REDEVELOPMENT AGENCY/CITY COUNCIL
PUBLIC HEARING RE PROPOSED SALE OF AGENCY PROPERTY TO MARIN SANITARI
SERVICE (JACOBY STREET) (RA)- File R-237 x SRCC 140
Redevelopment Program Manager Howard Ours reported that the joint public
hearing has been scheduled to conform with Section 33433 of the California
Health and Safety Code which requires the approval of any redevelopment
project within the jurisdiction of that public body when a Redevelopment
Agency sells property acquired by public funds. He stated that reading
Files have been placed in the City Clerk's office and in the office of tale
Redevelopment Agency.
Redevelopment Program Manager Ours explained that the first resolution
calls for the approval of a Negative Declaration by the Agency. The
second resolution cites compliance with Section 33433 and authorizes the
Agency's Executive Director to sign a Disposition Agreement with Marin
Sanitary Service Incorporated. The third resolution is for action by the
City Council, Which exercises jurisdiction over the disposition of real
property by a Redevelopment Agency, when that property has been acquired
by I)ubl.ic funds, and confirms that the Agency has complied Wl.th Section
33433 and approves the resale of this property.
The staff recommendation is to: Approve the Negative Declaration; deter-
mine the Agency has complied with Section 33433 and approve the Disposition
Agreement, with respect to Agency action, and to determine the Agency has
complied with Section 33433 and approve resale of property, with respect
to Council action.
Redevelopment Agency
It was moved by Member Nave and seconded by Member Russom to approve the
Resolution certifying the Negative Declaration.

It was moved by Member Frugoli and seconded by Member Nave,to adopt the
Resolution determining the Agency has complied with Section 33433 of the
Health & Safety Code and approving Disposition Agreement.
RESOLUTION 84-14 - DETERMINING AGENCY HAS COMPLIED WITH SECTION 33433 OF
THE CALIFORNIA HEALTH & SAFETY CODE AND APPROVING DIS-
POSITION AGREEMENT WITH MARIN SANITARY SERVICE

City Council
It was moved by Councilmember Russom and seconded by Councilmember Nave,
to adopt the Resolution determining the Agency has complied with Section
33433 of the Health & Safety Code and approving a Disposition Agreement
and resale of property.
RESOLUTION 6893 - DETERMINING AGENCY HAS COiMPLIED WITH SECTION 33433 OF
THE CALIFORNIA HEALTH AND SAFETY CODE AND APPROVING A
DISPOSITION AGREEMENT, AND RESALE OF PROPERTY
