A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL ORDERING THE CLOSING, ABANDONING AND
VACATING OF A CERTAIN DRAINAGE PIPE ON THE LANDS
OF ANDREAZZI AP#012-162-15, ANGELONE & ELLIOTT
AP#012-162-09, ALLAN AP#012-162-10, AND MONTELEONE
AP#012-162-11 OF THE SUBDIVISION ENTITLED "KNOLL
TERRACE" AS SHOWN ON THE MAP OF "KNOLL TERRACE"
SAN RAFAEL, MARIN COUNTY RECORDED AT PAGE 16 OF
BOOK 12, MARIN COUNTY RECORDS.
WHEREAS, the City Council of the City of San Rafael, on the P day of
June, 1996, adopted Resolution No. 9612 declaring its intent to close, abandon, and vacate
a certain drainage pipe on the lands of Andreazzi AP#012-162-15, Angelone & Elliott
AP#012-162-09, Allan AP#012-162-10, and Monteleone AP#012-162-11 of the
subdivision entitled "Knoll Terrace"; and
WHEREAS, said Resolution set the time and place for hearing all persons
interested in the proposed closing, abandoning and vacation of said pipe for Monday, the
ls` day of July, 1996, at 8:00 o'clock P.M., in the Council Chambers at the City Hall in the
City of San Rafael; and
WHEREAS, it appears from all evidence submitted that the following
described drainage pipe is unnecessary for present or prospective public use.
NOW, THEREFORE, IT IS HEREBY RESOLVED as follows:
1. That the following described drainage pipe is unnecessary for present or prospective public
use;
2. That the following described drainage facility is hereby ordered closed, abandoned and
vacated;
3 That the drainage facility closed, abandoned and vacated is described on Exhibit "A"
which is attached to Resolution 9612.

the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of
the Council of said City on Monday, the Is' day of July, 1996, by the following vote, to wit:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL DECLARING ITS INTENT TO CLOSE,
ABANDON AND VACATE A CERTAIN DRAINAGE PIPE ON
THE LANDS OF ANDREAZZI AP#012-162-15, ELLIOTT &
ANGELONE AP9012-162-09, ALLAN AP#012-162-10, AND
MONTELEONE AP#012-162-11 OF THE SUBDIVISION
ENTITLED "KNOLL TERRACE" AS SHOWN ON THE MAP OF
"KNOLL TERRACE" SAN RAFAEL, MARIN COUNTY
RECORDED AT PAGE 16 OF BOOK 12, MARIN COUNTY,
RECORDS.
WHEREAS, a 24" corrugated metal pipe running through the lands of
Andreazzi, Elliott & Angelone, Allan, and Monteleone of that certain subdivision known
as "Knoll Terrace" subdivision, draining surface storm water from the upper reaches of
Bret Harte Basin to the intersection of Clorinda Avenue and Madrona Street; and
WHEREAS, this pipe was installed by the property owners, and
subsequently this pipe was utilized as a drainage facility for storm water runoff; and
WHEREAS, the City has improved the drainage of storm water from this
area by constructing a completely new storm drain under the street, from the intersection
of Clorinda Avenue and Los Robles Drive to the intersection of Clorinda Avenue and
Madrona Street thereby bypassing the old drainage pipe; and
WHEREAS, as a result of this new construction, the old pipe no longer
serves any present or prospective public purpose.

NOW, THEREFORE, the City Council of the City of San Rafael resolves as
That the City of San Rafael intends to declare that the drainage pipe
originating at the intersection of Clorinda Avenue and Los Robles Drive transversing the lands of
Andreazzi, Elliott & Angelone, Allan, and Monteleone of subdivision entitled "Knoll Terrace" as
shown on the attached map labeled Exhibit `B", is unnecessary for present or prospective public
use; and
2. That the City of San Rafael intends to order closed, abandoned and vacated
under Section 8333(c) of the Streets and Highways Code of the State of California, that drainage
easement, if any, acquired by prescription or dedication as described in Paragraph (1) above, and
as is more particularly described in Exhibit "A"; and

3. That the City Council of the City of San Rafael shall conduct a public
hearing no sooner than fifteen (15) days after the adoption of this Resolution of Intent to Vacate
Easement, to hear evidence on whether the drainage easement described in Exhibit "A" is
unnecessary for present or prospective purpose and said hearing shall be posted and noticed
according to the provisions of the Streets and Highways Code; and
4. That Monday, the 1 st day of July, 1996, at 8:00 o'clock P.M., in the Council
Chambers at the City Hall in the City of San Rafael, California, is hereby set as the time and
place for hearing all persons interested in the proposed closing, abandoning and vacation of said
easement.
