A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL GRANTING PARTIAL AND TEMPORARY RELIEF
OF A BUILDING CODE REQUIREMENT - NORTHGATE
SHOPPING CENTER ENCLOSURE
(RE: TENANT SMOKE EVACUATION SYSTEM)
WHEREAS, the City Council of the City of San Rafael is
authorized, pursuant to Section 12.12.020 of the Municipal Code, to
grant relief of Building Code requirements, and
WHEREAS, Mace Rich Company, the applicant, for Northgate
Shopping Center has requested partial and temporary relief from build-
ing code requirements pertaining to tenant area smoke evacuation
systems, and
WHEREAS, the City Council gave the applicant full oppor-
tunity to be heard, the City Council does hereby find as follows:
1) That granting of partial and temporary relief for a
tenant smoke evacuation system will not create a hazardous condition,
if the conditions listed below are met:
a) That all other requirements of the Appendix to
Chapter 7 of the Building Code can be met;
b) Mace Rich will develop and enforce a program to
upgrade the existing leased spaces to
the
re-
quirements
of the Appendix to Chapter
7 of
the
code. The
upgrade of an existing space will
be
required in
the event of or not later
than
the
expiration
of the existing leases, or
upon
the
renovation
of the leased space;
c) The new mall enclosure emergency generator will
be sized large enough to provide standby power
for the complete covered mall building to include
the existing leased spaces;
d) Mace Rich will review and approve all new tenant
plans and require application of the requirements
of Appendix to Chapter 7 prior to the submission
for a building permit by a tenant;
e) Upon remodeling or expiration of a lease, the
tenant space will require installation of a smoke

control system from the public area below the
ceiling through the roof by use of the tenant air
conditioning system, or a separate smoke exhaust;
f] Upon remodeling, or expiration of a lease, each
tenant space shall be separated from other tenant
spaces by a wall having a fire -resistive rating
of not less than one hour. The separation wall
shall extend from the floor to the underside of
the ceiling above;
g) The ventilating system for the mall area will be
designed to operate in a positive air mode with a
manual reverse cycle available to the Fire
Department personnel for smoke evacuation. The
mall ventilating system will be oversized to
allow for ten (10) air changes per hour in the
occupied zone to provide for the extra smoke
evacuation of the leased areas; and
h) The Mace Rich Company will indemnify the City in
regards to any claims arising out of this action
in a form acceptable to the City Attorney.
NOW, THEREFORE, BE IT RESOLVED BY THE SAN RAFAEL CITY
COUNCIL, that in view of the foregoing findings that partial and
temporary relief from tenant smoke evacuation system at Northgate
Shopping Center, be and is hereby granted.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said City
on Monday, the 4th day of August 1986, by the following vote, to wit:
