RECOMMENDATION: Staff recommends the City Council adopt the resolution approving the
purchase of two marked police motorcycles from Marin BMW Motorcycles for $48,681.46.
BACKGROUND: The City of San Rafael's Fleet Advisory Board supports the need to replace
two marked Police Department motorcycles. Both motorcycles are at their recommended
replacement time frame, in accordance with the standards established by the Fleet Advisory
Board. The motorcycles to be replaced are marked units 201, 202.
The City, as a participant in the California Multiple Award Schedule Contracts program, also
known as State Bids, is exempt from competitive bidding requirements for these vehicles under
San Rafael Municipal Code Section 2.55.260.
FISCAL IMPACT: There are sufficient funds in the Vehicle Replacement Fund to purchase
these vehicles.
ACTION REQUIRED: Adopt resolution approving the purchase of two marked motorcycles
from Marin BMW Motorcycles in the amount of $48,681.46.

RESOLUTION
A RESOLUTION APPROVING THE PURCHASE OF TWO POLICE MOTORCYCLES
FOR $48,681.46 FROM MARIN BMW MOTORCYCLES, AS PART OF CALIFORNIA
MULTIPLE AWARD SCHEDULE CONTRACTS PROGRAM WHICH IS EXEMPT
FROM BID PROCESS
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES AS
FOLLOWS:
WHEREAS, two marked Police Department motorcycles are at their replacement
time frames; and
WHEREAS, there are adequate funds in the City's Vehicle Replacement Fund to
purchase replacement vehicles; and
WHEREAS, the City, as a participant in the California Multiple Award Schedule
Contracts program, also known as State Bids, is exempt from competitive bidding
requirements for this vehicle under San Rafael Municipal Code Section 2.55.260; and
WHEREAS, Marin BMW Motorcycles is currently an approved BMW dealer for
the California Multiple Award Schedule Contracts program.
NOW, THEREFORE, BE IT RESOLVED that the bid from Marin BMW
Motorcycles for two marked BMW motorcycles at the specified unit prices totaling
$48,681.46 is hereby accepted and that a purchase order for said vehicles in that
amount is hereby approved.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Chief of Police is
hereby authorized to take any and all such actions and make changes as may be
necessary to accomplish the purpose of this Resolution.
I, Esther Beirne, Clerk of the City of San Rafael, hereby certify that the foregoing
resolution was duly and regularly introduced and adopted at a regular meeting of the
Council of said City on the 20th day of July, 2009, by the following vote, to wit:
