A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL AUTHORIZING EXECUTION OF GRANT
OF MAINTENANCE EASEMENT IN CITY OPEN SPACE
TO THE GUARDIAN FOUNDATION - SMITH RANCH
PERSONAL CARE/SKILLED NURSING FACILITY
ON SILVEIRA PARKWAY, SAN RAFAEL
WHEREAS, the public interest, convenience, necessity and
welfare require that the easement hereinafter mentioned be conveyed to
"The Guardian Foundation".
NOW, THEREFORE BE IT RESOLVED by the City Council of the City
of San Rafael, California, that the Mayor and City Clerk are authorized to
execute that certain grant of maintenance easement (for improvements such
as buttress fill, drilled pier walls, ditches, etc.) to "The Guardian
Foundation", and the City Clerk of said City is hereby directed to cause said
conveyance to be duly recorded in the office of the County Recorder of the
County of Marin, State of California, forthwith upon the adoption of this
Resolution.
I, JEANNE. M. LEONCINI, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced and
adopted at a regular meeting of the Council of said City on Monday, the 20th
day of December, 1993, by the following vote, to wit:

It is expressly agreed and understood by Grantees herein that Grantor reserves the right to also use the said
real property together with the right to convey additional easements therefore to others.
It is further agreed that the easement conveyed herein is exclusive to Grantees and to their contiguous real
property.
