THE METROPOLITAN TRANSPORTATION COMMISSION FOR THE
CONSTRUCTION OF THE PUERTO SUELLO HILL TO SAN RAFAEL TRANSIT
CENTER CONNECTOR PROJECT
RECOMMENDATION:
Adopt resolution.
BACKGROUND:
The Puerto Suello Multi -Use Path along the west side of US101, north of Mission Avenue, is currently
under construction. When completed, this path will end at the northwest corner of the intersection of
Hetherton Street and Mission Avenue, three blocks from the San Rafael Transit Center. The only
pedestrian facility along Hetherton Street between Mission Avenue and the Transit Center is a 5' wide
sidewalk. There are no bicycle facilities along Hetherton Street. The Puerto Suello to Transit Center
Connector Project will connect the terminus of the Puerto Suello Multi -Use Path and the Transit Center
with an 18.5' wide multi -use path (8.5' for pedestrians, 10' for bicycles).
The Non -Motorized Transportation Pilot Program (NTPP) provided $600,000 for the design, outreach,
environmental documents and construction of the project. However, this amount of funding will not fund
the entirety of the construction of the project, and therefore additional funding is required in order to
provide a complete, operable and useable Multi -Use bicycle and pedestrian facility.
The Transportation 2035 Plan for the San Francisco Bay Area, dated April 2009 and published by the
Metropolitan Transportation Commission (MTC), is based on three principles of sustainability including
equity, environment and economy. The Puerto Suello to Transit Center Connector Project is consistent
with the Plan.

On April 3, 2007, the City of San Rafael applied for a Safe Routes to Transit (SR2T) grant from the MTC
for Regional Measure 2 (RM2) funds in the amount of $600,000. This additional funding is to
supplement the NTPP funds for construction of the project. On July 30, 2007, the City was notified that
the $600,000 grant was authorized for the Puerto Suello Hill Path to Transit Center Connector Project.
Allocation of the project funds is required in order to receive reimbursements from MTC for the grant.
ANALYSIS:
Submittal of the Initial Project Report and allocation request will start the project for reimbursement
eligibility in an amount up to $600,000 for the construction of the Puerto Suello to Transit Center
Connector Project. If this document is not submitted, eligibility for the grant will be lost.
FISCAL IMPACT:
The SR2T grant provides funds on a reimbursement basis which requires the City of San Rafael to
provide payment up front for reimbursement later. No city match is required.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AUTHORIZING THE PUBLIC WORKS DIRECTOR TO SUBMIT AN INITIAL
PROJECT REPORT AND TO REQUEST ALLOCATION OF $600,000 FROM THE
METROPOLITAN TRANSPORTATION COMMISSION FOR THE CONSTRUCTION
OF THE PUERTO SUELLO HILL TO SAN RAFAEL TRANSIT CENTER
CONNECTOR PROJECT
Whereas, SB 916 (Chapter 715, Statutes 2004), commonly referred as Regional
Measure 2, identified projects eligible to receive funding under the Regional Traffic Relief Plan;
and
Whereas, the Metropolitan Transportation Commission (MTC) is responsible for funding
projects eligible for Regional Measure 2 funds, pursuant to Streets and Highways Code Section
30914(c) and (d); and
Whereas, MTC has established a process whereby eligible transportation project
sponsors may submit allocation requests for Regional Measure 2 funding; and
Whereas, allocations to MTC must be submitted consistent with procedures and
conditions as outlined in Regional Measure 2 Policy and Procedures; and
Whereas, the Puerto Suello Hill to San Rafael Transit Center Connector Project is
eligible for consideration in the Regional Traffic Relief Plan of Regional Measure 2, as identified
in California Streets and Highways Code Section 30914(c) or (d); and
Whereas, the City of San Rafael has received $600,000 in funding from the federal
government under the Non -Motorized Transportation Pilot Program (NTPP) for the design of the
Project; and
Whereas, the City of San Rafael will obtain an encroachment permit from the California
Department of Transportation, who owns the right-of-way for the Project, to permit construction
by the City of San Rafael of the Project improvements if funding for such improvements is
provided by the MTC, and
Whereas, the City of San Rafael's Regional Measure 2 allocation request, contained in
the Initial Project Report on file with the Public Works Department, lists the Project, purpose,
schedule, budget, expenditure and cash flow plan for which the City of San Rafael is requesting
that MTC allocate Regional Measure 2 funds; and
Whereas, the City Council certifies:
1. That City staff have determined that the City's proposed Regional Measure 2 Project
is consistent with the Regional Transportation Plan (RTP); and
2. That the City's proposed Regional Measure 2 Project, upon receipt of the requested
allocation from MTC, will be fully funded and will result upon completion in an
operable and useable Multi -Use bicycle and pedestrian pathway; and
3. That City staff have reviewed the Project needs and has determined that the City has
adequate staffing resources to complete the Project within the schedule set forth in the
aforementioned Initial Project Report; and
4. That the City of San Rafael is an eligible sponsor of projects in the Regional Measure
2 Regional Traffic Relief Plan, Capital Program, in accordance with California
Streets and Highways Code 30914(c); and
5. That the City of San Rafael is authorized to submit an application for Regional
Measure 2 funds for the Puerto Suello Hill to San Rafael Transit Center Connector
Project in accordance with California Streets and Highways Code 30914(c); and
6. That prior to the City of San Rafael's acceptance of an allocation from MTC for
construction of the Project, the City will confirm to MTC that the required
environmental clearance documentation for the Project has been approved in
accordance with the requirements of the California Environmental Quality Act
(Public Resources Code Section 21000 et seq.), the California Environmental Quality
Act Guidelines (14 California Code of Regulations Section 15000 et sem.), and to the
extent applicable the National Environmental Policy Act (NEPA), 42 USC Section 4-
1 et. seq., and the applicable regulations thereunder;
7. That the funding period for design, right-of-way and/or construction phases will have
taken into consideration the time necessary to obtain environmental clearance and
permitting approval for the project, and
8. That there is no known legal impediment to the City of San Rafael making allocation
requests for Regional Measure 2 funds; and
9. That there is no pending or threatened litigation which might in any way adversely
affect the proposed project, or the ability of the City of San Rafael to deliver such
project; and
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SAN RAFAEL:
1. That the City of San Rafael, and its agents shall comply with the provisions of the
Metropolitan Transportation Commission's Regional Measure 2 Policy Guidance
(MTC Resolution No. 3636) in processing the allocation request and in construction
of the Project with funds provided; and
2. That the City Council approves the Initial Project Report; and
3. That the City Council approves the cash flow plan included in the Initial Project
Report, and
4. That the City of San Rafael shall indemnify and hold harmless MTC, its
Commissioners, representatives, agents, and employees from and against all claims,
injury, suits, demands, liability, losses, damages, and expenses, whether direct or
indirect (including any and all costs and expenses in connection therewith), incurred
by reason of any act or failure to act of the City of San Rafael, its officers, employees
or agents, or subcontractors or any of them in connection with its performance of
services under this allocation of RM2 funds. In addition to any other remedy
authorized by law, so much of the funding due under this allocation of RM2 funds as
shall reasonably be considered necessary by MTC may be retained until disposition
has been made of any claim for damages; and
5. That the Public Works Director, or his designee, is authorized to execute and submit
an allocation request to MTC for Regional Measure 2 funds in the amount of
$600,000 for the Puerto Suello Hill to Transit Center Connector Project, as described
in the aforementioned Initial Project Report; and
6. That the Public Works Director, or his designee, is hereby delegated the authority to
make non -substantive or minor amendments to the Initial Project Report that are
deemed necessary; and
7. That if the MTC funds construction of the Project, the Public Works Director is
directed to post, during construction of the Project, one sign on each end of the
Project, visible to the public, stating that the Project is funded with Regional Measure
2 Toll Revenues; and
8. That the Public Works Director is directed to transmit a copy of this resolution to
MTC in conjunction with the filing of the City of San Rafael application referenced
herein.

L OVERALL PROJECT INFORMATION

B. Project Purpose
The Puerto Suello Multi -Use Path along the west side of US101 is currently under construction. When
completed, this path will end at on the northwest corner of the intersection of Hetherton Street and Mission
Avenue, three blocks from the San Rafael Transit Center. The only pedestrian facilities along Hetherton
Street between Mission Avenue and the transit Center is a 5' wide sidewalk. There are no bicycle facilities
along Hetherton Street. This project will connect the terminus of the Puerto Suello Mutli-Use Path with the
Transit Center with an 18.5' wide multi -use path (8.5' for pedestrians, 1.0' for bicycles).
Regional Measure 2 — INITIAL PROJECT REPORT
C. Project Description (please provide details)

The purpose of the Puerto Suello Path Transit Center Connector project is to construct a bicycle and
pedestrian multi -use path that will connect the Puerto Suello multi -use path currently under construction to
the existing San Rafael Transit Center.
The project will install high visibility crosswalks, bicycle and pedestrian advance warning signs, modification
to existing traffic signals to add right turn phase for southbound traffic and several intersections along
Hetherton Street, upgrade the existing traffic signal equipment to current standards, install curb extensions,
widen the existing sidewalk, upgrade curb ramps to meet current ADA requirements, enhance the pedestrian
lighting, and install bicycle left turn protection along Fourth Street.
This project is also funded, in part, by the federal Non -Motorized Transportation Pilot Program (NTPP)
Grant. The NTPP grant is to be used for design, environmental clearance and a portion of the construction
costs. The SR2T grant will be used solely for construction. The project is currently under environmental
review by Caltrans and review of the final design is underway.
D. Impediments to Project Completion
Because a portion of the funding is from the NTPP grant, the project must comply with all FHWA and
Caltrans Local Assistance requirements. Also, a Caltrans encroachment permit is required for this project as
the majority of the work to be done is on Caltrans Right -of -Way (the City has a maintenance agreement with
Caltrans for Hetherton Street, the area is within Caltrans right-of-way but maintained by the City of San
Rafael).
E. Operability
The City of San Rafael will maintain and operate the improvements once installed. The City of San Rafael
Department of Public Works' street maintenance division and parks maintenance division maintains sidewalk,
pathways, roadways, Curb Ramps, singing and striping, and landscaping and can maintain all improvements
associated with this project except for electrical improvements. For electrical improvements; the City
contracts with an electrical contractor who maintains the City's street lighting and traffic signal system. The
electrical contractor provides services for both preventative and repair maintenance.
II. PROJECT PRASE DESCRIPTION and STATUS
F. Environmental —

The City of San Rafael is working with Caltrans to obtain NEPA and CEQA environmental approval. The
project qualifies for a categorical exemption from CEQA/NEPA which was sent to Caltrans for approval on
July 28, 2009. This project, however, requires a Cultural resources study to be completed for Caltrans
approval. The City is currently working with the design engineer to obtain a certified cultural resources firm
to provide the necessary review and documentation for CEQA/NEPA approval. We anticipate receiving
environmental clearance for the project, from Caltrans, in March 2010.
Environmental documentation and clearance is not RM -2 funded.

Reitional Measure 2 — INITIAL PROJECT REPORT
G. Design —
The 95% design plans were recently received from the design consultant. Once environmental clearance is
obtained from Caltrans, the City will start the process and proceed with the requirements necessary to
advertise and award the contract.
Design of the project is not RM -2 funded.
H. Right -of -Way Activities / Acquisition —
A Caltrans encroachment permit is required for this project as the majority of the work to be done is on
Caltrans Right -of -Way. No acquisition of right-of-way is required.
Right-of-way activities, including obtaining the Caltrans encroachment permit, is not RM -2 funded. The
process to obtain the encroachment permit will begin as soon as possible after environmental clearance has
been obtained.

No special circumstances are required for project construction. Construction will commence once
environmental clearance and the encroachment permit has been obtained.

O. Impediments to Allocation Implementation
Once the environmental documents are completed and approved by Caltrans, the project will be advertised,
the contract awarded and construction will begin. In general, the community is in support of this project as it
will greatly enhance the city of San Rafael's bicycle and pedestrian network as well as improve the safety for
pedestrian and bicycle crossings at the existing traffic signals located along the project corridor. The City of
San Rafael will be administering the construction contract. The City staff has extensive experience
administering construction contracts most of which were grant funded. The City must, however, obtain an
encroachment permit from Caltrans and work with the agency during construction. Delivery of the
environmental documentation and therefore start of construction depends largely on the review and approval
time of Caltrans' required forms and permits.
