RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SAN RAFAEL
DENYING APPEAL OF PLANNING COMMISSION'S DECISION
THAT AN OFFICE PROPOSAL ABOVE A .3 FAR
(FLOOR AREA RATIO) IS CONSISTENT
WITH THE SAN RAFAEL GENERAL PLAN 2000
65 Mitchell Boulevard
WHEREAS, the appellant requested a higher FAR for a redevelopment
proposal at 65 Mitchell Boulevard during City Council General Plan hearings;
and
WHEREAS, the City Council considered the request and adopted
the General Plan without provision for a FAR above .3 for 65 Mitchell Boulevard;
and
WHEREAS, the appellant met further with planning staff following
adoption of the Plan and stated that his plans for an office building with
a .57 FAR should be considered consistent with the General Plan; and
WHEREAS, staff determined that such a proposal would not be consistent
with the General Plan FAR of .3 in Northgate; and
WHEREAS, the property owner appealed this determination on the
basis that the proposal is a redevelopment project and is therefore consistent
with Policy LU -15; the proposal meets the intentions of the General Plan
and the specifics of the Northgate Plan; and the proposal meets intensity,
design, etc. standards. Additionally, the appellant stated he should be
entitled to construct a proposed office at greater than the .3 FAR because
the vast majority of Northgate Industrial Park buildings are developed
at greater than .3 FAR; and
WHEREAS, the prior service station building was developed at
less than a .3 FAR and a change of use is proposed. Therefore, LU -15 does
not apply; and
WHEREAS, the project does not meet the intensity (i.e., FAR limit)
standards in the Plan; and
WHEREAS, the proposal is not consistent with the General Plan,
in that Plan modifications to allow waiver of the FARs based on estimated
historic trips would be necessary and are not recommended for reasons identified
in the Council staff report of January 3, 1989.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council
denies the appellant's appeal and upholds the Planning Commission determination
that an office proposal at 65 Mitchell Boulevard above a .3 FAR is inconsistent
