A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL AUTHORIZING THE PUBLIC WORKS DIRECTOR TO
FILE AN APPLICATION FOR FEDERAL SURFACE
TRANSPORTATION PROGRAM AND CONGESTION
MITIGATION AND AIR QUALITY IMPROVEMENT PROGRAM
FUNDING IN THE AMOUNT OF $1,398,757.75 TO:
1. CONSTRUCT PAVEMENT REHABILITATION
THROUGHOUT THE CITY.
2. REPAIR BANK EROSION ON MAHON CREEK AT ALBERT
PARK AT "B" STREET.
3. BUILD SLOPE REPAIR AT OAKWOOD DRIVE.
THIS RESOLUTION COMMITS THE NECESSARY LOCAL
MATCH FOR THE PROJECTS AND ALSO STATES THE
ASSURANCE OF THE CITY OF SAN RAFAEL TO COMPLETE
THE PROJECTS.
BE IT RESOLVED by the Council of the City of San Rafael as follows:
WHEREAS, the City of San Rafael (City) under Article III of its charter
has power to enter into contracts and to provide for the construction and repair of public
streets; and
WHEREAS, the Transportation Equity Act for the 21" Century (TEA 21)
(Public Law 105-178, June 9, 1998) and the TEA 21 Restoration Act (Public Law 105-
206, July 22, 1998) continue the Surface Transportation Program (23 U.S.C.s 133) and the
Congestion Mitigation and Air Quality Improvement Program (CMAQ) (23 U.S.C.s 149);
and
WHEREAS, pursuant to TEA 21, and the regulations promulgated
thereunder, eligible project sponsors wishing to receive Surface Transportation Program or
Congestion Mitigation and Air Quality Improvement Program grants for a project shall

submit an application first with the appropriate metropolitan transportation planning
organization (MPO), for review and inclusion in the MPO's Transportation Improvement
Program (TIP); and
WHEREAS, the Metropolitan Transportation Commission is the MPO for
the San Francisco Bay region; and
WHEREAS, the City is an eligible project sponsor for Surface
Transportation Program or Congestion Mitigation and Air Quality Improvement Program
funds; and
WHEREAS, the City wishes to submit a grant application to MTC for
funds from the Surface Transportation Program or Congestion Mitigation and Air Quality
Improvement Program in fiscal year 1999/2000 for the following projects:
the following:
1) Pavement rehabilitation City-wide $1,194,000.00
2) Mahon Creek bank erosion repair $50,000.00
3) Oakwood Drive slope repair $154,757.75
WHEREAS, MTC requires, as part of the application, a resolution stating
1) The commitment of necessary local matching funds of least 11.5%; and
2) That the sponsor understands that the Surface Transportation Program
and Congestion Mitigation and Air Quality Improvement Program
funding is fixed at the programmed amount, and therefore any cost
increase cannot be expected to be funded with Surface Transportation
Program or Congestion Mitigation and Air Quality Improvement
Program funds; and
3) The assurance of the sponsor to complete the project as described in the
application, and if approved, as programmed in MTC's TIP.
4) That the sponsor understands that funds must be obligated by
September 30, 2001, or the project may be removed from the program.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
San Rafael that the Public Works Director is authorized to execute and file an application
for funding under the Surface Transportation Program or the Congestion Mitigation and
Air Quality Improvement Program of TEA 21 in the amount of $1,398,757.75 for the
above-mentioned projects; and
RESOLVED, FURTHER, that the Council, by adopting this Resolution,
does hereby state that:
1) The City will provide $782,300.55 (55%) in local matching funds; and
2) The City understands that the Surface Transportation Program and
Congestion Mitigation and Air Quality Improvement Program funding
for the project is fixed at $1,398,757.75, and that any cost increases
must be funded by the City from local matching funds, and that City
does not expect any cost increases to be funded with Surface
Transportation Program or the Congestion Mitigation and Air Quality
Improvement Program funds; and
3) The three projects mentioned above will be built as described in this
Resolution, and, if approved, as programmed in Metropolitan
Transportation Commission (MTC) Transportation Improvement
Program (TIP).
4) The program funds are expected to be obligated by September 30,

RESOLVED, FURTHER, that a copy of this Resolution will be transmitted to
the MTC in conjunction with the filing of the application; and
RESOLVED, FURTHER, that the MTC is requested to support the application
for the project described in the Resolution and to program the project, if approved, in MTC's
TIP.

the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of
the Council of said City on the 1551 day of March, 1999, by the following vote, to wit:
