HomeMy WebLinkAboutResolution No. 4748RESOLUTION NO. 4748 A RESOLUTION AUTHORIZING THE SIGNING OF A LEASE OP AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael a lease or agreement with (San Rafael Redevelopment Agency - Repayment Agreement.- Fifth and Lootens Parking Lot) A copy of which is hereby attached and by this reference made a part hereof. I, MARION A. GRADY, City Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a re-qular meeting of the City Council of said City held on Monday the 17th day of June 19 74 by the following vote, to wit: AYES: COUNCILMEN: Jensen, Miskimen.,. GRADY City Clerk SAN RAFAEL REDEVELOPMENT PROJECT CONTRACT THIS AGREEMENT entered into this 17th day of June , 1974 by and between the San Rafael Redevelopment Agency (hereinafter called "Agency") and the City of San Rafael (hereinafter called "City"). RECITALS: 1. In furtherance of Resolution No. 74-14 dated lltoum�,. ,� �' , 1974, passed by the Agency and 'Resolution No. /,'�,.`. , dated June 17 , 1974, passed by the City Council of San Rafael, this Contract is entered into between the City and the Agency. 2. By San Rafael City Council Ordinance No.. 1079, the Agency is vested with the responsibility for carrying out the Central San Rafael Redevelopment Project (hereinafter called "Project"). 3. To assure the successful redevelopment of the Project and at the special instance and request of the Agency, the City has made and shall make certain capital improvements within the Project area as part of the redevelopment program. 4. At the special instance and request of the Agency one of the improvements the City will undertake in the Project Area is the constructon of a Parking Lot at Fifth and Lootens Streets. By the above resolutions, the City and Agency both recognize the desirability of a municipal parking lot in the Project in order to alleviate parking problems. 5. At present the land is owned by the Agency. The Agency will deed title to the land to the City when this Contract is signed. 6. The City and the Agency have an understanding that the Agency will repay an amount not to exceed Sixteen Thousand Dollars ($16,000) to the City for the construction of said Parking Lot. It is further understood by both the City and the Agency that the cost of the construction of the Parking Lot might exceed $16,000, but that the Agency shall only be responsible for costs up to said $16,000. NOW THEREFORE, the City and the Agency agree: 1. The Agency agrees to deed to the City the title to the real property at Fifth and Lootens Streets, (said real property is more particularly described in Exhibit "A" attached to this agreement and incorporated herein by reference), and to reimburse the City for costs incurred by the City up to the amount of $16,000 for construction of a Parking Lot upon said land. Said reimbursement shall be derived solely from tax increment funds generated from the central San Rafael Redevelopment Project. Said Parking Lot is built as one of the capital improvements made within the Project Area as part of the redevelopment program. 2... The City agrees to accept the title to said land, to build a Parking Lot in conformance with said resolutions, and understands that the costs of construction of said Parking Lot might exceed Sixteen Thousand Dollars ($16,000); however all -2- costs exceeding $16,000.00 shall be borne by the City which shall expect no repayment for said excess costs from the Agency. IN WITNESS WHEREOF the Mayor of the City by Resolution No. thereunto duly authorized has caused the name of said City of San Rafael to be affixed hereto and the Executive Director of the San Rafael Redevelopment Agency by Resolution No. a of said Agency thereunto duly authorized has caused the sum of said San Rafael Redevelopment Agency to be affixed hereto on the date and year first hereinabove written.
