dave Canal from Cooper Engineers (formerly Cooper & Clark) stated
that their capacity in this project is to review Herzog's original
report and also they are now acting as geotechnical consultants to
the developer. They concur with the statements Mr. Rice mentioned
that the geologic consultants to the developer. They concur with the
statements Mr. Rice mentioned that the geologic conditions have been
identified at the site, and further study of the major landslide are
needs to be done.

Mayor Mulryan clarified with Mr. Canal that in earlier documentation
from Cooper Engineers there is a slide area and that further actual
borings should be taken, and Mr. Canal agreed. Ms. Moore stated that
part of what was discussed was a matter of timing of the studies
required, and staff noted that City has routinely recommended that
these are detailed, expensive studies done after approval of the
tentative map, prior to approval of the final map.
Mayor Mulryan stated that what he was hearing from the public is that
there is a slide area that may have gotten lost in the shuffle, and
further testing should be made before a house is designed in the
areas 1 through 11. Public Works Director Bernardi informed Mayor
Mulryan that this level of detail will be provided.
Mr. Canal summarized stating that the studies done to date identified
potential geological hazards and conditions of the site and they feel
that those conditions have been identified, and changes in lot
locations and building areas have been made by the developer based on
input of a geologic nature. Further studies that need to be done
should be done after the final map has been prepared.
Mayor Mulryan asked Mr. Canal what specificity would the final map
entail. One of the concerns raised is how can you locate a house
before you know the dangers? Mr. Canal replied that the possible
dangers have been identified, and the developers are not allowed to
develop the site without doing further studies, and input has to be
made on each step along the way.
Councilmember Breiner asked City Attorney Ragghianti, that if a
tentative map is approved, is the final map also approved and can
major changes be made between the tentative and final maps? Mr.
Ragghianti stated that major changes are not to be made and that the
approval of the final map is administerial act. He said if the final
map purports with the conditions for approval specified in the
tentative map, it must be approved.
Public Works Director Bernardi explained that the process that occurs
is that the General Plan calls for the investigation of various items
of information. Once the tentative map is approved, the developer
has the responsibility to prepare plans and specifications to whatever
studies are necessary to address the conditions of approval. The
final map is not brought back to the City Council until all the
conditions of approval are met.
Mayor Mulryan asked Mr. Bernardi what would be included in the
preliminary map? Mr. Bernardi replied that it deals with grading,
construction of the roadways, the mitigation of the drainage con-
cerns, the repair of the slides, all the specific details.
Mayor Mulryan then asked if the borings and trenchings to evaluate
the depth and nature of the slides can logically be done before any
part of the studies needed to get to that point of the tentative map?
Mr. Bernardi stated it could be done that way if Council preferred.
Councilmember Frugoli stated that he would like to see a copy of the
Herzog report made in 1979 before the storms.
Councilmember Russom asked if staff and the Planning Commission were
comfortable with the wording from Cooper and Clark, and Mr. Bernardi
responded that rewording should be done.
Mr. Michael Smith of 99 Junipero Serra said that he had not come to
the meeting to object to the area until he heard what was said
tonight. At the last Planning Commission meeting, one more lot was
added and it moved the house site closer to his home. Mr. Smith
asked staff to analyze this in relationship to his property, and
wants the original lot to be put back.
Mr. Frank Batat of 62 Lochinvar Road stated he suffered greatly
during the storms and maintenance needs to be done; he asked that the
City have an on-going plan to take care of these problems.
Mayor Mulryan asked that the Public Works Department provide a
schedule for cleanup, including cost.

Mr. John Burns of 125 Kinross stated that during a minimum of 10 to
12 winters the culvert has overflowed causing a real problem.
Mayor Mulryan closed the public hearing.
Council referred this item back to staff without motion and asked
that they have a report submitted at another public hearing with the
following items reviewed (hearing to be re -noticed):
1. The order of the studies should be reviewed by the Geotechnical
Review Board and Council to review the Herzog reports, with
assurance that the Geotechnical Review Board has reviewed the
Herzog reports also.
2. Council asked to have maps submitted to them showing any existing
springs on the site.
3. Any situations in this area that are parallel to problems caused
in drainage swale in the Glenwood area where a house was
destroyed.
4. Wants to know what the maintenance of drainage facilities will
cost and information on the current schedule of maintenance of
drainage facilities.
5. Wants a detailed response on the wording concerning lots 23 and
24.
6. More explanation of what is to be done on the off-site slides
re borings and further testing.
7. Have Dominic Selmi review the issues raised and to attend the
next hearing.
8. If the City is relying on the conditions from Cooper & Clark
dealing with corrections on the major slide areas, these con-
ditions are to refer to specific remedial actions, rather than
referring to a report, and then a report is to be made spelling
out steps to be taken.
9. These lots should be looked at in terms of construction,
grading and site preparation, in chronological order.
10. Conditions (Cooper and Clark) to be reworded rather than
referring to the report.
21. REPORT ON NOISE COMPLAINTS RE T&T BAR & GRILL, 1325 FOURTH STREET
(CM) - File 13-9
Assistant City Manager Nicolai stated that this was a followup to a
complaint heard at the meeting of February 4, 1985, concerning the
operation of T&T Bar & Grill. The Police Department received no
complaints in the month of December, but in January, 25 calls for
service were received which were directly related to T&T's for either
noise or drunk subjects in the street. Due to the zoning in this
area, the current business does not require a use permit which would
allow the City to set specific restrictions. Even though there are
residents in this area, it is not zoned as a residential district.
Ms. Nicolai stated she had contacted Mr. Mel Figone of the State
Alcohol Beverage Control who informed her that they have worked
closely with the owners who have agreed to use smaller speakers and
improve the soundproofing. The owners also have a doorman who
watches the patrons as they leave the establishment to ensure that
they do not loiter outside. A.B.C. is monitoring the area watching
the streets to see if they can identify related activity to T&T.
A.B.C. is also working closely with the San Rafael Police Department,
and will come back to staff when they have a conclusion.
Councilmember Russom asked staff what is the City's recourse to
address a public nuisance legally in abating something like this?
City Attorney Ragghianti responded by saying that if there was a use
permit (of which there is none) and if the circumstances rose to a

level of a public nuisance, the City would have the right to a public
hearing order to show cause as to why a public nuisance ought not to
be declared to exist, to abate it either through civil proceedings
authorized by the Council or criminal proceedings authorized by the
Council.
Mayor Mulryan asked Mr. Ragghianti about the jurisdiction of the
A.B.C. Mr. Ragghianti replied that their purview would be only in
connection with revocation of T&T's license to serve alcoholic
beverages.
Mr. Richard Gelber, 1334 Fourth Street, stated he had a petition with
47 names of residents of the area who are asking the City Council to
recommend to the A.B.C. that the operating hours for T & T Bar &
Grill be limited to 11:00 PM Sundays through Thursday nights and no
later than midnight Friday and Saturday nights, which is what the
residents feel is appropriate for an eating establishment, as opposed
to being a full bar.
Mr. Joseph Territo, of 1334 Fourth Street, stated he had a problem
with the staff report on the number of telephone calls made, indi-
cating he had called 25 times to the Police Department and the
neighbors probably had done the same, and that there must be a
mistake in the amount of calls reported.
Mr. Mason Ravan, of 1317 Fourth Street, two stores from the bar,
stated the noise has affected his family and asked Council to try to
help them.
Mrs. Marie Sessi, who with her husband, have owned the building
at 1334 Fourth Street since 1978, stated they have 22 residents that
live upstairs and 6 downstairs. They are pleased with the tenants in
their building, but with the noise across the street at T&T Bar &
Grill, some of the tenants will be moving, and indicated they will
also have to pay over $2,000 to put windows in units to cut down
noise. Mrs. Sessi suggested that a letter be sent from the Council
to A.B.C. stating firmly what Council would like done to resolve this
problem.
Mr. Gimi Sessi acknowledged that the owners of T & T's are trying to
lessen the problem, but it is not compatible having apartments and
the bar that close. Mr. Sessi continued that Mr. Gelber had moved
out and Mr. Territo has threatened to move and they have also lost
two other tenants.
Mayor Mulryan asked staff to prepare a letter for his signature on
behalf of the Council to A.B.C. expressing specific concerns, and
asking them to have their report ready if they could, by the next
Council meeting of March 4, 1985.
Councilmember Breiner stated that they may want to consider having
all uses require use permits in the downtown area.
Mr. Tom Lyons, one of the owners of T & T's apologized to the City
and the neighbors in the area, stating that when they contracted for
the lease, they never thought that this problem would happen and
indicating that because of the way the building is built, that at
night the noise seems to echo. In defense of their customers, he
stated 95% seem to be having a normal conversation on the way out,
but there are a few people who are negligent, creating this problem.
Mr. Tim Stone, co-owner of T&T Bar & Grill, indicated that they have
asked the Police Department to drive by their neighborhood around
2:00 AM to aid in keeping patrons quiet. They also have an accous-
tical ceiling to be installed to help to keep the noise level
down. He indicated they have been dealing with A.B.C. and have met
with the neighbors and some of the neighbors have stated that the
noise level is lessening. Mr. Stone concluded by apologizing to the
neighbors for the noise and thanked the Police for their help.
22. STAFF EVALUATION OF REGULATING SERVICE STATION CONVERSIONS (P1) -

Councilmember Russom stated that he had a philosophical problem with
the proposed Ordinance, indicating he does not believe that the City,

beyond the areas of public health and safety, should get into the
areas which he considers to be a free market question, and the
question of a gas station conversion from full service to self
service is a free market question and one of what the market will
bear and not a regulatory one.
Councilmember Nave agreed with Mr. Russom and stated that the market
has changed within the last three years, and wonders if an Ordinance
is really needed at this time.
Councilmember Breiner indicated that she brought this subject up
thinking there were concerns in terms of what could be wholesale
conversions to self service. Mrs. Breiner stated that she had a
certain reluctance to build in the requirements to keep maintenance
facilities. Mrs. Breiner stated that there is a real necessity to
have restrooms, air and water available for people, indicating this
is simply creating a use permit procedure, not saying that the City
is not allowing conversions, but to review to see if there is a point
where it may create a problem in the community. Mrs. Breiner urged
the Council to think about this, because it may be fine now but
perhaps not at a later time.
Mayor Mulryan asked Planning Director Moore if the existing Ordinance
allows the City to monitor conversions and Ms. Moore replied that all
they can do is to require design review approval which is limited to
design matters; they cannot use design review approval to impose use
restrictions or mandatory requirements.
Mr. Waite Powell spoke on behalf of Marin Center for Independent
Living, representing the disabled of Marin County, indicating they
support the Ordinance. According to the way the law reads now,
should he enter a service station with an attendant, the attendant is
required by law to pump the fuel for him because of his handicap.
Mr. Powell stated they have supported San Anselmo and will support
San Rafael indicating he would not want it to get to a point where a
majority of the service stations are converted to computerization.
From the standpoint of the disabled, they ask that Council have some
control over the conversions.
Mayor Mulryan asked staff if the existing regulations allow the City
on an application for conversion to require handicapped access.
Ms. Moore said this could be done if it dealt with modification of a
service station, and would require a use permit.
In response to questioning from Councilmember Breiner, Ms. Moore
indicated that when a service station operator applies for a major
design change, a use permit is required. However, if a station is
changing one pump aisle from full service to self service, this is
something the City may not be aware of as the gas stations are not
monitored for this.
Council referred item to the Planning Commission, without motion to
review concerns in the area of the handicapped, basic services and
the free market enterprise, with a report to be brought back to
Council with their recommendations.
23. STATUS REPORT ON CALTRANS ANALYSIS OF HIGHWAY 101/INTERSTATE 580
INTERCHANGE (HIGHWAY 17) (PW) - File 11-16
Public Works Director Bernardi reported that CalTrans was nearing
completion on their study of Highway 101/I-580 Interchange for the
California Transportation Commission. Initial recommendations have
been made to the City so the City's comments can be included with the
report. The changes include widening of southbound Highway 101,
improving the Highway 101 southbound ramps at West Francisco Boule-
vard, reconstructing the Highway 101/I-580 structure, and phased
relocation of the local ramps to Bellam Boulevard. The proposed
widening of Highway 101 would provide two southbound lanes and no new
northbound lanes, requiring significantly more right of way than
previously anticipated. The improvements will not provide the two
directional capacity needed for buildout in East San Rafael. The
significant right-of-way take is not justified by the design standards
of adjoining sections of Highway 101 significantly impacting rede-
velopment along West Francisco Boulevard. Modifications to the

southbound ramps are similar to those previously recommended by City
staff; however, certain features of the design would reduce access to
local businesses. Alternate designs should be considered. The
changes to the Highway 101/Interstate 580 structures are similar to
those previously recommended by City staff and are needed to accom-
modate the ramp improvements. Concepts of relocating the Bellam
Boulevard ramp are similar to those previously recommended by staff,
and alternate designs to minimize the impact of right-of-way acqui-
sition and maintain as much of the existing network as possible
should be considered.
Mr. Dick Harrison, Civil Engineer for CalTrans' Project Development
Department, spoke on the project study report on the U.S. 101/Inter-
state 580 Interchange.
Mr. Art Brook, Senior Planner, briefly gave a report on the U.S.
101/Interchange 580 project.
Council accepted the staff report, without motion, and directed staff
to forward the City's concerns and comments to CalTrans.

contract for the southbound auxiliary lane between Second Street and
Interstate 580 will be awarded by the end of February. CalTrans
staff has indicated that the project will take six months to com-

1985. Construction is estimated to take 24 months.

ing to reach a decision whether to continue the project, and has been

It is recommended that some positions be reclassified in the Depart-
ment: a) the existing position of Land Development Engineer be
reclassified to Assistant Director of Public Works; b) reclassify the
Secretary position (currently vacant) to Building Technician, com-
mensurate with the Planning Department's Planning Technician position;
c) retitle the Chief Building Inspector (current incumbent retiring
March 15th) to Supervising Inspector; Senior Building Inspector and
Building Inspector to Building Inspector I/II; d) hire a Contract
Plan Check Engineer for a period of one year to deal with the in-
creased permit activity; e) reclassify the Building Development
Engineer to Senior Engineer who would take on supervisory respon-
sibilities directly overseeing the building permit process as a
whole.
In the traffic area, the long-term traffic needs and monitoring of
the traffic mitigation programs would be assigned to the Senior
Planner/Transportation. It is also recommended that the Traffic
Engineer position (currently vacant) be taken out of Mid -Management
and classified as Associate Civil Engineer/Traffic.
With the addition of the San Rafael Sanitation District maintenance,
it is recommended that a new position be created entitled Sewer
Maintenance Supervisor; this position will be totally funded by the
Sanitation District per the joint powers agreement.
Councilmember Breiner asked what the total annual cost would be and
Public Works Director Bernardi indicated it would be approximately
$20,000.

33. REQUEST FOR AUTHORIZATION FOR PARTTIME DEPUTY CITY ATTORNEY FOR
ONE-YEAR PERIOD (CA) - File 4-3-138 x 9-3-16
City Attorney Ragghianti indicated that the City Attorney's Department
is in need of a contract Deputy City Attorney to enable the department
to complete the many backlogged projects.
Councilmember Russom moved and Councilmember Nave seconded, to hire a
contract Deputy City Attorney on a one-year contract basis from March
1, 1985 to March 1, 1986 (Mary Casey).
