HomeMy WebLinkAboutCC Resolution 9534 (Boyd Park)A RESOLUTION NO. 9.534 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL CERTIFYING A NEGATIVE DECLARATION AND APPROVING A DEVELOPMENT AND DISPOSITON AGREEMENT WITH THE MARIN COUNTY HISTORICAL SOCIETY FOR A PORTION OF BOYD PARK WHEREAS, the Marin County Historical Society (the "Society") has negotiated a draft Development and Disposition Agreement ("DDA") for the lease of a portion of Boyd Memorial Park for the construction of a historical Museum; and, WHEREAS, upon review of the DDA an environmental Initial Study was prepared consistent with the requirements of the California Environmental Quality Act (CEQA); and, WHEREAS, it was concluded in the Initial Study that the DDA for the lease of land and the construction of a 7500 square foot Museum building does not have the potential for creating a significant impact on the environment; and, WHEREAS, a Negative Declaration was prepared for the project and processed and reviewed in accordance with the California Environmental Quality Act (CEQA); and, WHEREAS, a mitigation monitoring program has been prepared and attached to the Negative Declaration to insure implementation of and compliance with all conditions required to mitigate any impact to a level of insignificance; and, WHEREAS, on December 18, 1995, the San Rafael City Council held a duly noticed Public Hearing at which time it considered the proposed Negative Declaration, oral testimony and written comments, the City Council staff report and all other material entered into the record; and, WHEREAS, the Negative Declaration for the project is consistent with the provisions of CEQA in that an Initial Study has been prepared on the project which determined that there is no substantial evidence that the project will have a significant impact on the environment. Mitigation measures will be attached to the project which reduce the potential impacts to a level of insignificance. Public notice of the intent to adopt the Negative Declaration has been done pursuant to state law. The proposed Negative Declaration has been considered in conjunction with the comments received during the review period and the public hearings. NOW, THEREFORE, BE IT RESOLVED that the City Council has exercised its independent judgement and determined that the proposed project does not have the potential for creating a significant impact on the environment and QR9GINA1 a5'l therefore certifies the Negative Declaration and mitigation monitoring program in accordance with the California Environmental Quality Act. BE IT FURTHER RESOLVED that the City Council approves the Development and Disposition Agreement for lease of a portion of Boyd Memorial park and construction of a Museum by the Marin County Historical Society; and, authorizes the Acting City Manager to sign the Agreement.
