RESOLUTION NO. 6453
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL CREATING A LIST OF CONFIDENTIAL
POSITIONS WITHIN THE CLASSIFIED SERVICE
WHEREAS, certain employees of the City of San Rafael
who are represented by the Marin Association of Public Employees
(MAPE) hold positions in the classified service which require
involvement with employer-employee relations; and
WHEREAS, by reason of holding such positions said
employees are privy to decisions of City management affecting
employer-employee relations; and
WHEREAS, the City of San Rafael and the Marin Associ-
ation of Public Employees have met and conferred with regard to
this issue in accordance with the provisions of the Meyers-Milias-
Brown Act and are in agreement with what follows:
NOW, THERFORE, BE IT RESOLVED by the City Council of
the City of San Rafael as follows:
Section 1. From and after the date of adoption of
this Resolution, the City of San Rafael and the Marin Associ-
ation of Public employees agree that the classified positions
listed on Exhibit "A" consisting of one page shall be designated
CONFIDENTIAL;
Section 2. Employees who hold these positions are
entitled to all rights, wages and fringe benefits which accrue to
them under the provisions of the contract between the City of
San Rafael and Miscellaneous employees, with one exception, to
wit: they are prohibited from direct participation in the
collective bargaining process at the bargaining table and may
not hold office in the organization which legally represents
Miscellaneous employees.

I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City on MONDAY , the 15th day of NOVEMBER 1982, by the
following vote, to wit:

CONFIDENTIAL EMPLOYEES
Section 1. Definition. Effective November 15, 1982
the following positions are hereby designated CONFIDENTIAL and
employees holding these positions in the classified service are
prohibited from holding office in the employee association which
represents Miscellaneous employees. Further, said employees may
not participate as members of the bargaining team during the
collective bargaining process.
