RESOLUTION NO. 9025
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL ORDERING VACATION OF EXCESS
PORTIONS OF TERRACE AVENUE EXTENSION RIGHT-
OF- WAY - OAKWOOD UNIT 5 SUBDIVISION
WHEREAS, the City Council of the City of San Rafael on the 16th day of
August, 1993, passed and adopted Resolution No. 8996 entitled, "Resolution of
Intention to Consider Vacation of Excess Portions of Terrace Avenue Extension
Right of Way, Oakwood Unit 5, San Rafael, California"; and
WHEREAS, said notice was posted as required by law; and
WHEREAS, a hearing was held this day as required by law and said
Resolution No. 8996, at which hearing the Council of the City of San Rafael heard
evidence offered by all persons interested in or objecting to the vacation
hereinafter ordered; and
WHEREAS, it appears from all of the evidence submitted, and the said
Council finds, that the excess portions of street right of way herein described is
unnecessary for present or prospective public street purposes.
NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED that
excess portions of Terrace Avenue extension right of way, located in the City of San
Rafael, California hereinafter more particularly described, is unnecessary for
present or prospective public street purposes and is hereby vacated.
IT IS FURTHER RESOLVED that the excess portions of the public
street right of way proposed to be vacated is located in the City of San Rafael, State
of California, designated as Terrace Avenue, and is more particularly described on
the attached Exhibits "A" and "B".
IT IS FURTHER RESOLVED that the property so abandoned shall
become part of the property immediately adjacent thereto as described:
1) Portion of land described in Exhibit 'A" shall be merged with Lot 41
as shown on Map of Oakwood Unit 4 and 5 filed in Book 19 of Maps Page 13, Marin
County Records.

2) Portion of land described in Exhibit "B" shall be merged with Lot 39
as shown on Map of Oakwood Unit 4 and 5 filed in Book 19 of Maps Page 13, Marin
County Records.

certify that the foregoing resolution was duly and regularly introduced and adopted
at a regular meeting of the Council of said City on Monday, the 20th day of
September, 1993, by the following vote, to wit:

Being a portion of the public street known as Terrace Avenue as shown and delineated
on Map of Oakwood Units No.4'and 5 filed in Book 19 of Maps, Page 13, Marin County
Records, said portion being more particularly described as follows:
Beginning at the most northerly corner of Lot 41 as shown and delineated on the above
referenced Map, said point also lying on the easterly right-of-way line of Terrace
Avenue; thence along said common line South 36 degrees 33 minutes 30 seconds West,
35.78 feet; thence'South 56 degrees 10 minutes 28 seconds West, 37.93 feet; thence
North 57 degrees 32 minutes 51 seconds West, 13.00 feet; thence leaving said line
along a non -tangent curve to the left whose center bears South 57 degrees 32 minutes
51 seconds East having a radius of 125.60 feet, a central angle of -5 degrees 11
minutes 14 seconds for an arc length of 11.37 feet; thence South 52 minutes 21
minutes 44 seconds East, 7.00 feet; thence along a non -tangent curve to the left
whose center bears North 52 degrees 21 minutes 44 seconds West, having a radius of
118.95 feet a central angle of 41 degrees 05 minutes 44 seconds for an arc length of
85.32 feet to an angle point in the easterly right-of-way line of Terrace Avenue;
