HomeMy WebLinkAboutPW Dedication of Property01� OF 1� &4t, Agenda Item No: 16 Meeting Date: April 20, 2009 SAN RAFAEL CITY COUNCIL AGENDA REPORT Department: Public�OL Prepared by: City Manager Approval: ector of fWlic Works (LM) File No - 19 0166 SUBJECT: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL APPROVING THE DEDICATION OF 2,480 SQUARE FEET OF CITY OWNED PROPERTY FROM ASSESSOR'S PARCEL NUMBER 014-101-07 TO THE PUBLIC RIGHT-OF-WAY, AND AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE AND RECORD ANY DOCUMENTS THAT MAY BE REQUIRED TO EFFECTUATE SUCH DEDICATION. RECOMMENDATION: Staff recommends that the City Council adopt the resolution authorizing the dedication of 2,480 square feet of City owned property from Assessor's Parcel Number (APN) 014-101-07 to the public right-of-way. BACKGROUND: As part of the routine traffic monitoring, intersection analysis, signal inspection and responding to requests from citizens, staff has analyzed the intersection of Third Street and Union Street for traffic signal installation and modification. On June 16, 2003 and August 6, 2007 the City Council adopted Resolution numbers 11340 and 12328, respectively, authorizing the Director of Public Works to enter into agreements with Kimley-Horn & Associates to design intersection improvements. Intersection improvement alternatives were developed and presented to stake holders such the Montecito Area Residents Association (MARA), Whole Foods, and Montecito Shopping Center representatives, as well as many public hearings pertaining to General Plan 2020, and private developments such as Village at Lock Lomond Marina over a period of four years and a preferred alternative was selected. Kimley-Horn and Associates, Inc. has completed the design and development of the project plans and specifications. The plans have been signed and approved by the Public Works City Engineer. On March 16, 2009 the City Council adopted the plans and specifications and on March 20th, 2009 the project was advertised in accordance with San Rafael's Municipal code and policies and bids were opened on April 15th, 2009. As part of the project, a westbound right turn lane from Third Street onto Union Street and widening of the sidewalk along Third Street in front of the fire station at 210 Third Street (City owned property APN 014- 101-07) will be constructed. A portion of the project on Third Street is located outside of the public right of way and on the City owned property at 210 Third Street (APN 014-101-07). A plat map of the 2,480 square feet of proposed property including line bearings and lengths proposed to be dedicated is attached. The dedication of the land enclosed by the existing city right of way line (1-1) and lines L2, L3, FOR CITY CLERK ONLY File No.: Council Meeting: Disposition: SAN RAFAEL CITY COUNCIL AGENDA REPORT / Paee: 2 L4 and L5, as described and depicted on attached Exhibit'A', will encompass the entirety of the proposed project thereby locating it within public right of way limits. FISCAL IMPACT: There is no fiscal impact associated with the dedication. ACTION REQUIRED: Adopt the resolution authorizing the dedication of 2,480 square feet of City owned property from APN 014-101-07 to public right-of-way according to the legal description and the bearings and lengths of lines 1-1, 1-2, 1-3, L4 and L5 as depicted in Exhibit'A'. ANALYSIS: As the proposed project is intended for use by the public, it is necessary to dedicate this portion of the city owned property at 210 Third Street (APN 014-101-07) to the public right of way. WHEREAS, based on routine traffic monitoring and review of citizens' request by the Traffic Coordinating Committee; it was recommended that the intersection of Third Street and Union Street be improved based on traffic engineering design and professional judgment; and WHEREAS, the design of the improvements includes, among others, installation of a westbound right turn lane at the intersection and widening of the sidewalk along Third Street; and WHEREAS, 2,480 square feet of the proposed project is located outside of public right-of-way and on the city owned property at 210 Third Street (Assessor's Parcel Number 014-101-07); and WHEREAS, the proposed project is intended for use by the public; and WHEREAS, a legal description and plat map to accompany the legal description have been prepared and stamped by a liscenced Land Surveyor for the dedication of the land; and WHEREAS, the 2,480 square feet of land dedication will encompass the entirety of the proposed project intended for public use. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Rafael that the Council does hereby approve the dedication of 2,480 square feet from the city owned property at 210 Third Street (Assessor's Parcel Number 014-101- 07) to the public right-of-way as described and depicted on attached Exhibit A, and authorizes the City Manager and City Clerk to record any documents that may be required to effectuate such dedication.
