HomeMy WebLinkAboutCC Resolution 9452 (Master Fee Schedule Amendment)RESOLUTION NO. 9 4 5 2 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL AMENDING ITS MASTER FEE SCHEDULE INCREASING PLANNING DEPARTMENT FEES AND ADDING A COST INDEX WHEREAS, City Council Resolution No. 7553 provides that development fees may be changed by the City Council subject to public hearing; and WHEREAS, a public hearing to consider proposed increases to the Planning Department's development application fees was duly noticed and advertised for July 17, 1995, as required by Government Code section 66016; and WHEREAS, the City Council has determined that the cost of providing certain services is not of general benefit but of special benefit to the applicant seeking the service or permit; and WHEREAS, the estimated revenue from the existing Planning fee schedule is less than the costs incurred by the service or permit; NOW, THEREFORE BE IT RESOLVED that the City Council of the City of San Rafael hereby makes the following findings: 1) Based on the analysis in Tables 1 and Exhibit D to the Planning Department Staff Report dated June 30, 1995, and in accordance with Government Code Section 66014, the charges adopted in this Resolution do not exceed the cost of services provided for which the charges are made. 2) The adoption of these charges is statutorily exempt from the California Environmental Quality Act under Public Resource Code Section 21080(b)8, establishment and modification of charges by a public agency to meet operating expenses. BE IT FURTHER RESOLVED that Exhibit "A" to Council Resolution No. 8474 which amended Section 10 of the Master Fee Schedule is repealed. BE IT FURTHER RESOLVED that Section 10 of Exhibit "A" to Council Resolution No. 8590 is revised. BE IT FURTHER RESOLVED, that certain fixed fees for those services are established as set forth in Exhibit "A". BE IT FURTHER RESOLVED, that an hourly fee of $62.40 per hour be established for those services provided by City staff as set forth in Exhibit "A" and that this rate shall be charged for all development applications for which processing times are greater than those used to set the fees listed in Exhibit "A." BE IT FURTHER RESOLVED, that when, in the judgment of the Planning Director, the size of a development proiect or the proiected costs of development review services require a deposit to guarantee payment of fees, applicants shall pay an initial deposit set by the Planning Director to cover initial costs; BE IT FURTHER RESOLVED, that the adopted fees are based on 1995 dollars and will be adjusted annually on July 1 based on the most recent Bay Area Consumer Price Index; BE IT FURTHER RESOLVED that these fees shall become effective immediately upon adoption. Actual fees and costs Fees shall be submitted in full at the time of the application to the City. Portions of fees may be refunded upon withdrawal of the application; the amount of refund shall be determined by the Planning Director, based upon the amount of work done by the City prior to withdrawal. Full fee credits may be granted toward resubmittal of applications if applications are withdrawn and resubmitted within 60 days from the date of withdrawal with the prior written authorization of the Planning Director. In the event that any work has been undertaken or use made of the property without legal authority prior to completing the requisite procedures necessary to authorize such work or use, the applicant shall pay two times the specified amount. Where a project requires more than one permit, the full fee shall be collected for each and every permit required. The City Council may waive planning fees for projects which include below market rate housing units. The amount of fees waived to be determined based on the proportion of the project which is below market rate housing, and the permanency of the housing subsidy. Permit fee charges at the hourly rate shall be limited to the staff costs for two hearings each at the Planning Commission and City Council level. This limit does not apply to hearings on Environmental Impact Reports.
