HomeMy WebLinkAboutCM Joint Services Authority Appointments & JPAOrry OF n� Agenda Item No: Meeting Date: March 15, 2010 SAN RAFAEL CITY COUNCIL AGENDA REPORT Department: Management Services Prepared by: Jim Schutz, Assistant City Manager �S City Manager Approval: SUBJECT: RESOLUTIONS AUTHORIZING THE CITY MANAGER TO ENTER INTO TWO JOINT POWERS AGREEMENTS AND FURTHER AUTHORIZING THE CITY MANAGER TO SERVE ON THE BOARD OF DIRECTORS OF BOTH JOINT SERVICES AUTHORITIES RECOMMENDATION: Adopt the Resolutions BACKGROUND: The City of San Rafael currently has working partnerships with joint powers authorities (JPAs) with various other public agencies in the County in order to provide services that are more efficiently delivered by pooling our resources and working together. Examples of such efforts include the Animal Control JPA, the General Services JPA, and the Hazardous and Solid Waste JPA. Staff is recommending that the City Council authorize involvement in two additional Joint Powers Authorities: Local Government Services (LGS) and Regional Government Services (RGS). These JPAs establish alternative structures for hiring governmental employees that facilitate the sharing of employees across organizations, and provides a cost effective platform for sharing administrative services. RGS and LGS were formed in March 2001 by the City of San Carlos and the Association of Bay Area Governments to provide administrative, support, and staffing services to other California public agencies. They were formed to meet two growing pressures on local governments: 1) increasing demand for services without corresponding funding, and 2) increasing difficulty recruiting and retaining highly qualified employees. RGS and LGS have provided consulting and staffing services to cities, special districts, counties, other JPAs, and special consortiums of government agencies throughout California. LGS is a PERS member agency and RGS has a 401(a) defined contribution plan. Neither JPA participates in Social Security for retirement purposes. The JPAs provide services to the cities of Larkspur, Belvedere, Sausalito, Yountville; the Transportation Authority of Marin; MERA; MTA; Transbay Joint Powers Authority; Marin Transit District; South Bayside Waste Management Authority; Ventura County Transportation Commission; and other entities. The City of San Rafael is currently under contract with RGS to provide the services for two positions in Management Services and one in the Police Department. The structures allow services to be provided to public and non-profit agencies on a contractual, fee for service basis, fully recovering the cost to provide the services. The benefit to member agencies is in maximizing the efficiency of service delivery through pooling together the limited resources of multiple agencies, thus avoiding duplication of costs while maintaining, enhancing and/or adding services. ANALYSIS: The JPA Board has been looking to add strategic, stable local government organizations with high quality policy makers and operations staff to expand its presence and services in the Bay Area. The current members of RGS and LGS are the City of Larkspur and the Association of Bay Area Governments (ABAG). Each agency's chief executive officer has a seat on the Board of Directors for RGS and on the Board of Directors for LGS. The City of San Rafael has been invited to join the JPAs and to serve on the Board of Directors for the JPAs to assist with leadership and direction. FISCAL IMPACT: No fiscal impact is anticipated as a result of adoption of these resolutions. Over time, the largest financial impact to the City of San Rafael and to the other clients of the JPAs will be in costs avoided through sharing expenses with other agencies. As services and clients are added to the JPAs, economies of scale and sharing of costs will result in on- going savings. In addition, RGS and LGS offered training grants totaling $15,000 to its member agencies last year and they anticipate continuing to offer grant funds for training. OPTIONS: 1. RESOLUTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL JOINING THE JOINT POWERS AGREEMENT WHICH ESTABLISHED THE REGIONAL GOVERNMENT SERVICES AUTHORITY WHEREAS, the City of San Rafael is a member of several Joint Powers Authorities (JPAs) in order to take advantage of economies of scale and improved efficiencies; and WHEREAS, JPAs can and do provide a myriad of services for public agencies, including solid and hazardous waste disposal, recycling, wastewater treatment, workers' compensation and liability self insurance and other direct and support services; and WHEREAS, recruitment and retention success would be enhanced by providing an effective means for sharing talented employees across organizations and providing a defined contribution retirement plan to add flexibility for both employees and the City. WHEREAS, the Regional Government Services Authority created by a Joint Powers Agreement, dated March 1, 2001, is an entity which provides such employment services; and WHEREAS, the City Council finds it would be beneficial to the City to be a member of the Regional Government Services Authority; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: The City Manager is authorized to execute on behalf of the City, an agreement to join the Regional Government Services Authority to provide services for public agencies and other local government entities; and IT IS FURTHER RESOLVED that the City Council of the City of San Rafael authorizes the City Manager to serve on the Board of Directors of the Regional Government Services Authority as needed to assist with the governance of the agency. I, Esther C. Beirne, Clerk of the City of San Rafael, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted at a regular meeting of the City Council of the City of San Rafael, held on Monday, the 15th day of March, 2010, by the following vote, to wit: AYES: Councilmembers: NOES: Councilmembers: ABSENT: Councilmembers: Esther C.
