WEST MULTI USE PATHWAY SUBJECT: A. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE PROGRAMMING OF $1 MILLION IN FEDERAL OBAG FUNDS FROM THE FRANCISCO BLVD WEST MULTI -USE PATH TO THE GRAND AVENUE PEDESTRIAN BRIDGE, IN EXCHANGE FOR ASSIGNING $1 MILLION IN LOCAL FUNDS FROM THE GRAND AVENUE PEDESTRIAN BRIDGE TO THE FRANCISCO BLVD WEST MULTI -USE PATH. B. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESCINDING RESOLUTION NO. 14282 AND AUTHORIZING, IN CONNECTION WITH THE FRANCISCO BOULEVARD EAST SIDEWALK WIDENING AND GRAND AVENUE PEDESTRIAN BRIDGE, THE FILING OF AN APPLICATION FOR FUNDING ASSIGNED TO THE METROPOLITAN TRANSPORTATION COMMISSION AND COMMITTING ANY NECESSARY MATCHING FUNDS AND STATING ITS ASSURANCE TO COMPLETE THE PROJECT RECOMMENDATION: Adopt the resolutions. BACKGROUND: Grand Avenue Bridge Funding The Grand Avenue Pedestrian Bridge project consists of installing a bicycle/pedestrian bridge just east of the existing Grand Avenue vehicular bridge which crosses the San Rafael Canal. This structure will improve access to Francisco Blvd. East and provide a vital connection between the downtown and east San Rafael. In 2011, the City of San Rafael received a grant for the design of the Grand Avenue Pedestrian Bridge from the Association of Bay Area Governments (ABAG). The design of the bridge has since been completed by Siegfried Engineering Inc. In order to construct this pedestrian bridge, acquisition of right- of-way is required which can take a significant amount of time. FOR CITY CLERK ONLY File No.: 170 x 9-3-40 Council Meeting: 06/05/2017 Disposition: Resolution 14339 & Resolution 14340 SAN RAFAEL CITY COUNCIL AGENDA REPORT / Paee: 2 Francisco Blvd. West Multi -Use Pathwav Funding Concurrent to the award of funds to the Grand Avenue Pedestrian Bridge project, $1 million in federal One Bay Area Grant (OBAG 2) funding was allocated for the construction of the Francisco Blvd. West multi -use pathway, a project to install a multi -use pathway next to the Sonoma Marin Area Rail Transit (SMART) line from 2nd Street to Andersen Drive. The OBAG 2 funds were allocated in addition to $250,000 in local funds from TAM to support the design and environmental phase of the multi -use path. At this point in time, the feasibility study and a 35% design have been initiated by Alta Planning and Design. SMART is anticipating moving forward with their Larkspur rail extension project, by hiring their design build contractor in July 2017 and anticipates starting construction as early as September 2017. Since SMART will be performing construction work to realign Francisco Blvd. West and install SMART rail lines for the Larkspur extension, and the multi -use pathway will be parallel to the SMART rails, the City's intention is to have Alta Planning develop a 35% -level plan set and finalize the environmental document so that we can request SMART's construction contractor to install the multi -use pathway simultaneously. While Public Works staff is in the process of applying for local and state grants to close the funding gap for the multi -use pathway project, at present the $1,000,000 in federal OBAG 2 funding allocated by MTC is the only funding source. The drawback in utilizing federal funds for the multi -use pathway project is that the process includes an exceptional amount of paperwork and time needed to follow the federal process. Utilization of federal funding on the multi -use pathway project would require the City to follow the federal environmental process which can take several months longer than the state environmental review to complete. With SMART anticipating starting the Larkspur extension construction in the fall of 2017, staff is concerned that complying with federal policies associated with the OBAG 2 federal funding on the multi- use pathway project will cause significant delays in the project, and therefore not coincide with SMART's construction schedule for the Larkspur extension. This would force the City to construct the pathway at a later date, after the train begins service. Construction of the multi -use pathway will require the use of heavy equipment for the installation of several wall systems, and this equipment will be difficult if not impossible to operate when the train is running. ANALYSIS: Proposed Funding Swap In order to expedite the review and pre -construction process for the multi -use pathway, and to assist the efforts for the pathway to be constructed simultaneously with the Larkspur rail extension, staff is recommending transferring the $1,000,000 in federal funding from the Francisco Blvd. West Multi -Use pathway to the Grand Avenue Pedestrian Bridge Project. Because the Grand Avenue Pedestrian Bridge Project has had federal funding (STP funds), the project has complied with the federal review process. If the transfer of federal OBAG 2 funds is made from the Multi -Use Pathway project, a standard federal review of paperwork will be required following the completion of the Right -of -Way phase. Staff is anticipating that this additional federal review will require 4 to 6 months to complete with construction approval to follow in early 2018. The proposed swap will thus cause a 4-6 month delay in receiving construction authorization for the Grand Avenue Pedestrian Bridge. Though the swap will cause a slight delay in the bridge construction authorization, assigning local funds to the Multi -Use path (by transferring the federal OBAG 2 funds over to the Grand Avenue Pedestrian Bridge) will speed up the construction authorization process for the pathway, since federal review and compliance will no longer be required. If the swap does not occur, and federal OBAG 2 funds remain assigned to the Multi -Use Pathway project, the additional time required for the pathway project to meet federal compliance will likely mean that aligning the construction timeline of the pathway and SMART's Larkspur extension may not be possible. Therefore, in order to provide as much opportunity as possible for the Multi -Use Pathway to be constructed with the Larkspur extension, staff is recommending the transfer of federal funds to the Grand Avenue Pedestrian Bridge Project even though there may be a short delay in authorization of construction for the bridge. Attachment 1- Resolution Requesting Funding Swap. The Metropolitan Transportation Commission (MTC) recently approved this swap of $1 million of local funds from the Grand Avenue Pedestrian Bridge to the Francisco Boulevard West Multi -Use Path project. A resolution of local support from the San Rafael City Council is required for the swap to be complete and for the funding to be approved in the Federal Transportation Improvement Program (TIP) database. This required resolution is attached as Attachment 1. Attachment 2 -Revised Resolution in Support of MTC Application. In addition, to effectuate this funding swap, the MTC has asked the City to revise the resolution the Council previously adopted in support of the application to use the OBAG funds for the Francisco Blvd. West Multi -Use Pathway Project. The Council adopted that resolution, No. 14282, on February 21, 2017. The resolution attached as Attachment 2 rescinds Resolution No. 14282, and readopts the substance of the earlier resolution, amended to refer to use of the OBAG funds for the Grand Avenue Pedestrian Bridge Project. The new resolution complies with MTC's requirement that the City affirm the following: • The sponsor commits to provide any required matching funds; SAN RAFAEL CITY COUNCIL AGENDA REPORT / Pajee: 4 • The sponsor understands that the regional discretionary funding is fixed at the programmed amount, and therefore any cost increase cannot be expected to be funded with additional regional discretionary funding; • The project will comply with the procedures, delivery milestones and funding deadlines specified in the Regional Project Funding Delivery Policy (MTC Resolution No. 3606, revised); and • The sponsor assures the completion of the project as described in the application, subject to environmental clearance, and if approved, as included in MTC's federal TIP; and • The project will have adequate staffing resources to deliver and complete the project within the schedule submitted with the project application; and • The project will comply with all project -specific requirements as set forth in the program; and • The applicant (City of San Rafael) has assigned, and will maintain a single point of contact for all FHWA and CTC -funded transportation projects to coordinate within the agency and with the respective Congestion Management Agency (CMA), MTC, Caltrans, FHWA, and CTC on all communications, inquiries or issues that may arise during the federal programming and delivery process for all FHWA- and CTC -funded transportation and transit projects implemented by the applicant. Transferring local funding presently assigned to the Grand Avenue Pedestrian Bridge project to the Francisco Blvd. West Multi -Use Pathway project will expedite the design and environmental process by complying with CEQA regulations instead of the federal environmental review process (NEPA) which takes significantly more time. Unfortunately the full design for the multi -use pathway has not been completed at this time, nor has the project been fully funded. Though Public Works continues to identify additional funding sources to close the funding shortfall for the multi -use pathway, it is still advantageous to expedite the environmental review process in order to ensure construction for the path can align with the SMART Larkspur extension construction schedule. The Grand Avenue Pedestrian Bridge project has followed the federal process through design such that it can accept federal funding for construction. FISCAL IMPACT: The swap does not have an effect on the total current budget and funding allocations available for the Grand Avenue Pedestrian Bridge nor the Francisco Blvd. West Multi -Use Path. As detailed in the "Before Propose Swap" and "After Proposed Swap" funding table above, the total funding available for each project is the same before and after the swap. OPTIONS: The City Council has the following options in this matter: 1. Adopt the two resolutions as presented to assign the OBAG2 funding originally assigned to the Francisco Blvd. West Multi Use pathway project to the Grand Avenue Pedestrian Bridge Project. In exchange, local funding assigned to the Grand Avenue Bridge shall be allocated to the Francisco Blvd. West Multi -Use Pathway project. 2. Do not approve the two resolutions and direct staff to proceed with the Francisco Blvd. West Multi - Use Pathway project by following the standard federal process. This may delay the execution of the construction to coincide with SMART's work and the pathway may inevitably be more expensive to construct while the train is operational. Resolution rescinding Resolution No. 14282 and adopting amended findings and resolutions RESOLUTION NO. 14339 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE PROGRAMMING OF $1 MILLION IN FEDERAL OBAG FUNDS FROM THE FRANCISCO BLVD. WEST MULTI -USE PATH TO THE GRAND AVENUE PEDESTRIAN BRIDGE, IN EXCHANGE FOR ASSIGNING $1 MILLION IN LOCAL FUNDS FROM THE GRAND AVENUE PEDESTRIAN BRIDGE TO THE FRANCISCO BLVD WEST MULTI -USE PATH. WHEREAS, the Metropolitan Transportation Commission (MTC) proposed to provide $1,000,000 in financial support for the Francisco Blvd. West Multi -Use Pathway (herein referred to as the OBAG 2 Project), through the OBAG 2 Program; and WHEREAS, MTC is administering the OBAG2 Program using federal Surface Transportation Program (STP) and Congestion Mitigation and Air Quality (CMAQ) funding administered by the Federal Highway Administration (FHWA); and WHEREAS, all projects receiving federal STP and CMAQ funding are required to comply with federal requirements, including but not limited to, obtaining National Environmental Policy Act (NEPA clearance; and WHEREAS, the City of San Rafael (herein referred to as CITY) plans to obtain California Environmental Quality Act (CEQA) clearance for the OBAG 2 Project but does not plan to obtain NEPA clearance; and WHEREAS, the OBAG 2 Project is not eligible to receive STP or CMAQ funds without NEPA clearance; and WHEREAS, CITY proposes a transportation project (Grand Avenue Pedestrian Bridge Project) (herein referred to as SUBSTITUTE PROJECT) which is eligible to receive STP or CMAQ funding; and WHEREAS, the CITY will provide no less than $1,000,000 in local funding from a source to be determined to the OBAG 2 Project provided that CITY receives $1,000,000 in STP or CMAQ funding for the SUBSTITUTE PROJECT; and WHEREAS, contemporaneously with this Resolution, CITY is adopting a Resolution of Local Support for SUBSTITUTE PROJECT. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AS FOLLOWS: That CITY requests MTC to provide $1,000,000 in STP or CMAQ funding to the SUBSTITUTE PROJECT; 2. That CITY agrees to provide no less than $1,000,000 in local funding to the OBAG 2 Project, provided that CITY receives the aforementioned STP or CMAQ funding for the SUBSTITUTE PROJECT; 3. That CITY agrees to provide the Transportation Authority of Marin (herein referred to as TAM) with documentation that no less than $1,000,000 in local funding has been expended on the OBAG 2 Project; and 4. That CITY agrees to apply to obtain the federal authorization to proceed (E- 76/Obligation) from FHWA no later than January 2018 for SUBSTITUTE PROJECT. I, ESTHER C. BEIRNE, City Clerk File No.: 16.01.284 RESOLUTION NO. 14340 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESCINDING RESOLUTION NO. 14282 AND AUTHORIZING, IN CONNECTION WITH THE FRANCISCO BOULEVARD EAST SIDEWALK WIDENING AND GRAND AVENUE PEDESTRIAN BRIDGE, THE FILING OF AN APPLICATION FOR FUNDING ASSIGNED TO THE METROPOLITAN TRANSPORTATION COMMISSION AND COMMITTING ANY NECESSARY MATCHING FUNDS AND STATING ITS ASSURANCE TO COMPLETE THE PROJECT. WHEREAS, on February 21, 2017, the City Council adopted Resolution No. 14282, "Resolution of the City Council of the City of San Rafael Authorizing, in Connection with the Francisco Boulevard East Sidewalk Widening and Francisco Blvd. West Multi -Use Pathway, the Filing of an Application for Funding Assigned to the Metropolitan Transportation Commission and Committing any Necessary Matching Funds and Stating its Assurance to Complete the Project"; and WHEREAS, the City Council now intends to use Metropolitan Transportation Comission (MTC) -approved federal funds for the Grand Avenue Pedestrian Bridge project rather than for the Francisco Blvd. West Multi -Use Pathway project referenced in Resolution No. 14282; and therefore wishes to amend and readopt all the findings and resolutions originally made in Resolution No. 14282; and WHEREAS, the findings and resolutions of Resolution No. 14282 are set forth in their amended form in all of the next succeeding paragraphs; and WHEREAS, the City of San Rafael (herein referred to as APPLICANT) is submitting an application to the Metropolitan Transportation Commission (MTC) for $2,100,000, $4,025,000 and $1,000,000 in funding assigned to MTC for programming discretion, which includes federal funding administered by the Federal Highway Administration (FHWA) and federal or state funding administered by the California Transportation Commission (CTC) such as Surface Transportation Block Grant Program (STP) funding, Congestion Mitigation and Air Quality Improvement Program (CMAQ) funding, Transportation Alternatives (TA) set-aside/Active Transportation Program (ATP) funding, and Regional Transportation Improvement Program (RTIP) funding (herein collectively referred to as REGIONAL DISCRETIONARY FUNDING) for the Francisco Boulevard East Sidewalk Improvement Project ($2,000,000 in OBAG funds and $4,025,000 in Regional ATP funds) and the Grand Avenue Pedestrian Bridge Project ($1,000,000 in OBAG funds) (herein referred to as PROJECT) from the One Bay Area Grant Program and Regional Active Transportation Program (herein referred to as PROGRAM); and WHEREAS, the United States Congress from time to time enacts and amends legislation to provide funding for various transportation needs and programs, (collectively, the FEDERAL TRANSPORTATION ACT) including, but not limited to the Surface Transportation Block Grant Program (STP) (23 U.S.C. § 133), the Congestion Mitigation and Air Quality Improvement Program (CMAQ) (23 U.S.C. § 149) and the Transportation Alternatives (TA) set-aside (23 U.S.C. § 133); and WHEREAS, state statutes, including California Streets and Highways Code §182.6, §182.7, and §2381(a)(1), and California Government Code §14527, provide various funding programs for the programming discretion of the Metropolitan Planning Organization (MPO) and the Regional Transportation Planning Agency (RTPA); and WHEREAS, pursuant to the FEDERAL TRANSPORTATION ACT, and any regulations promulgated thereunder, eligible project sponsors wishing to receive federal or state funds for a regionally -significant project shall submit an application first with the appropriate MPO, or RTPA, as applicable, for review and inclusion in the federal Transportation Improvement Program (TIP); and WHEREAS, MTC is the MPO and RTPA for the nine counties of the San Francisco Bay region; and WHEREAS, MTC has adopted a Regional Project Funding Delivery Policy (MTC Resolution No. 3606, revised) that sets out procedures governing the application and use of REGIONAL DISCRETIONARY FUNDING; and WHEREAS, APPLICANT is an eligible sponsor for REGIONAL DISCRETIONARY FUNDING; and WHEREAS, as part of the application for REGIONAL DISCRETIONARY FUNDING, MTC requires a resolution adopted by the responsible implementing agency stating the following: • the commitment of any required matching funds; and • that the sponsor understands that the REGIONAL DISCRETIONARY FUNDING is fixed at the programmed amount, and therefore any cost increase cannot be expected to be funded with additional REGIONAL DISCRETIONARY FUNDING; and • that the PROJECT will comply with the procedures, delivery milestones and funding deadlines specified in the Regional Project Funding Delivery Policy (MTC Resolution No. 3606, revised); and • the assurance of the sponsor to complete the PROJECT as described in the application, subject to environmental clearance, and if approved, as included in MTC's federal Transportation Improvement Program (TIP); and • that the PROJECT will have adequate staffing resources to deliver and complete the PROJECT within the schedule submitted with the project application; and • that the PROJECT will comply with all project -specific requirements as set forth in the PROGRAM; and • that APPLICANT has assigned, and will maintain a single point of contact for all FHWA- and CTC -funded transportation projects to coordinate within the agency and with the respective Congestion Management Agency (CMA), MTC, Caltrans, FHWA, and CTC on all communications, inquires or issues that may arise during the federal programming and delivery process for all FHWA- and CTC -funded transportation and transit projects implemented by APPLICANT; and WHEREAS, that APPLICANT is authorized to submit an application for REGIONAL DISCRETIONARY FUNDING for the PROJECT; and WHEREAS, there is no legal impediment to APPLICANT making applications for the funds; and WHEREAS, there is no pending or threatened litigation that might in any way adversely affect the proposed PROJECT, or the ability of APPLICANT to deliver such PROJECT; and WHEREAS, APPLICANT authorizes its Executive Director, General Manager, or designee to execute and file an application with MTC for REGIONAL DISCRETIONARY FUNDING for the PROJECT as referenced in this resolution; and WHEREAS, MTC requires that a copy of this resolution be transmitted to the MTC in conjunction with the filing of the application. NOW, THEREFORE, BE IT RESOLVED that the APPLICANT is authorized to execute and file an application for funding for the PROJECT for REGIONAL DISCRETIONARY FUNDING under the FEDERAL TRANSPORTATION ACT or continued funding; and be it further RESOLVED that APPLICANT will provide any required matching funds; and be it further RESOLVED that APPLICANT understands that the REGIONAL DISCRETIONARY FUNDING for the project is fixed at the MTC approved programmed amount, and that any cost increases must be funded by the APPLICANT from other funds, and that APPLICANT does not expect any cost increases to be funded with additional REGIONAL DISCRETIONARY FUNDING; and be it further RESOLVED that APPLICANT understands the funding deadlines associated with these funds and will comply with the provisions and requirements of the Regional Project Funding Delivery Policy (MTC Resolution No. 3606, revised) and APPLICANT has, and will retain the expertise, knowledge and resources necessary to deliver federally -funded transportation and transit projects, and has assigned, and will maintain a single point of contact for all FHWA- and CTC -funded transportation projects to coordinate within the agency and with the respective Congestion Management Agency (CMA), MTC, Caltrans, FHWA, and CTC on all communications, inquires or issues that may arise during the federal programming and delivery process for all FHWA- and CTC -funded transportation and transit projects implemented by APPLICANT; and be it further RESOLVED that PROJECT will be implemented as described in the complete application and in this resolution, subject to environmental clearance, and, if approved, for the amount approved by MTC and programmed in the federal TIP; and be it further RESOLVED that APPLICANT has reviewed the PROJECT and has adequate staffing resources to deliver and complete the PROJECT within the schedule submitted with the project application; and be it further RESOLVED that PROJECT will comply with the requirements as set forth in MTC programming guidelines and project selection procedures for the PROGRAM; and be it further RESOLVED that, in the case of a transit project, APPLICANT agrees to comply with the requirements of MTC's Transit Coordination Implementation Plan as set forth in MTC Resolution No. 3866, revised; and be it further RESOLVED that, in the case of a highway project, APPLICANT agrees to comply with the requirements of MTC's Traffic Operations System (TOS) Policy as set forth in MTC Resolution No. 4104; and be it further RESOLVED that, in the case of an RTIP project, PROJECT is included in a local congestion management plan, or is consistent with the capital improvement program adopted pursuant to MTC's funding agreement with the countywide transportation agency; and be it further RESOLVED that APPLICANT is an eligible sponsor of REGIONAL DISCRETIONARY FUNDING funded projects; and be it further RESOLVED that APPLICANT is authorized to submit an application for REGIONAL DISCRETIONARY FUNDING for the PROJECT; and be it further RESOLVED that there is no legal impediment to APPLICANT making applications for the funds; and be it further RESOLVED that there is no pending or threatened litigation that might in any way adversely affect the proposed PROJECT, or the ability of APPLICANT to deliver such PROJECT; and be it further RESOLVED that APPLICANT authorizes its Executive Director, General Manager, City Manager, or designee to execute and file an application with MTC for REGIONAL DISCRETIONARY FUNDING for the PROJECT as referenced in this resolution; and be it further RESOLVED that a copy of this resolution will be transmitted to the MTC in conjunction with the filing of the application; and be it further RESOLVED that the MTC is requested to support the application for the PROJECT described in the resolution, and if approved, to include the PROJECT in MTC's federal TIP upon submittal by the project sponsor for TIP programming.
