RESOLUTION NO. 4570
RESOLUTION SETTING TIME AND PLACE FOR HEARING FOR
DETERMIUING PUBLIC CONVENIENCE AND NECESSITY IN
THE RAFAEL RACQUET CLUB ESTATES UTILITY UNDERGROUNDING
ASSESSMENT DISTRICT, CITY OF SAN RAFAEL, COUNTY OF
MARIN, STATE OF CALIFORNIA
WHEREAS, the City Council of the City of San Rafael, County
of Marin, State of California, has adopted a map showing the boun-
daries of proposed Rafael Racquet Club Estates Utility Undergrounding
Assessment District, City of San Rafael, Marin County, California, which
said map is entitled, "Proposed Boundaries of Rafael Racquet Club
Estates Utility Undergrounding Assessment District, City of San
Rafael, County of Marin, State of California;" and
WHEREAS, the owners of more than sixty per cent (60%) of the
real property within the boundaries of said proposed assessment dis-
trict have waived all investigation proceedings under the Special
Assessment Investigation, Limitation and Majority Protest Act of 1931
and have requested that said Act shall not be applicable to these pro-
ceedings;
NOW, THEREFORE, BE'IT RESOLVED by the City Council of the
City of San Rafael, Marin County, California, as follows:
1. That Monday, the 15th day of October, 1973, at the
hour of 8:00 o'clock P.M. of said day, is hereby fixed as the day and
hour, and the meeting place of the City Council of the City of San
Rafael, located in the City Hall, 1400 Fifth Avenue, San Rafael, Calif-
ornia, as the place, when and where any and all persons interested may
appear and show cause wry the City Council should not find and determine
that the public convenience and necessity require the said proposed
improvements and acquisitions to be made in said proposed assessment
district, without compliance with the provisions of the Special
Assessment Investigation, Limitation and Majority.Protest Act of 1931.

2. The time and place of hearing shall be given in accord-
ance with the provisions of Ordinance No. 590 of the City Council of
the City of San Rafael.
I HEREBY CERTIFY that the foregoing resolution was duly
and regularly adopted by the City Council of the City of San Rafael,
Marin County, California, at a regular meeting thereof, held on the
17th day of September, 1973, by the following vote, to wit:
AYES: Councilmen= Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini
NOES: Councilmen: None
