HomeMy WebLinkAboutResolution No. 5507RESOLUTION NO. 5507 A RESOLUTION AUTHORIZING THE SIGNING OF A CONTRACT, LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael a contract, lease or agreement with SAN RAFAEL SCHOOL DISTRICT for use of San Rafael Hi.gh_School Swimming Pool and Locker Rooms from July 1, 1978 to August 13, 1978 - Memorandum of Understanding a copy of which is hereby attached and by this reference made a part hereof. I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the City Council of said City held on Wednesday the fifth following vote, to wit: day of July , 1978 by the AYES: COUNCILMEN: Miskimen, Mulryan, Nixon and Vice -Mayor Jensen NOES: COUNCILMEN: None ABSENT: COUNCILMEN: Mayor Bettini J E—M. LEONCINI, City Jerk 1/78 -CC _"� I 1 71T f"0v1 A, sso 7 MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding, made and entered into this 28th day of June 1978, by and between the City of San Rafael, hereinafter referred to as "City" and the San Rafael School District, hereinafter referred to as "District". 'PT7rTTA7 Q WHEREAS, City and District are mutually agreeable to a contractual agreement allowing City to use the swimming pool at San Rafael High School. WITNESSETH For and in consideration of mutual promises, covenants and con- ditions hereinafter contained, the parties hereto agree as follows: 1. City is hereby granted, by District, the exclusive right to use the San Rafael High School Swimming Pool and Locker Rooms for City recreational purposes from July 1, 1978 to August 13, 1978. 2. City agrees to reimburse District for the cost of the hourly rate, not to exceed $8.00 per hour, of the pool maintenance staff for six hours per week. If District Maintenance Staff is laid off, it is the City's responsibility to hire staff to do the maintenance. 3. City agrees to reimburse District for the cost of utilities and chemicals necessary to maintain pool operations. 4. City agrees to take full responsibility in cleaning and maintaining the male and female locker rooms. r -q Page One. 5. 6. 7. ATTEST: City agrees to accept the responsibility of opening and closing Gymnasium and Swimming Pool. City has the option of repairing any mechanical failures in the Pool operation. If the City chooses not to make these repairs, then the District reserves the right to close Pool at that time. City shall indemnify and hold District harmless from any liability for personal injury or property damage arising out of the use of District facilities by City pursuant to this Agreement. eanne M.
