This schedule lists the respective bail amounts to be used by the Marin County Courts in conducting criminal infraction and misdemeanor proceedings for violations of the San Rafael Municipal Code. The Council requested more information from staff about the purposes of the bail schedule and whether the current bail amounts are sufficient. Staff analyzed the City Council’s questions and, due to the Court’s request for the City to forward its adopted bail schedule by November 15, staff recommends that the 2018 bail schedule be adopted as presented this year, and that any changes to the schedule be developed for consideration by the Council next year for the 2019 bail schedule. RECOMMENDATION: Staff recommends that the Council adopt the Resolution approving the 2018 Bail Schedule as presented (Attachment 1), and provide direction to staff to undertake a comprehensive review of bail amounts for the bail schedule for 2019. BACKGROUND: For uniformity in the imposition of penalties for infraction and misdemeanor violations of municipal ordinances within Marin County, the Marin County Courts annually ask each city to provide a requested “bail schedule” that lists the bail amounts the Courts should impose for violations of their respective municipal codes (Attachment 2). The judges of the Court review the requested bail schedule submitted by each city, and if approved those bail schedules are adopted for use during the calendar year. Once adopted, the judges use a city’s bail schedule to determine the bail to be set when a person is charged with a municipal code violation. When a person charged with such an offense chooses not to SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 2 contest the citation by going to trial, or if that person is convicted after trial, the Courts will refer to the bail schedule for the amount of any penalty to be imposed. The bail schedule enables the Courts to impose substantially the same penalties on different persons for violations of the same municipal ordinance. If no bail amount is listed, the Courts will use “default” base bail amounts, which are set this year at $35 for infractions and $185 for misdemeanors. Historically, the City of San Rafael’s bail schedule has primarily recommended bail amounts consistent with the court’s default bail amounts. In recent years, the City of San Rafael has requested very few changes to its bail schedule, mostly for the purpose of adding violations of new regulations adopted by the City, or deleting obsolete violations. The City does not frequently rely on the bail schedule in its enforcement of City Code violations. The City’s code enforcement efforts continue to emphasize administrative enforcement through use of administrative citations and administrative orders pursuant to Chapters 1.44 and 1.46 of the Municipal Code, which do not rely on the criminal bail schedule. The bail schedule comes into play only occasionally where police officers or possibly code enforcement staff, determine they need to pursue criminal enforcement remedies. ANALYSIS: In preparing its bail schedule, the City is allowed to set only a “base bail” amount for each violation. The proposed 2018 bail schedule attached to this report proposes no change to the base bail amounts approved for the 2017 bail schedule except to add violations in San Rafael Municipal Code Sections 12.13.010 and 12.22.01, reflecting the City's adoption of the California Resident ial Code and the California Existing Building Code. The base bail amounts match the Courts’ current default bail amounts of $35 for infractions and $185 for misdemeanors. Although the base bail amounts are relatively small, the “total bail amount” for each violation, which is the amount that the offender must pay, is actually substantially larger because it also includes penalties and assessments imposed by the State and County. This can be illustrated by the case cited by Mayor Phillips during the Council’s consideration of this item on November 6, a violation of San Rafael Municipal Code section 5.32.030 (“[t]he driver of a vehicle shall not drive within any sidewalk area or any parkway except at a permanent or temporary driveway”), an infraction. The proposed bail schedule shows a base bail of $35. However, the total penalty that will be imposed by the Court for this violation will be $158. Similarly, a misdemeanor violation, such as a violation of San Rafael Municipal Code section 5.64.020 (prohibiting operating “a motor vehicle other than a publicly owned motor vehicle, on, over or across any fire trail, hiking trail, open space or park lands, without first securing a permit . . .”), is shown with a base bail of $185, however the total penalty that will be imposed is $773. Staff recommends that the Council approve the proposed 2018 Bail Schedule as proposed, and give staff direction to investigate increases for Council consideration next year for the 2019 bail schedule. FISCAL IMPACT: The proposed 2018 bail schedule, if adopted by the Marin County Courts, will not result in any change in the portion of bail payments for City Code violations remitted by the Courts to the City. The amount of the total bail the City may recover is set by state law, and is limited to 87% share of the base bail amounts for City Code violations, with the State and County receiving the additional assessments making up the “total bail”. Thus the City receives less than 21% of the total bail amount in any case. This statutory limit, along with infrequent City reliance on criminal enforcement for Municipal Code violations, means that even if the City Council increases the base bail amounts, there will not be a substantial increase in City revenues. Direct staff to return with more information; 3. Take no action. This will result in the Marin Superior Court relying on the City’s 2017 Bail Schedule. ACTION REQUIRED: Adopt attached Resolution approving the proposed 2018 Bail Schedule for violations of the Municipal Code, and provide direction to staff regarding investigation of increased bail amounts for the bail schedule for 2019. RESOLUTION NO. 14419 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL APPROVING A PROPOSED 2018 BAIL SCHEDULE FOR VIOLATIONS OF THE SAN RAFAEL MUNICIPAL CODE WHEREAS, Penal Code Section 1269(b) requires the Marin County Superior Court to adopt an annual countywide bail schedule which includes bail amounts for Municipal Code violations; and WHEREAS, the Marin County Superior Court has requested the City of San Rafael to advise the Court of any proposed changes to the bail schedule for violations of the San Rafael Municipal Code for inclusion in the 2018 countywide bail schedule; and WHEREAS, the text of the bail schedule for the City of San Rafael was last amended in 2014 based upon a recommendation by the City Council in 2013 by Resolution No. 13628; and WHEREAS, the City’s bail schedule now needs to be amended to reflect the changes made in the last year to add sections to the City’s Municipal Code; NOW THEREFORE, be it resolved by the City Council as follows: 1. That the Marin County Superior Court is requested to accept the proposed 2018 Bail Schedule attached hereto as Exhibit “A” and incorporated herein by reference, for violations of provisions of the San Rafael Municipal Code. 2. Kim Court Executive Officer DATE: October 16, 2017 SUBJECT: ANNUAL BAIL SCHEDULE REVIEW In preparation for the annual bail schedule review conducted by the Judges of the Marin County Superior Court (in accordance with the provisions of Penal Code § 1269b(c) and California Rule of Court 4.102), I am writing to invite your agency to provide written recommendations for changes to your juridiction’s offenses. Please see the January 2017 bail schedule available online at: http://www.marincourt.org/uniform_bail_sched.htm The bail schedule reflects your agency’s current list of offenses. As part of your review, please see the questions below and discuss them with your city attorney and/or governing body.  Are there any errors in the section, type of violation, and/or description of the offense?  Have you re-numbered or re-lettered your violations?  Do you have new offenses to add? If so, please list them in the same format as your existing schedule and provide a brief explanation to help the Court in establishing an appropriate bail amount.  If you would like to change the "Total Bail" for any of your existing offenses, please provide a brief justification to the Court.  Would you like to change the severity of an offense (e.g., provide an infraction level for a violation presently listed as a misdemeanor only?) page 1 of 2 Unless there is a change in the Judicial Council authorized default bail amounts for 2018, the Court has established the following default bail amounts for any offense not specifically listed in the local ordinance schedule: Base + Additional = Total Bail/Penalty Penalties Surcharges Misdemeanor $185 + $588 = $773 + $40 (A) + $30 (B) = $843 Infraction $ 35 + $123 = $158 + $40 (A) + $35 (B) = $233 (A) The $40 fee for Court Security specified by Penal Code § 1465.8(a) is also collected on each convicted charge in addition to the stated total bail. Any bail amount you propose will include the additional $30 fee per conviction upon collection. Accordingly, if there is more than one charge listed on a complaint or citation, there may be multiple assessments of the $30 fee if the defendant is convicted on more than one charge. These collections will be remitted to the State. (B) Pursuant to California law, the Court will also add a conviction assessment of $35 for each infraction and $30 for each misdemeanor to the total bail. Felony Bail Schedule: The presumptive bail for any felony charge not listed in the Felony Bail Schedule is $10,000; however, the bail may be enhanced in the same manner as if the felony charge were listed in the Felony Bail Schedule.
