HomeMy WebLinkAboutResolution No. 4870RESOLUTION NO. 4870 RESOLUTION, REPORT AND FINDING OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL THAT THE SAN RAFAEL GENERAL PLAN SATISFIES THE E.I.R. REQUIRE- MENTS FOR A LOCAL GENERAL PLAN AS SET FORTH IN SECTION 15147(c) OF THE GUIDELINES FOR THE IMPLEMENTATION OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT AND ADOPTION OF THE ATTACHED ENVIRONMENTAL IMPACT ASSESSMENT. WHEREAS, Section 65300 of the Government Code specifies that a General Plan shall be adopted by the City; WHEREAS, Section 15037 of the Guidelines for Implementation of the California Environmental Quality Act of 1970 (December 17, 1973) defines the adoption of local general plans as a project; WHEREAS, Section 21065 of the Public Resources Code defines a pro- ject as an activity directly undertaken by any public agency; WHEREAS, Section 15061 of the Guidelines for Implementation of the California Environmental Quality Act of 1970 requires environmental documents for projects that are to be undertaken by a public agency; WHEREAS, Section 15147(c) of the Guidelines for the implementation of the California Environmental Quality Act state that the requirements for an Environmental Impact Report on a local General Plan will be satisfied by the General Plan if: 1. The General Plan addresses all the points required by Article 9 of the Guidelines; 2. The General Plan document contains a special section or a cover sheet identifying where the General Plan document addresses each of the points required; WHEREAS, the San Rafael Planning Commission on September 10, 1974 at its regular meeting did find that the San Rafael::General Plan and the Environ- mental Impact Assessment thereof satisfied the requirements of Section 15147(c) of the Guidelines for the Implementation of the California Environmental Quality Act of 1970 and by Resolution No. 74-4 did favorably recommend same to the City Council; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael does hereby determine that "The San Rafael General Plan" addresses all points required to be in an Environmental Impact Report by Article 9 State Guidelines; and, BE IT FURTHER RESOLVED that the City Council approves and accepts the "Environmental Impact Assessment" attached hereto and made a part hereof as constituting the section of the General Plan identifying where the General Plan documents addresses each of the parts required, in accordance with Section 15147(c) of the Guidelines for the Implementation of the California Environmental Quality Act of 1970.
