ORAL COMMUNICATIONS OF AN URGENCY NATURE:
Mr. David Frey of 1222 Irwin Street spoke on the high costs charged by
the YMCA.
Council directed City Manager Nicolai to write to the YMCA for information
on their various programs and fees charged to the public.

4. RESOLUTION ACCEPTING $7,625 NATIONAL ENDOWMENT FOR THE ARTS GRANT

Mayor Mulryan inquired about the status of filling position left vacant
by Molly Lambert at Falkirk. Library Director Stratford responded
that recruitment for the full-time mid -management position is taking
place.

10. PRESENTATION OF RESOLUTION OF APPRECIATION TO ALAN HARRY, ADMINISTRATIVE
ASSISTANT - File 102
Mayor Mulryan presented Alan Harry, Administrative Assistant, with
a Resolution of Appreciation for his three and one-half years' service
in the City Manager's Office, thanking him for his years of service.
11. RESOLUTION ABANDONING PROCEEDINGS - SAN RAFAEL CANAL DREDGING ASSESSMENT
DISTRICT NO. 1 (PW) - File 6-44
Public Works Director Bernardi stated staff was asking the Council
to cease the proceedings on the San Rafael Canal Dredging Assessment
District No. 1 because a land disposal site has been secured, noting
the funds previously needed to haul the debris to Alcatraz are no
longer necessary. He stated the Corps of Engineers is in the process
of refunding the $75,000 advance payment to the City. Mr. Bernardi
indicated there are some fees outstanding the City is committed to
pay, i.e., engineering, hydrosurveying and sediment testing. These
commitments will be used as part of the City's contribution toward
the dredging of the private work to be done if it takes place. The
property owners are to come back to staff by the end of next week
on the formation of their district.

Councilmember Breiner moved and Councilmember Nave seconded, to dispense
with the reading, to refer to it by title only, and adopt Charter
Ordinance No. 1540 by the following vote, to wit:

13. EQUITY ADJUSTMENT FOR PRINCIPAL PLANNER SALARY RANGE (CM) - File 7-3
x 9-3-17
City Manager Nicolai stated that recruitment for a Principal Planner
is now taking place, noting that the Associate Planners and Assistant
Planner recruitments are about to close.
She indicated a salary survey for the Principal Planner position was
done and San Rafael was found to be ten percent off the mean of the
market for the past two years. This position had been reviewed as
part of the management, mid -management survey done nine months ago
and a five percent adjustment was made at that time to bring the salary
range closer to the market.
Ms. Nicolai indicated there is a great deal of activity in the pro-
fessional planning area at this time, noting this to be the reason
salaries are becoming more competitive.
In response to Councilmember Frugoli's concern about the salary range
and the City's size, Ms. Nicolai responded a salary survey is done
by intentionally describing the position and responsibilities rather
than any particular title, to get the other jurisdiction to identify
whatever position is most equal to it. She indicated 17 applications
have been received but only three or four applicants might be considered
for an interview.
In response to Mayor Mulryan's question as to the cities polled, Ms.
Nicolai indicated that the survey was done with the following cities:
Fairfield, Hayward, Napa, San Leandro, Santa Rosa, South San Francisco,
Vacaville, Vallejo and Walnut Creek. She added these cities are the
ones determined through past experience to be the market draw rather
than cities of the same size as San Rafael and have comparable types
of positions.
After further discussion, Councilmember Breiner moved and Councilmember
Frugoli seconded, to adopt a Resolution Amending Resolution No. 7490
relating to the Principal Planner position with a five percent increase
rather than a 10 percent increase.
RESOLUTION NO. 7631 - RESOLUTION AMENDING RESOLUTION NO. 7490 PERTAINING
TO THE COMPENSATON FOR MANAGEMENT AND MID -MANAGEMENT
EMPLOYEES WITH A FIVE PERCENT INCREASE. (Principal
Planner salary range - Minimum $3,478.86; Maximum
$4,116.07).

ADD ITEM
1. EARTHQUAKE SAFETY CHECKS - File 13-11
Add item allowed to be discussed after clearance from City Attorney
Ragghianti.
Due to the recent earthquake in Los Angeles, Councilmember Breiner
asked staff to investigate the strength of overpasses and buildings
in San Rafael for earthquake safety, and bring a report back to Council
at some future meeting.
Councilmember Frugoli indicated the County of Marin has an ongoing
program on earthquake safety and suggested that the City's Public
Works Department bring the County's report to Council.
Ms. Nicolai stated a draft of an updated emergency plan for the City
was recently reviewed at a management/mid-management meeting, and
it is in the process of being revised for submittal to Council for
approval within the next couple of months.
Public Works Director Bernardi stated he will come back to Council
with information on the overpasses after checking with Caltrans.
He indicated legislation has been passed requiring cities to begin
an investigation program by having an inventory of buildings that
are not earthquake safe by 1991, with provisions to be made by the
City to make those buildings earthquake safe. He noted cities are
awaiting guidelines to be set up by the State on building safety which
are to be implemented by the local jurisdictions. He further pointed
out that currently, if an existing building was being modified, the
City could not require the owners to retrofit the whole building to
meet earthquake requirements, whereas any new building must meet today's
codes.
Mr. Bernardi noted that State law will provide that cities charge
the property owner a fee to cover the City's cost to investigate the
building and let the property owner know if their building is deficient
and if it must to be brought up to current codes.
