Special Meeting: Present: Lawrence E. Mulryan, Mayor Dorothy L. Breiner, Councilmember Gary R. Frugoli, Councilmember Richard Nave, Councilmember Maynard H. Willms, Councilmember Absent: None Also Present: Pamela J. Nicolai, City Manager; Jeanne M. Leoncini, City Clerk; Gary T. Ragghianti, City Attorney 1. APPOINTMENT OF PLANNING COMMISSIONER - File 9-2-6 Mayor Mulryan called the meeting to order and announced he had just received a letter of resignation, dated April 13, 1987, from Michael Smith, Chairman of the Planning Commission. He stated that Mr. Smith's resignation was based on the FPPC (Fair Political Practice Commission) matter of his inability to vote on a number of significant matters relating to the General Plan due to his various property holdings in the City of San Rafael. At the request of City Clerk Leoncini upon the advice of City Attorney Ragghianti, who believed this fell within the Brown Act open meeting agenda exceptions due to the fact the matter arose after the agenda was posted and could be discussed based on an affirmative vote of two-thirds of the Council, the following motion was made: Councilmember Frugoli moved and Councilmember Nave seconded, to allow for discussion on the impact of Chairman Smith's resignation. AYES: COUNCILMEMBERS: Breiner, Frugoli, Nave, Willms & Mayor Mulryan NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None Councilmember Breiner moved and Councilmember Nave seconded, to accept the resignation of Planning Commission Chairman Michael Smith. AYES: COUNCILMEMBERS: Breiner, Frugoli, Nave, Willms & Mayor Mulryan NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None Mayor Mulryan stated that Chairman Smith's resignation is accepted with regret and recognition of almost seven years of excellent service. After discussion, Councilmember Nave moved and Councilmember Willms seconded, that in addition to the 13 applicants who were interviewed on April 7, 1987, to call for additional applicants in view of the two vacancies on the Planning Commission, and to amend the City Council Policy relating to calling for applications from a 21 day period to 10 days for this instance only; deadline for receipt of applications was set for Friday, April 24, 1987 by 5:00 P.M. in the City Clerk's Office. AYES: COUNCILMEMBERS: Breiner, Frugoli, Nave, Willms & Mayor Mulryan NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None Councilmember Breiner asked that an option be left open to allow for call back of any applicant previously interviewed for further interview at Council request.
