RESOLUTION OF THE SAN RAFAEL CITY COUNCIL CERTIFYING THE
PEACOCK GAP ENVIRONMENTAL IMPACT REPORT AND ITS DETERMINA-
TION OF SIGNIFICANT EFFECTS OF THE NEIGHBORHOOD PLAN
WHEREAS, the City of San Rafael prepared an initial study for Peacock Gap
Neighborhood Plan which identified several potentially significant environmental
effects of said Plan and, consequently, prepared a Draft Environmental Impact Report
for said Plan; and
WHEREAS, a Notice of Preparation was prepared and sent to all known responsible
and interested agencies pursuant to Section 15085 of the State EIR Guidelines; and
WHEREAS, a public review period was established from January 11, 1980, through
February 25, 1980, and a Notice of Completion was properly published and distributed
for the EIR as required by said Section 15085 of the State EIR Guidelines; and
WHEREAS, a duly noticed San Rafael Planning Commission public hearing on
the Draft EIR was conducted at 8:00 p.m. on April 8, 1980, and continued to May 6,
1980, at which time all interested persons were heard; and
WHEREAS, a duly noticed San Rafael City Council public hearing on the
Final EIR was conducted at 8:00 p.m. on October 20, 1980, at which time all interested
parties were heard; and
WHEREAS, the Planning Commission and City Council have read and considered
the Draft EIR, all written comments received, all verbal testimony presented, and
all related staff responses and reports; and
WHEREAS, the Peacock Gap Neighborhood Plan incorporates significant mitiga-
tion responding to the potentially significant environmental effects documented in
the EIR; and
WHEREAS, it has been determined that some traffic related mitigation
measures can only be accomplished through actions of the California Department of
Transportation or other agencies.
NOW, THEREFORE, BE IT RESOLVED the the San Rafael City Council certifies
the Peacock Gap Neighborhood Plan Final EIR (which consists of the Draft Environ-
mental Impact Report, the written comments received during the public review period,
and written responses to those comments, the minutes of the May 6, 1980, Planning
Commission hearing and related staff responses and reports, the minutes of the
October 20, 1980, City Council hearing) as complying with the requirements of the
California Environmental Quality Act, the State EIR Guidelines and the San Rafael
Environmental Assessment Procedures Manual.

BE IT FURTHER RESOLVED that the Peacock Gap Neighborhood Plan incorporates
mitigation addressing the potential significantly adverse effects of development
consistent with said Plan, and that the potentially significant environmental effects
are reduced to an acceptable level except for the cumulative traffic effects within
the Pt. San Pedro Road corridor at the Highway 101 vicinity where major potential
mitigation measures are within the responsibility and jurisdiction of the California
Department of Transportation and are not the sole responsibility of the City of San
Rafael. Policy within the adopted Plan that Service Level D not be exceeded at
Second Street and Grand Avenue, Third Street and Grand Avenue and Pt. San Pedro
Road and Union Street also constitutes mitigation for those cumulative traffic
impacts.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify
that the foregoing resolution was duly and regularly introduced and adopted at
a regular meeting of the City Council of said City held on Monday the fifteenth
day of December, 1980, by the following vote, to wit:
