HomeMy WebLinkAboutCM Munson Park Fence InstallationAgenda Item No: 14 Meeting Date: April 19, 2010 SAN RAFAEL CITY COUNCIL AGENDA REPORT Department: CITY MANAGER / Prepared by: Ken Nordhoff, City Manager Approval: „ SUBJECT: RESPONSE TO REQUEST TO INSTALL FENCE ALONG MUNSON PARK RECOMMENDATION: Continue to uphold the Park and Recreation Commission decision of May 21, 2009 BACKGROUND: At the March 1, 2010 meeting, San Rafael resident Ben Ross submitted a packet to the City Council. This packet included approximately 165 signatures, maps and other documentation related to a proposed fence along the Freitas Parkway segment of Munson Park. He explained that in May, 2009 the Park & Recreation Commission suggested that the neighbors provide half the funds necessary to plant hedges; however, it had not been possible to raise these funds. Mr. Ross requested that a green 4 -foot chain link fence be erected adjacent to the high-speed traffic area of Freitas Parkway, identified on an aerial photograph. He noted the Park & Recreation Commission favored a hedge over a fence; however, those in the neighborhood considered the hedge inadequate as balls could roll through onto the adjacent street. Mayor Boro noted the Park & Recreation Commission considered this issue and provided their response and the City Council was now being requested to pursue another alternative. He stated that Mr. Nordhoff would investigate and make a recommendation to the City Council at a future meeting. ANALYSIS: The Parks and Recreation Commission was established by City Ordinance. They have limited powers and duties, as defined in our Municipal Code: To assist in the preparation and adoption of a review annually and revise as necessary a long-range plan for parks including neighborhood parks, community -wide parks, special use facilities and open space lands; To focus public attention upon the need for adequate parks and healthful and creative year-round supervised recreation for all age groups; To assist in promoting the public recreation programs; FOR CITY CLERK ONLY File No.: Council Meeting: Disposition: SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 2 To solicit to the fullest extent possible the cooperation of school authorities and other public and private agencies interested therein; To assist the parks and recreation director in establishing general policies and procedures in respect to park usage; To review, comment and make recommendations regarding the annual operating budget of the department, To receive periodic reports from the department head concerning the general operations and functions of the department; To perform such other duties as may be prescribed by the council Mr. Ross' application was considered by the Commission last year using the scope of duties and regular practice of hearing similar small scale requests from community members. The request by Mr. Ross has been investigated further, at your direction. Staff has provided the following documents as part of this staff report in order to support our work and recommendation. 1. Attachment "A" — Documents submitted by Mr. Ross at the March 1, 2010 City Council meeting. 2. Attachment "B" — Memo from Community Services Director Carlene McCart 3. Director McCart's memorandum provides additional insight and explanation into the Parks and Recreation Commission decision of May 21, 2009. Let me offer some additional relevant information that will support our recommendations regarding this matter. The City has a number of parks, large and small, which can be generally divided into two categories. The first are considered active, and illustrated on Attachment "D". These parks have been planned and developed for active use, including rentals, sport activities and the like. Amenities are constructed to support these types of uses, including restrooms, parking, fields, etc. The marketing of these facilities, and recreation programs we sponsor, takes full advantage of using these amenities to serve general community recreation activities as well as youth sports programs, adult leagues, annual HOA picnics and many other functions. The second groupings of parks are deemed inactive/passive (or what I like to label 'parkettes'). These are scattered across San Rafael. These locations are typically small in nature, and are not designed for active recreation such as ball games, sports, or children's play. Community members use these resources for dog walking, sitting, enjoyment of the outdoors and other non -structured activities. Munson Park falls into this second category. The City's practice and Commission's long-standing directive have supported not creating improvements at these locations (such as fencing, structures, etc.) that would encourage lively use. Simply stated, these are not the types of facilities that are designed to be safe and appropriate for pick up softball, volleyball, or other picnic type games. Typically, park improvements are vetted by the Commission, based upon community surveying of priorities, existing master plans, and all considered within the City's known or future SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 3 resources. We have customarily been grossly underfunded with discretionally dollars to upgrade, renovate and maintain the major features of all City parks. Park master plans, grants and capital projects all come before the City Council for your review and approval. Smaller items such as this request stay at the Commission level. Raising small amounts of money for park needs is not unique to this request. There currently exist some leaders from the Terra Linda HOA who are in the process of raising funds to complete a phase two series of improvements at Freitas Park. Residents in Glenwood have participated in raising money to assist with the redesign and major renovations needed at Victor Jones Park, as have those in Sun Valley and Bret Harte The Commission made a generous offer of sharing in the hedge improvements on a 50/50 basis (neighbors and City with equal contributions). Partnerships are a prudent and necessary course of business if park improvements are going to happen in the future. This of course does not preclude grants or outside funding from meeting these needs. Our current and future budgets will not have any measurable level of resources to meet these important community needs. One further argument for upholding the Commission decision is this fencing choice could begin to set a precedent for passive park improvements. By way of example, Highland Park is located at the southwest corner of the Freitas Parkway/Las Pavadas intersection. It is similar in size and use (inactive) to Munson Park. Highland Park contains some green space (lawn), a bench and pathways for walking. It contains no formal screening or fencing along either street. Installation of fencing at this location would change the nature and use of the small park. I believe the Commission understands the value of maintaining a balance of active/passive parks in our inventory when they deliberated and denied the request. The subsequent compromise offered a hedge treatment as an acceptable solution to the concerns brought forward by Mr. Ross. The staff and I have concluded that the decision of the Commission should stand. We have not concluded a fence is needed, nor should it be paid from City funds (given the budget picture). The Commission conducted a hearing, took testimony from Mr. Ross and two neighbors, and reached a thoughtful conclusion. Having reviewed all of the information, it is my recommendation that the Commission's decision of last May remain in place, and no additional action be taken by the City Council to install a fence at Munson Park. FISCAL IMPACT: The cost of sharing in the conclusion established by the Parks and Recreation Commission last year was about $5,500, of which half would be born by the City. Should the neighbors raise the required 50% matching sum, the Commission decision of last May remains valid today. Should this occur, the City would allocate existing appropriations in the Parkland Dedication Fund to construct the hedge as defined in the Commission's deliberation and decision. OPTIONS: The City Council may choose to: 1. Accept the staff recommendation as presented. 2. Modify the staff recommendation, and act as you deem appropriate. The request was not approved, based on the costs to the City and the priority for repairs and improvements across the park system. The Commission did advise, however, that if the neighborhood could contribute to the costs of the project, they would recommend installation. The original request was for fencing running parallel to Freitas Parkway, designed to protect children and balls from entering the street from the park. In discussion the Commission and staff agreed that a more esthetic approach would be to install a landscaped hedge along the effected edges. The hedge would be low enough to provide sight line into the park from the street for security, and a consistent barrier for children and balls. A hedge would require the purchase of landscape materials, a partial redesign of the irrigation system, and installation. Staff advises that the hedge would not be as lengthy as the proposed fence to provide the barrier desired for the protection of children and people utilizing the grass area of Munsen Park. There is no need or desire to fence or hedge the unlandscaped area of the park. Given that, the cost for the longer fence is approximately equal to the hedge installation. Marin Fence provided you with a quote for fence purchase and installation, $5,500. Staff will work with you to install the hedge if the neighborhood will contribute $2;250 toward the project, 50% of the cost. If the project goes forward, the City will purchase the landscape materials, prepare the planting area, make adjustments to the irrigation and install the plants. He made the same request of the Park and Recreation Commission in May 2009, after staff disagreed over the need for fencing. The Commission denied his request on the basis of budget concerns and priority for other more urgent needs. Informally, they advised that if the neighborhood provided the funds to install a landscape hedge to perform as a barrier in portions of the Park, the Commission would reconsider. Mr. Ross reported to the Council that the effort to raise money for the project from the neighborhood was unsuccessful. He requests the City install a fence barrier. I am responding to Council directive for additional information and recommendation. Attached are the Minutes for the Park and Recreation Commission Meeting, May 21, 2009 for your reference. At that meeting Mr. Ross proposed a 270 ft fence around the perimeter of Munson Park to protect children from traffic on Freitas Parkway, and game balls from rolling into the street. Mr. Ross provided the Commission with a petition signed by 165 neighbors in support of the idea. Two neighbors of the park responded to the notice of the meeting and testified that Mr. Ross currently allows his three dogs to be off leash in the park and seeks a fence to contain them, rather than protect park users. Staff recommendation to deny the request was based on the following 1. Munson Park is a "pocket park' less than a half acre, designed for passive use such as walking or sitting. These configurations are not generally contained by fencing but serve as a stopping location and landscape feature along the Freitas Park walkway, which extends from Las Gallinas Avenue to Los Gamos Avenue. 2. The Park has no active facilities, such as play equipment, ball courts or fields. These activities should not be encouraged due to its size and location next homes and to the walkway along Freitas Parkway. 3. Three -acre Oleander Park is one quarter mile from Munson Park. Active recreational use should be directed there where space and conditions create a safe environment for play and sports. 0 Page 1 Attachment "B" 4. This proposal is not a priority for the Parks Division in light of the $1 million of current inventory of park repair and renovation projects. The Commission acted on the basis of the testimony received from the community and staffs recommendation. I contend the concerns expressed at the meeting remain valid. Installation of a fence will alter the use pattern of the park. There is an active park within walking distance. With a mounting list of park priorities, this proposal is not critical at this time. The neighborhood does not hold this issue as a priority they wish to support with funds. No other similar requests have been received. Request for Fencing at Munson Park Director McCart introduced Mr. Ben Ross, a resident of San Rafael who is petitioning the commission for consideration in fencing a portion of Munson Park. Prior to the meeting, Mr.R oss received a letter outlining staff recommendations. Mr. Ross stated he knows the request is a long shot due to current economic climate. He sighted danger to children as the primary reason for his request, since Munson Park is located along a high speed street. He stressed children playing ball sports are at danger if they chase balls into the street. Mr. Ross collected approximately 165 signatures from neighbors residing on streets around the park. Approx. 90% of the residents surveyed agree support a fence. He provided a photo of the road and where he suggests a fence should be constructed. He is proposes 270 ft. of fence. He noted that the quote for fencing stated in the staff report was high; and that he has a quote from Marin Fence for approximately $5500.00. Two additional guests spoke opposing the fence and said that the issue was about Mr. Ross' dogs rather than about children safety and since there has never been an injury the request is unwarranted. John Tune stated that the estimate from Marin Fence was reasonable and thath a would look at whether a fence can fit in the proposed space. He also mentioned that a hedge might look better and be just as effective as a barrier to stop balls. McCart stated staff does not recommend support at this time. Commission Chair Mihan stated budget as the issue and why we can't support at this time. If the neighborhood was willing to financially support the installation of a hedge, the matter could be revisited. M/s Quintero/Lubamersky to deny the request and to support staff recommendation.
